Qassim Soleimani, who was killed by a US airstrike ordered by President Donald Trump at Baghdad International Airport on Friday, was hailed as a hero in Iran -- brave, charismatic and beloved by the troops.
Iran's supreme leader, Ayatollah Ali Khamenei, once called him a "living martyr of the revolution." But the United States viewed Iran's top general as a ruthless killer.
One of Iran's most powerful men, Soleimani cut a highly controversial figure. He was head of the Revolutionary Guards' Quds Force, an elite unit that handles Iran's overseas operations and one deemed to be a foreign terrorist organization by the US. Having started his front line military career in the Iran-Iraq war during the early 1980s, Soleimani rose to prominence to become an indispensable figure in Iran, playing an instrumental role in spreading its influence in the Middle East.

"He's been in combat his entire life. His soldiers love him. He's a quiet, charismatic guy, a strategic genius and a tactical operator," Lieutenant General Mark Hertling, a national security, intelligence and terrorism analyst, told CNN.

تعتبر مسؤولية حماية المرأة من العنف المبني على النوع االجتماعي في مسيرات العودة مسؤولية مشتركة بين
دولة االحتالل اإلسرائيلي والسلطة الفلسطينية. حيث أن دولة االحتالل اإلسرائيلي مسؤولة بشكل مباشر وغير
مباشر عن العنف المبني على النوع االجتماعي في هذه المسيرات، كما أن تبعات العنف الذي تمارسه سلطات
االحتالل، والذي ينعكس على المجتمع الفلسطيني ككل، وعلى المرأة الفلسطينية بشكل خاص، والتي تواجه
أ مختلفة من العنف المبني على النوع االجتماعي جراء ذلك، تتحمل السلطة الفلسطينية مسؤولة توفير
نماطاً
الحماية الالزمة للنساء منه. وبالتالي، على كل من االحتالل اإلسرائيلي والسلطة الفلسطينية توفير اآلليات
الالزمة لحماية المرأة الفلسطينية من العنف المبني على النوع االجتماعي في مسيرات العودة. يقسم هذا الفصل

يوجد عدد من الوسائل التي يمكن أن تستخدمها المرأة لحملبنى نفسها من العنف المبني على النوع االجتماعي
أو لالنتصاف في حال التعرض للعنف. وتشمل هذه الوسائل ما توفره سلطات االحتالل اإلسرائيلي من آليات
قانونية يمكن للفلسطينيين اللجوء لديها للشكوى والمقاضاة، على الرغم من عدم فاعليتها. وكذلك تشمل هذه
اآلليات الوسائل التي توفرها السلطة الفلسطينية للحملبنى واالنتصاف للمرأة من العنف المبني على النوع

