Both terms are acceptable. The word 秘匿 is another word for "secrets" (秘密).保持 means "keeping" in this context, and is used very frequently in conjunction with 秘密 or 秘匿 (秘匿保持,秘密保持) to mean confidentiality. I have seen 秘匿保持契約,秘密保持契約 translated as confidentiality agreement, and also as non-disclosure agreement.
The fine English nuances would be more like:
Confidentiality agreement: agreement to keep secrets
Non-disclosure agreement: agreement not to disclose secrets
So I think it is really up to you.

I haven't met this precise term, but in general one may talk about 'keeping something secret' (confidentiality) and 'retention' (the users descretion in retaining (and conversely selling) the IP.
