This section provide useful link to Iraqi Legal Database (ILD) developed by the Iraqi Higher Judicial Council (HJC), Ministry of Justice (MoJ), and Kurdistan Ministry of Justice (KMoJ), supported by UNDP's Programme on Governance in the Arab Region (POGAR) and UNDP-Iraq.
Iraqi Legal Database is a smart and developed standard database which is guided by to build an Iraqi comprehensive legal information bank. In addition to legislations, ILD contains national judicial verdicts accounting and interpreting the related legal provisions. Provisions of laws related to Code of Criminal Procedure, Penal Code, and Commercial Law have been documented and linked to legal terms and terminologies expressing their contents. It also includes legal glossary automatically linking the similar and synonymous phrases. ILD also contains also the modern laws of 2007 and laws of Kurdistan Regional Government (KRG) from 1992 to the end of 2007.
The Iraqi legal Database contains 27.500 laws, i.e. 187.000 articles distributed to the Iraqi Official Gazette since its issuance in 1917 till 2007 -number of issues reaches 113 issues, namely 70.000 pages – and the Kurdistan Official Gazette from 1992 to 2007 - number of issues reaches 113 issues, namely 70.000 pages. 172 Iraqi verdicts and 103 verdict passed by courts of KRG were also incorporated into the ILD.
The Iraqi Legal Database contains the following:
- Legislative and regulatory legislation: this legislation varies from laws and resolutions to decrees enacting laws and regulations of general and ongoing nature and not of personal or individual nature. Example of these are company law, law of the Planning Authority, presidential decree regarding the issuance of banknote of 250 dinars, regulations of Ministry of Transportation, formation of ongoing appellate commission in the Ministry of Labour (resolution).
- Other legislation: it is legislation related to main legislation such as explanatory notes, forms, laws or amended or repealed laws; e.g. amended or repealed articles of the Iraq company law such as article 203 repealed from company law No. 36 of 1983.
- On the other hand, legislation related to individual and personal issues were excluded such as the appointment and dismissal of staff and determination of their salaries…..whatever their origin, whether they are decrees, resolutions or statements..., for example: appointment of Mr. Adnan Abdul Majid Jassim, Minister of Industry and Minerals, or dismissal of Minister of Agriculture from his office (Presidential Decree). Education
Subject to Law of the Ministry of Education No. (34) of 1998 and the Law of the Ministry of Higher Education and Scientific Research No. (40) of 1988, Ministry of Education shall be responsible for pre-school, primary and secondary education, while Ministry of Higher Education and Scientific Research shall be responsible for higher education and scientific research.
The education system in Iraq consists of the following:

Fines for Motor Vehicle Violations
Fine regulations regarding traffic violations includes the following:
A. Anyone who commits the following violations shall be fined thirty thousand dinars (30.000 ID):
1. Failure to obey traffic lights or traffic police signal;
2. Driving against traffic;
3. Driving without front or rear lights at night;
4. Driving a vehicle without registration plate;
5. Reckless or negligent driving;
6. Driving at a speed greater than reasonable or in excess of speed limit;
7. Failure to register vehicle within 30 days of purchase;
8. Violating the rules of traffic on highways;
9. Violating instructions or statements issued by the General Directorate of Traffic.
B. Anyone who commits the following violations shall be fined twenty thousand dinars (20.000 ID):
1. Failure to cover the cargo securely to prevent cargo from falling during driving or shaking;
2. Parking in no-parking area;
3. The use of tinted windows or textile or metal curtains on rear or side windows;
4. Turning in the places where it in not allowed to turn;
5. Failure to stop when exiting from side road to main road;
6. Failure to yield the right of way to pedestrians.
C. Anyone who commits the following violations shall be fined fifteen thousand dinars (50.000 ID):
1. Stopping large trucks, buses, construction or agricultural vehicles in travel lanes, on internal streets or in residential regions, except when loading or unloading;
2. Carrying cargo in trucks in excess of height requirements;
3. Driving a vehicle with damaged or unclear registration plate;
4. Failure to use safety belts in moving vehicle;
5. Improper use of air horns, multi-tone horns, outer microphones, horns like animal sounds, including use of horns other than factory installed or equivalent;
6. Passing a vehicle on the right side on roadways.
D. Anyone who commits the following violations shall be fined ten thousand dinars (10.000 ID):
1. Improper use of high beam lights affecting other drivers;
2. Driving a vehicle that doesn’t meet the minimum safety standards for equipment (as stipulated in section 13 of this law);
3. Putting stickers, decorations or notices on the front windshield or rear window;
4. Violating the rules of safe driving;

يوفر هذا القسم الوصول الى قاعدة التشريعات والتنظيمات العراقية ، التي تم تطويرها من قبل مجلس القضاء الأعلى العراقي, ووزارة العدل العراقية, ووزارة العدل بحكومة إقليم كردستان , بدعم من برنامج إدارة الحكم في الدول العربية (POGAR) التابع لبرنامج الأمم المتحدة الإنمائي (UNDP)، وبرنامج الأمم المتحدة الإنمائي - العراق (UNDP-Iraq).