للوصول إلى اآلليات الدولية لمالحقة مجرمي الحرب، وخاصة المحكمة الجنائية الدولية. ويمكن للفلسطينيين
رفع دعاوى مدنية لطلب التعويض أما المحاكم اإلسرائيلية عن اإلصابات التي تعرضوا لها، ولكن بشروط
معينة. كما يمكن تقديم شكاوى للنيابة العسكرية االسرائيل ية لحثها على التحقيق في اعتداءات جيش االحتالل
على المدنيين الفلسطينيين. وهذه الوسائل يمكن –نظرياً- لضحايا مسيرات العودة، ومن ضمنهم النساء، اللجوء
يوجد الكثير من العراقيل التي تعيق الوصول للعدالة اإلسرائيلية وتعدم
لها لالنتصاف والتعويض، ولكن واقعياً
فعاليتها. وقد عقلت مؤسسة بيتسيلم االسرائيلية على منظومة العدالة اإلسرائيلية الموفرة للفلسطينيين بما يلي:
ّي "أنشأت إسرائيل منظومة ال تنتج سوى صورة زائفة توهم بتطبيق القانون - معًا.
في المستويين الجنائي والمدن
نتيجة لذلك ال يعاقَب المسؤولون وال يحظى الضحايا بالتعويض عن إلحاق األضرار بهم. هكذا هو الوضع سوى
في حاالت قليلة واستثنائية تُستخدم فقط لتضخيم اإليحاء بأ ّن جهاز تطبيق القانون يعمل كما ينبغي." وعادة ما
يلجأ الضحايا لمؤسسات حقوق اإلنسان العاملة في قطاع غزة، وابرزها المركز الفلسطيني لحقوق اإلنسان، لكي
يتمكنوا من الوصول آلليات العدالة. فيما يأتي تبيان وسائل العدالة اإلسرائيلية التي يمكن للنساء اللجوء إليها
لالنتصاف والتعويض.
1 .النيابة العسكرية اإلسرائيلية
تعتبر النيابة العسكرية اإلسرائيلية الجهة المسؤولة عن محاسبة التجاوزات التي يقوم بها جنود االحتالل
اإلسرائيلي، بما فيها االعتداءات على الفلسطينيين. وبالتالي، يلقى على عاتق النيابة العسكرية واجب متابعة هذه
التجاوزات ومالحقة مرتكبيها، من خالل التحقيق في الحادثة واالحالة للمحكمة المختصة لمحاكمة الجنود في
حال تبين تورطهم في ارتكاب مخالفات أو جرائم، ومن ضمنها الجرائم ضد الفلسطينيين. ويكون للضحايا حق
تقديم شكاوى أمام مكتب المدعي العسكري اإلسرائيلي بخصوص االنتهاكات التي تعرضوا لها، وهذا يتم بالعادة
من خالل توكيل محامي أو من خالل أحد المراكز الحقوقية، واألخيرة هي الصورة األغلب في هذه الحالة.
ويعتبر المركز الفلسطيني لحقوق اإلنسان في قطاع غزة، من أكثر المراكز التي تقدم شكاوى عن الضحايا
الفلسطينيين، ومن ضمنهم ضحايا مسيرات العودة. وعادة ما تواجه المراكز الحقوقية بكثير من العقبات
والمماطالت لتفعيل شكوى أمام النيابة العامة أبرزها ما يلي: تجاهل النيابة ألغلب الشكاوى دون رد؛ الردود
تكون بالعادة سلبية تفيد بعدم وجود حاجة لفتح تحقيق؛ اذا تم فتح تحقيق فعادة ما ينتهي دون توجيه اتهامات؛
المماطلة لفترة طويلة، قد تصل لسنوات، وتنتهي دائما دون انصاف للضحايا؛ والقيود على حرية الحركة
للفلسطينيين وإمكانية اعتقالهم، مما تجعل الشهود غير قادرين على تقديم شهاداتهم أمام الجهات القضائية.
Translation - English Chapter 3: Interventions and mechanisms needed by officials and civil
society to combat gender-based violence related to return marches
The responsibility of protecting women from gender-based violence in the marches of
return is shared by the Israeli occupying Power and the Palestinian Authority. The State
of Israeli occupation is directly and indirectly responsible for gender-based violence in
these marches. The consequences of the violence by the occupying authorities, which
is reflected in Palestinian society as a whole, and on Palestinian women in particular,
who face different types of gender-based violence as a result, are the responsibility of
the Palestinian Authority to provide women with the necessary protection.
Consequently, both the Israeli occupation and the Palestinian Authority must provide
mechanisms to protect Palestinian women from gender-based violence in the return
marches. This chapter is divided into three studies, the first one deals with the available
official mechanisms to combat gender-based violence during or on the occasion of the
return marches. The second study deals with civil society mechanisms available to
combat gender-based violence during or on the occasion of return marches. The third
research addresses interventions to combat gender-based violence during or on the
occasion of marches of return.
First: Official mechanisms available to combat gender-based
violence during or on the occasion of return marches.
There are a number of ways in which women can protect themselves from gender-based
violence or equity in the event of violence. These include the legal mechanisms that the
Israeli occupation authorities provide, although not effective, for Palestinians to lodge
complaints and prosecutions. These mechanisms also include the means provided by
the Palestinian Authority to support and rectify gender-based violence against women.
The Israeli justice system and the Palestinian justice system were presented in two
sections
First Division : Israeli means of justice:
Palestinians can resort to Israeli justice mechanisms in case one of them was attacked
by the occupation authorities. Even if the history of these means shows that they are
neither effective nor just, they are an emergency way of reaching international
mechanisms to prosecute war criminals, particularly the International Criminal Court.
Palestinians can institute civil claims for compensation, either in Israeli courts for injuries
suffered, but on certain conditions. Complaints could also be filed with the Israeli military
prosecution urging it to investigate the occupation army's attacks on Palestinian civilians.
These means can, in theory, be used for the victims of the return marches, including
women, to seek redress and compensation, but actually there are many obstacles that
hinder the Israeli justice and its ineffectiveness, The Israeli Bizelem Foundation has
commented on the Israeli justice system that provides the Palestinians with the following
" Israel has created a system that produces only a fake image of the law's enforcement -
both criminal and civil. As a result, officials are not punished and victims are not
compensated for their damage. This is the case only in a few exceptional cases used to
exaggerate the argument that the law enforcement system is functioning properly"
Victims usually resort to human rights institutions operating in the Gaza Strip, notably the
Palestinian Center for Human Rights, to gain access to justice mechanisms. Meanwhile,
Israeli justice means that women can resort to for rectification and compensation are
mentioned"
1-Israeli military Prosecution:
The Israeli military Prosecution is responsible for holding accountable the excesses committed
by the Israeli occupation soldiers, including the attacks on the Palestinians. The military
prosecution has therefore a duty to monitor and prosecute such abuses, by investigating the
incident and referring to the competent court to try soldiers in case they are found to be
involved in committing offenses or offenses, including offenses against Palestinians. Victims
have the right to lodge complaints with the Israeli military prosecutor's office concerning the
violations they have suffered, usually through the office of a lawyer or through a center of
rights, the latter being the most likely picture in this case. The Palestinian Center for Human
Rights in the Gaza Strip is one of the most complaints centers for Palestinian victims, including
victims of the return marches. The human rights centers often face many obstacles and
procrastination to activate a complaint before the Public Prosecutor's Office, the most notable
