If a situation arises where we have a good faith belief that a claimant’s monetary offer to settle a covered claim is reasonable when you do not, then we will neither compel you to accept the settlement offer nor will we cease providing cover for such a claim merely because you did not accept the offer. However, if we recommend that you do accept such an offer and you elect not to, then our maximum payment toward that particular claim following the rejection or expiration of that offer ***will be outstanding covered defence costs*** incurred up to the date the settlement offer was rejected or expired, plus the amount of the unaccepted settlement offer, minus your remaining excess on the day the settlement offer is rejected or expires.

if you refuse the settlement offer, the insurance company will pay:
1. the costs incurred up to the moment when you refuse the offer
2. The amount offered in the settlement

En fait, je sais ce que signifie "outstanding", mais je n'avais pas compris la structure de la phrase. Vu que vous confirmez ce sens de "en souffrance", je comprends que cela signifie "notre paiement maximal se composera des frais non réglés"... J'avais en fait l'impression qu'il manquait quelque chose entre "will be" et "outstanding"...