وتعتبر قاعدة التشريعات والتنظيمات العراقية، قاعدة معلومات نموذجية وذكية و متطورة يسترشد بها لبناء بنك معلومات قانوني عراقي شامل، حيث تضمنت بالإضافة إلى التشريعات القانونية أحكاما قضائية وطنية تعلل وتفسر المواد القانونية المرتبطة. كما تم توثيق مواد التشريعات القانونية المرتبطة بقانون اصول المحاكمات الجزائية، قانون العقوبات والقانون التجاري ، وقد جرى ربطها بعناوين ومصطلحات قانونية تعبر عن مضمونها وإضافة مكنز يسمح بربط آلي للعبارات المرادفة والمتشابهة، وإضافة التشريعات العراقية الحديثة أي العائدة لعام 2007 والتشريعات الخاصة بإقليم كردستان من تاريخ 1992 ولغاية آخر عام 2007.
تضم قاعدة التشريعات العراقية 27500 تشريعاً قانونياً أي ما يعادل 187000 مادة قانونية موزعة بين جريدة الوقائع العراقية من تاريخ صدورها عام 1917 لغاية آخر عام 2007 وبلغ عددها حوالي 113 عدداً ما يعادل 70.000 صفحة، وجريدة الوقائع الكردستانية من تاريخ 1992 لغاية آخر عام 2007 وبلغ عددها حوالي 70 عدداً ما يعادل 1000 صفحة. بالإضافة الى 172 حكم قضائي عراقي و 103 حكم قضائي صادر عن المحاكم التابعة لإقليم كردستان.
وتتضمن قاعدة التشريعات والتنظيمات العراقية ما يلي:
التشريعات الأساسية ذات الطابع التشريعي والتنظيمي: تتوزع هذه التشريعات المصنفة بين القوانين والقرارات والمراسيم التي تقضي بسن تشريعات قوانين أو بوضع أنظمة لها طابع عام ومستمر وليس لها اي طابع شخصي أو فردي. مثال : قانون الشركات، قانون هيئة التخطيط، إصدار ورقة نقدية فئة 250 دينار(مرسوم جمهوري)، نظام وزارة النقل والمواصلات (نظام)، تشكيل لجنة استئنافية دائمة في وزارة العمل (قرار).
التشريعات الإضافية : وهي تشريعات ترتبط بالتشريعات الأساسية مثال المذكرات الإيضاحية، النماذج، القوانين أو التشريعات المعدلة أو الملغاة للاستئناس بها، مثال: المواد المعدلة أو الملغاة من قانون الشركات العراقي كالمادة الملغاة رقم 203 من قانون الشركات رقم 36 لسنة 1983.
وبالمقابل تم استبعاد التشريعات القانونية المتعلقة بمواضيع فردية وشخصية كتعيين الموظفين وتحديد رواتبهم وإنهاء خدماتهم ... مهما كان مصدرها سواء أكانت مراسيم أو قرارات أو بيانات...، مثال: تعيين عدنان عبد المجيد جاسم وزيرا للصناعة والمعادن أو إعفاء وزير الزراعة من منصبه (مرسوم جمهوري)، والتشريعات القانونية ذات المفعول المؤقت والتي ينقضي اجلها بفترة معينة، بالإضافة إلى استبعاد التقارير والاقتراحات والاستشارات.

لقد حدد قانون تسجيل الولادات والوفيات المرقم (148) لسنة 1971 وتعديلاته الضوابط الخاصة بتنظيم وتسجيل شهادات الولادة والوفاة والذي يعتمد من قبل المؤسسات الصحية الحكومية والأهلية والقابلات وتعتبر شهادات الولادة والوفاة من الوثائق الرسمية المهمة في تسجيل الولادات في دوائر الأحوال وترقين قيود المتوفين .
مراكز الرعاية الصحية الاولية
تقدم مراكز الرعاية الصحية الاولية الخدمات الوقائية والعلاجية الاساسية والقحوصات التشخيصية مما يمكن من تغطبة كافة الاحتياجات الاساسية للمجتمع ضمن الرقعة الجغرافية للمركز الصحي الواحد. و كذلك ترسيخ الوعي الصحي و المعرفي لدى المواطنين حول ماهية عمل المؤسسات الصحية و بالخصوص المراكز الصحية الأولية.
