Weil er mit einem dieser Männer im Sommer 1997 ein Monat vor dessen 18. Geburtstag sexuellen Kontakt hatte, verurteilte ihn das Klagenfurter Landesgericht auch auf Grund des antihomosexuellen Sonderstrafgesetzes § 209 StGB. Obwohl der damals 30jährige Mann den 17 Jahre und 11 Monate alten jungen Mann lediglich oral befriedigte sah der Richter auch in diesem Fall die Gefahr der Übertragung des Hi-Virus (!) und damit den § 178 StGB als erfüllt an. Die Strafe: 1 Jahr Freiheitsstrafe, davon drei Monate unbedingt.


Since with one of his partners in summer 1997 he had sexual contact one month before his 18th birthday, the court also convicted him under the anti-homosexual statute Art. 209 CC (which stipulates an age of consent of 18 for gay male relations as opposed to 14 for lesbians and heterosexuals). In spite of the fact that the then 30 year old man just himself orally satisfied the 17 years and 11 months old young man the judge even in these contacts saw a danger of transmission and therefore a breach of Art. 178 CC. The sentence: 1 year imprisonment, three month of them unsuspended.

Defendant tries to distinguish St. Francis by arguing that the record does not support the interpretation that all pre-release behavior is covered by the probation conditions, and by further arguing that the parties and the court intended Condition 15 to apply only after defendant's release from the unsuspended part of his sentence. Under defendant's theory, failure in his pre-release therapy could result only in adverse prison classification and parole board action, not probation revocation.
