a) Selling and purchasing agents (or realtors)

In the case of a regular real estate transaction, the buyer and the seller often engage a real estate agent. His work can comprise, inter alia, an instruction to search for a suitable real estate object in a suitable environment, or to put a real estate object for sale on the market. The real estate agents can, furthermore, play an active role in negotiations on the purchase contract, often as concerns the commercial and technical components.

b) Notaries

In principle, the Dutch civil law notary acts as an independent counsel/adviser, who looks after the interests of both the seller and the buyer.

Particularly as regards larger commercial real estate, the civil law notary (not the real estate agent) often prepares the contract of sale, given that civil law notaries generally have more legal expertise pertaining to real estate than real estate agents. Under certain circumstances, parties engage an attorney-at-law who is specialised in real estate.