وتتوزع المراكز الصحية من حيث الاعداد والموقع الجغرافي على اساس الضوابط التخطيطية والتي تتركز اساسا على حجم السكان في المنطقة المخدومة من قبل كل مركز صحي وكذلك على اساس مؤشرات اخرى منها البعد عن اقرب مؤسسة صحية، وترتبط المراكز الصحية اداريا وفنيا بقطاعات الرعايا الصحية الاولية في بغداد والمحافظات على اساس الرقعة الجغرافية والتقسيمات السكانية للمحافظات. بحيث يخدم كل قطاع من هذه القطاعات مايقارب من (200000 – 300000) الف نسمة في الوقت الحاضر والفرعي مايقارب من (3000 – 10000) نسمة.
وتتضمن الخدمات الصحية الاساسية للرعاية الصحية الاولية المقدمة من المراكز الصحية التالي:
- رعاية الام والطفل
- صحة الطفل
- السيطرة على الامراض الانتقالية
- التغذية

التعليم
وبناء على قانون وزارة التربية رقم (34) لسنة 1998 وقانون وزارة التعليم العالي والبحث العلمي رقم (40) لسنة 1988، فان وزارة التربية والتعليم تكون مسؤولة عن المراحل التعليمية ماقبل المدرسة والابتدائي والثانوي، بينما تختص وزارة التعليم العالي والبحث العلمي في مراحل التعليم العالي والبحث العلمي.
هذا ويتكون النظام التعليمي في العراق من الاتي:
ا - مرحلة التعليم الابتدائي ومدتها ست سنوات .
ب - مرحلة التعليم الثانوي ومدتها ست سنوات وتتكون من مستويين، المستوى المتوسط ومدته ثلاث سنوات والمستوى الاعدادي ومدته ثلاث سنوات، وينقسم الى نوعين عام ومهني .
وتعتبر مدة التعليم الاساسي تسع سنوات تتكون من مرحله الدراسة الابتدائية ومدتها ست سنوات مستوى الدراسة المتوسطة ومدته ثلاث سنوات . حيث تسعى وزارة التربية والتعليم الى تعميمه والزاميته.
المركبات والغرامات
وتتضمن لائحة الغرامات الخاصة بالمخالفات المرورية التالي:
أ. يعاقب كل من ارتكب مخالفة من المخالفات الاتية بغرامة مقدارها (30000) ثلاثون الف دينار وهي كما يلي:
1. مخالفة عدم امتثال السائق لاشارات المرور الضوئية او اشارة رجل مرور.
2. مخالفة قيادة مركبة بصورة معاكسة لوجهه المرور (عكس السير) المقرر من سلطات المرور.
3. مخالفة قيادة مركبة بدون اضوية امامية وخلفية ليلاً
4. مخالفة قيادة مركبة خالية من لوحات التسجيل.
5. مخالفة قيادة مركبة بسرعة تزيد على السرعة المقررة قانوناً.
6. مخالفة قيادة المركبة باهمال ورعونة
7. مخالفة مضي (30) ثلاثون يوماً على كتاب بيع المركبة وعدم مراجعة دوائر التسجيل المختصة لغرض تسجيلها او تثبيت موقفها.
8. مخالفة تجاوز قواعد السير والمرور على الطرق السريعة.
9. مخالفة تجاوز البيانات والتعليمات الصادرة من مديرية المرور العامة.
ب. يعاقب كل من ارتكب مخالفة من المخالفات الاتية بغرامة مقدارها (20000) عشرون الف دينار وكما يلي:-
1. مخالفة عدم تغطية حمولة مركبات الحمل بصورة محكمة وبشكل يؤمن عدم تطاير او تناثر او تساقط الحمولة اثناء سيرها او ارتجاجها.
2. مخالفة ايقاف المركبة في الاماكن التي يمنع فيها الوقوف.
3. مخالفة استخدام الزجاج المضلل في نوافذ المركبات او وضع الستائر النسيجية او المعدنية حاجبة للرؤيا على الزجاج الخلفي والجانبي.
4. مخالفة الاستدارة من الاماكن الغير مسموح الاستدارة فيها.
5. مخالفة عدم التوقف عند الخروج من شارع فرعي الى شارع رئيسي.
6. مخالفة عدم اعطاء الاسبقية للمشاه الذين وطئوا منطقة العبور.
ج. يعاقب كل من ارتكب مخالفة من المخالفات الاتية بغرامة مقدارها (15000) خمسة عشر الف دينار وكما يلي:
1. مخالفة ترك او مبيت مركبات الحمل الكبيرة والانشائية والزراعية والحافلات في الازقة والشوارع الداخلية والمناطق السكنية ولايشمل ذلك ايقافها ضمن المدة المنتظمة للتفريغ والتحميل.
2. مخالفة تجاوز الارتفاع المقرر لحمل المواد في سيارات الحمل وفق ما تحدده دوائر المرور.
3. مخالفة قيادة مركبة ذات لوحة تسجيل غير واضحة او تالفة.
4. مخالفة استعمال حزام الامان في المركبات التي تتوفر فيها احزمة الامان اثناء سيرها في الطرق العامة.
5. مخالفة استعمال جهاز التنبيه الهوائي او المتعدد النغمات او وضع سماعات كبيرة خارجية او استعمال المنبهات بصوت عال او على شكل اصوات الحيوانات غير التي تكون اصلاً من المنشأ.
6. مخالفة عدم اجتياز السائق لسيارة اخرى من الجهة اليمنى او الاجتياز الخاطئ.
د. يعاقب كل من ارتكب مخالفة من المخالفات الاتية بغرامة مقدارها (10000) عشرة الاف دينار وكمايلي:
1. مخالفة استعمال الضوء العالي بالشكل الذي يؤثر على سائقي المركبات الاخرى.
2. مخالفة قيادة مركبة لا تتوفر فيها الحد الادنى من شروط المتانة والامان (المنصوص عليها في القسم 13 من هذا القانون).
3. مخالفة وضع ملصقات الزينة والاعلان والكتابة والرسم على زجاج السيارات الامامي والخلفي المؤثر على الرؤيا.
4. مخالفة قواعد السير الامن.
5. مخالفة عدم تجديد اجازة السوق او اجازة التسجيل.

Source text - English 4.3 Fixed charge
To the extent that any asset expressed to be assigned pursuant to clause 4.1 (Assignment of Receivables) is not effectively so assigned by that clause, the Assignor charges and agrees to charge by way of first fixed charge all its right, title and interest in and to that asset.
5. NOTICE TO TENANT
(a) The Assignor and/or the Real Estate Agent shall give notice of such assignment to the relevant Tenants in the form set out at Schedule 1 and shall, as soon as reasonably practicable, provide copies of such notices to the Lender.
(b) In the event that the Assignor or the Real Estate Agent does not give the notice or notices referred to at clause (a) above, the Lender shall be entitled to notify the relevant Tenants of the assignments created by this Agreement in any form acceptable to the Lender.
6. CONDITION OF DEPOSIT
No monies at any time standing to the credit of any account (of any type and however designated) of the Assignor with the Lender or in which the Assignor has an interest (and no rights and benefits relating thereto) shall be capable of being assigned to any third party.
7. CONTINUING SECURITY
7.1 Continuing security
The Security is continuing and will extend to the ultimate balance of the Secured Obligations regardless of any intermediate payment or discharge in whole or in part. This Agreement shall remain in full force and effect as a continuing security for the duration of the Security Period.
7.2 Additional and separate security
This Agreement is in addition to, without prejudice to, and shall not merge with, any other right, remedy, guarantee or Security Interest which the Lender may at any time hold for any Secured Obligation.
7.3 Right to enforce
This Agreement may be enforced against the Assignor without the Lender first having recourse to any other right, remedy, guarantee or Security Interest held by or available to it.
8. LIABILITY OF THE ASSIGNOR RELATING TO SECURITY ASSETS
Notwithstanding anything contained in this Agreement or implied to the contrary, the Assignor remains liable to observe and perform all conditions and obligations assumed by it in relation to the Security Assets. The Lender is under no obligation to perform or fulfil any such condition or obligation or to make any payment in respect of any such condition or obligation.
9. REAL ESTATE AGENT
9.1 Appointment of Real Estate Agent
The Assignor hereby acknowledges that the Lender may appoint a Real Estate Agent of the Lender’s choice or require the Assignor to appoint a Real Estate Agent, such appointment being subject to the Lender’s prior approval. The Real Estate Agent shall carry out the following:
(a) Execute any tenancy and/or sale agreements with respect to the Properties.
(b) Present the Schedule 1 Form of Notice to Tenant(s) for execution.
(c) Act on the Lender’s behalf in ensuring the collection of Receivables and their timely deposit in any Initial Collection Account or Collection Account.
9.2 Power of Attorney to Real Estate Agent
The Assignor agrees to grant a power of attorney to the Real Estate Agent
9.3 Assignor's Indemnity
The Assignor agrees to indemnify and keep indemnified the Lender against any costs, disbursements and other expenses or charges ("REA Charges") rendered by the Real Estate Agent in relation to the collection of the Receivables and any related activities.
9.4 Payment of REA Charges
The Assignor agrees to pay the REA Charges within two Business Days of receipt by the Assignor of a demand for payment from the Lender.
9.5 Additional Assurance
The Assignor shall, at its own cost and expense, give such assistance as may, in the sole opinion of the Lender be required by the Real Estate Agent or the Lender to facilitate the collection of the Receivables.
10. COLLECTION OF RECEIVABLES
10.1 Payment into Collection Account
The Assignor shall:
(a) immediately upon receipt pay all monies which it receives in respect of the Receivables into:
(i) the Initial Collection Account; or
(ii) such other account(s) with the Lender as the Lender may from time to time direct
(each such account together with all additions to or renewals or replacements thereof (in whatever currency) being a "Collection Account"); and
(b) pending payment into the Collection Account, hold all monies so received upon trust for the Lender.
10.2 Direct payment
The Assignor shall, if the Lender so directs, ensure that each Tenant pays all monies in respect of Receivables directly into the Collection Account.
10.3 Dealings with Tenants
The Assignor shall not without the prior written consent of the Lender:
(a) release, exchange, compound, set-off, grant time or indulgence or commute the liability of any Tenant in respect of any Receivable (whether by reducing the amount due or extending the time for payment or otherwise); or
(b) permit any Receivable to be subordinated or postponed or do or permit to be done anything which may delay or prejudice a full recovery thereof,
or agree or attempt to do so.
10.4 Further action
Without limiting the generality of clause 19 (Further assurances), if required to do so by the Lender the Assignor shall at its own cost:
(a) execute a legal assignment of all or any of the Receivables in such form as the Lender may require;
(b) give notice of such assignment to the relevant Tenants;
(c) take any other steps which the Lender may require to perfect that assignment; and/or
(d) in the case of negotiable instruments, endorse all documents necessary to constitute the Lender the holder of such documents.
11. COLLECTION ACCOUNTS
11.1 No withdrawals
The Assignor shall not, without the prior written consent of the Lender, withdraw, attempt or be entitled to withdraw (or direct any transfer of) all or any part of the monies standing to the credit of any Collection Account. The Lender shall be entitled (in its absolute discretion) to refuse to permit any such withdrawal or transfer.
11.2 No variation
The Assignor shall not, without the prior written consent of the Lender, permit or agree to any variation of any right attaching to any Collection Account.
11.3 Application of monies in Collection Accounts
The Lender is authorised at any time or times (whether or not an Event of Default has occurred) without notice to the Assignor to apply any monies standing to the credit of any Collection Account against any of the Secured Obligations which is due and payable.
12. REPRESENTATIONS
12.1 General
The Assignor makes the representations and warranties set out in this clause 12 to the Lender.
12.2 No Security Interests
The Security Assets are, or when acquired will be, beneficially owned by the Assignor free from any Security Interest other than as created by this Agreement.
12.3 No avoidance
This Agreement creates the Security Interests which it purports to create and is not liable to be avoided or otherwise set aside on the liquidation, bankruptcy or dissolution of the Assignor or otherwise.
12.4 Ownership of the Security Assets
The Assignor is the sole legal and beneficial owner of the Security Assets.
12.5 Receivables
All Receivables:
(a) arise from the sale or lease on normal commercial terms of property or goods which have been made available, delivered or shipped to an account Tenant in accordance with the Relevant Contract;
(b) constitute valid and binding obligations of the relevant Tenants;
12.6 Relevant Contracts
(a) Payments by parties to each Relevant Contract are not subject to rights of set-off or similar rights.
(b) Each Relevant Contract constitutes the legal, valid and binding obligation of each party to it.
(c) The Assignor is not in default of any of its obligations under any Relevant Contract.
(d) There is no prohibition on assignment of any Relevant Contract and the Assignor's entering into this Agreement will not constitute a breach of any Relevant Contract.
12.7 Time when representations made
(a) All the representations and warranties in this clause 12 are made by the Assignor on the date of this Agreement and are also deemed to be made by the Assignor on each subsequent day during the Security Period.
(b) Each representation or warranty deemed to be made after the date of this Agreement shall be deemed to be made by reference to the facts and circumstances existing at the date the representation or warranty is deemed to be made.
13. UNDERTAKINGS BY THE ASSIGNOR
13.1 Restrictions on dealing
The Assignor shall not do or agree to do any of the following without the prior written consent of the Lender:
(a) create or permit to subsist any Security Interest on any Receivable or any other Security Asset other than as created by this Agreement; or
(b) sell, transfer, lease, lend, assign, charge, factor or discount or in any other manner deal with or dispose of (whether by a single transaction or a number of transactions and whether related or not) the whole or any part of its interest in any Receivable or other Security Asset.
13.2 General dealings with Receivables
The Assignor shall deal with the Receivables (both collected and uncollected) and any Collection Account in accordance with any directions given in writing from time to time by the Lender and, in default of and subject to such directions, only in accordance with this Agreement.
13.3 Access
The Assignor shall permit the Lender (or its designated representatives) on reasonable written notice:
(a) access during normal office hours to its offices, accounts, computer or other records and such other papers or records of the Assignor as the Lender may desire;
(b) to inspect such records and to take extracts from and make photocopies or other copies of the same,
and shall provide (at the expense of the Assignor) such clerical and other assistance which the Lender may reasonably require to do this.
13.4 General information
The Assignor shall provide to the Lender:
(a) such information as to the amount and nature of the Receivables as the Lender may from time to time reasonably require (taking into account the requirements of the Finance Documents); and
(b) any other information which the Lender may reasonably request in relation to the Security Assets;
13.5 Relevant Contracts
(a) The Assignor shall not, except with the prior written consent of the Lender (which for the puposes of this Clause 13.5a) may be provided directly by the Real Estate Agent on behalf of the Lender), amend or waive any term of any Relevant Contract, terminate any Relevant Contract or release any other party from its obligations under any Relevant Contract.
(b) The Assignor shall duly perform its obligations under each Relevant Contract and shall notify the Lender of any material default by it or any other party under any Relevant Contract.
(c) The Assignor shall, as soon as practicable upon receipt, provide to the Lender copies of all notices which it may from time to time receive from any other party to any Relevant Contract.
13.6 No prejudicial action
(a) The Assignor shall not take or omit to take any action which will reduce or impede recoveries in respect of any Security Asset.
(b) The Assignor shall not do, cause or permit to be done anything which may in any way depreciate, jeopardise or otherwise prejudice the value or marketability of any Security Asset (or make any omission which has such an effect).
14. NO OBLIGATIONS OF LENDER
Without prejudice to clause 8 (Liability of the Assignor relating to Security Assets) the Lender shall not be obliged to:
(a) take any steps necessary to preserve, realise or enforce any Security Asset;
(b) enforce any Receivable (or term of any Relevant Contract) against any Tenant or any other person; or
(c) make any enquiries as to the nature or sufficiency of any payment received by it pursuant to this Agreement.
15. POWER TO REMEDY
15.1 Power to remedy
If at any time the Assignor does not comply with any of its obligations under this Agreement, the Lender (without prejudice to any other rights arising as a consequence of such non-compliance) shall be entitled (but not bound) to rectify that default. The Assignor irrevocably authorises the Lender and its employees and agents (including without limitation the Real Estate Agent) by way of security to do all things (including entering the property of the Assignor) which are necessary or desirable to rectify that default.
15.2 Monies expended
The Assignor shall pay to the Lender on demand any monies which are expended by the Lender in exercising its powers under this clause 15.
16. WHEN SECURITY BECOMES ENFORCEABLE
16.1 When enforceable
This Security shall become immediately enforceable upon the occurrence of an Event of Default and shall remain so for so long as such Event of Default is continuing.
16.2 Enforcement
After this Security has become enforceable, the Lender may in its absolute discretion enforce all or any part of the Security in such manner as it sees fit.
17. APPLICATION OF PROCEEDS
17.1 Application
All monies received by the Lender under or in connection with this Agreement or the Security Assets (or standing to the credit of any Collection Account) after the Security has become enforceable shall (subject to the rights and claims of any person having a security ranking in priority to the Security) be applied in the following order:
(a) first, in satisfaction of, or provision for, all costs, charges and expenses incurred, and payments made by the Lender;
(b) secondly, in or towards the satisfaction of the remaining Secured Obligations; and
(c) thirdly, in payment of any surplus to the Assignor or other person entitled to it.
18. DELEGATION
The Lender may delegate, by power of attorney (or in any other manner) to any person, any right, power or discretion exercisable by it under this Agreement upon any terms (including power to sub-delegate) which it may think fit. The Lender shall be in any way liable or responsible to the Assignor for any loss or liability arising from any act, default, omission or misconduct on the part of any such delegate or sub-delegate.
19. FURTHER ASSURANCES
The Assignor shall, at its own expense, promptly take whatever action the Lender may require for:
(a) creating, perfecting or protecting the Security Interests intended to be created by this Agreement; and
(b) facilitating the realisation of any Security Asset or the exercise of any right, power or discretion exercisable by the Lender, or any of its or their delegates or sub-delegates in respect of any Security Asset,
including the execution of any transfer, conveyance, assignment or assurance of any property whether to the Lender or to its nominees, the giving of any notice, order or direction and the making of any registration, which in any such case, the Lender may think expedient.
20. PAYMENTS
20.1 Payments
Subject to clause 20.2 (Gross-up), all payments to be made by the Assignor in respect of this Agreement shall be made:
(a) in immediately available funds to the credit of such account as the Lender may designate; and
(b) without (and free and clear of, and without any deduction for or on account of):
(i) any set-off or counterclaim; or
(ii) except to the extent compelled by law, any deduction or withholding for or on account of tax.
20.2 Gross-up
If the Assignor is compelled by law to make any deduction or withholding from any sum payable under this Agreement to the Lender the sum so payable by the Assignor shall be increased so as to result in the receipt by the Lender of a net amount equal to the full amount expressed to be payable under this Agreement.
21. TAXES
The Assignor shall:
(a) pay all present and future stamp, registration and similar taxes or charges which may be payable, or determined to be payable, in connection with the execution, delivery, performance or enforcement of this Agreement, or any judgment given in connection therewith; and
(b) indemnify the Lender and demand against any and all costs, losses or liabilities (including, without limitation, penalties) with respect to, or resulting from, its delay or omission to pay any such stamp, registration and similar taxes or charges.
22. COSTS AND EXPENSES
22.1 Transaction and amendment expenses
The Assignor shall promptly on demand pay to the Lender the amount of all costs, charges and expenses (including, without limitation, legal fees, valuation, accountancy and consultancy fees (and any taxes thereon)) incurred by the Lender in connection with:
(a) the negotiation, preparation, printing, execution, registration, perfection and completion of this Agreement, the Security or any document referred to in this Agreement; or
(b) any actual or proposed amendment or extension of, or any waiver or consent under, this Agreement.
22.2 Enforcement and preservation costs
The Assignor shall promptly on demand pay to the Lender the amount of all costs, charges and expenses (including, (without limitation) legal fees (and any taxes thereon)) incurred by it in connection with the enforcement, exercise or preservation (or the attempted enforcement, exercise or preservation) of any of its respective rights under this Agreement or any document referred to in this Agreement or the Security.
23. CURRENCY CONVERSION
23.1 Conversion
All monies received or held by the Lender under this Agreement may be converted from their existing currency into such other currency as the Lender considers necessary or desirable to cover the obligations and liabilities comprised in the Secured Obligations in that other currency at a market rate of exchange in its usual course of business.
24. INDEMNITY
The Assignor shall indemnify and keep indemnified the Lender and any attorney, agent or other person appointed by the Lender under this Agreement and the Lender's officers and employees (each an "Indemnified Party") on demand against any cost, loss, liability or expense (however arising) incurred by any Indemnified Party as a result of or in connection with:
(a) anything done or omitted in the exercise or purported exercise of the powers contained in this Agreement;
(b) the Security Assets or the use or holding of them by any person; or
(c) any breach by the Assignor of any of its obligations under this Agreement.
25. MISCELLANEOUS
25.1 Changes to the Parties
(a) The Assignor may not assign any of its rights under this Agreement.
(b) The Lender may assign or transfer or grant participations in all or any part of its rights under this Agreement.
25.2 Amendments and waivers
Any provision of this Agreement may be amended only if the Lender and the Assignor so agree in writing and any breach of this Agreement may be waived before or after it occurs only if the Lender so agrees in writing. A waiver given or consent granted by the Lender under this Agreement will be effective only if given in writing and then only in the instance and for the purpose for which it is given.
25.3 Waiver, rights and remedies
No failure to exercise, nor any delay in exercising, on the part of the Lender, any right or remedy under this Agreement shall operate as a waiver, nor shall any single or partial exercise of any right or remedy prevent any further or other exercise, or the exercise of any other right or remedy. The rights and remedies provided are cumulative and not exclusive of any rights or remedies provided by law.
26. NOTICES
(A) All communications to be made hereunder shall be made by facsimile or otherwise in writing and shall be made or delivered to the relevant person at its address and/or facsimile number set out under its name at the end of this Agreement, or at such other address and/or facsimile as that person may hereafter advise the other Party of in writing.
(B) Any notice to any person hereunder (other than the Lender) shall be deemed to have been given:
(1) if delivered personally, at the time of such delivery;
(2) if posted, on the second Business Day following the day on which it was despatched by first class mail (airmail, if appropriate) postage prepaid; and
(3) if sent by facsimile transmission, on the Business Day on which transmitted.
(C) Any notice to the Lender hereunder shall be deemed to have been given only on actual receipt by the Lender.
27. PARTIAL INVALIDITY
All the provisions of this Agreement are severable and distinct from one another and if at any time any provision is or becomes illegal, invalid or unenforceable in any respect under any law of any jurisdiction, neither the legality, validity or enforceability of any of the remaining provisions nor the legality, validity or enforceability of such provision under the law of any other jurisdiction will in any way be affected or impaired.
28. RELEASE
28.1 Release
Upon the expiry of the Security Period (but not otherwise) the Lender shall, at the request and cost of the Assignor, take whatever action is necessary to release or re-assign (without recourse or warranty) the Security Assets from the Security.
28.2 Reinstatement
Where any discharge (whether in respect of the obligations of the Assignor or any security for those obligations or otherwise) is made in whole or in part or any arrangement is made on the faith of any payment, security or other disposition which is avoided or must be restored on insolvency, liquidation, bankruptcy, dissolution or otherwise (without limitation), the liability of the Assignor under this Agreement shall continue as if the discharge or arrangement had not occurred. The Lender may concede or compromise any claim that any payment, security or other disposition is liable to avoidance or restoration.
29. COUNTERPARTS
This Agreement may be executed in any number of counterparts, and this has the same effect as if the signatures on the counterparts were on a single copy of this Agreement.
30. THIRD PARTY RIGHTS
A person who is not a party to this Agreement shall have no right to enforce any term of this Agreement.
31. GOVERNING LAW AND JURISDICTION
(A) This Agreement and any non-contractual obligations arising out of or in connection with it shall be governed by and construed in accordance the laws of the United Arab Emirates as applied in the Emirate of Dubai and each of the parties to this Agreement irrevocably submits to the jurisdiction of the courts of Dubai.
(B) This clause 31 is for the benefit of the Lender only. As a result, the Lender shall not be prevented from taking proceedings in connection with this Agreement in any other courts with jurisdiction. To the extent allowed by law, the Lender may take concurrent proceedings in any number of jurisdictions.
IN WITNESS of which this Agreement has been duly signed by the Assignor and the Lender on the first date specified on page 1 of this Agreement.

يرهن المحيل ويوافق على رهن, عن طريق رهن أولي ثابت, جميع حقوق ملكيته وفوائدها في أو فيما يتعلق بما يلي:
(أ) كل حساب تحصيل وجميع الأموال القائمة كرصيد دائن في كل حساب تحصيل؛ و
(ب) جميع الأرباح من وقت لآخر المستحقة أو الناشئة عن هذه الأموال.
4-3 الرهن الثابت
بالقدر الذي لا يتم فيه حوالة أي أصل معبر عن حوالته وفقا للبند 4-1 (إحالة المستحقات) على نحو فعال بموجب ذلك البند, يرهن المحيل ويوافق على رهن, عن طريق رهن أولي ثابت, جميع حقوق ملكيته وفوائدها في هذه الأصول أو فيما يتعلق بها.
5. إرسال إشعار إلى المستأجر
(أ) يرسل المحيل و/أو وكيل العقارات إشعار بهذه الإحالة إلى المستأجرين ذوي الصلة بالشكل المبين في الملحق (1)، ويقدم, في أقرب وقت ممكن عمليا بشكل معقول، نسخ من هذه الإشعارات إلى المقرض.
(ب) في حالة عدم إرسال المحيل أو وكيل العقارات الإشعار أو الإشعارات المشار إليها في الفقرة (أ) أعلاه، يحق للمقرض إخطار المستأجرين ذوي الصلة بالحوالات الناشئة عن هذا العقد بأي شكل مقبول للمقرض.
6. شرط الإيداع
لا يجوز حوالة أية أموال قائمة في أي وقت كرصيد دائن في أي حساب (من أي نوع، ورغم تحديده) للمحيل لدى المقرض أو يكون للمحيل فيها مصلحة (ولا تتعلق بها حقوق ومزايا) إلى أي طرف ثالث.
7. الضمان المستمر
7-1 الضمان المستمر
يعد الضمان مستمرا, ويمتد حتى الرصيد النهائي للالتزامات المضمونة, بغض النظر عن أي دفع أو سداد مرحلي يتخلل ذلك بشكل كلي أو جزئي. ويظل هذا العقد ساري المفعول وكامل النفاذ كضمان مستمر لمدة فترة الضمان.
7-2 ضمان إضافي ومنفصل
يكون هذا العقد إضافة إلى، دون الإخلال، ولا يجوز دمجه مع، أي حق أو تدبير إنصافي أو ضمان أو فائدة ضمان يجوز للمقرض الاحتفاظ بها في أي وقت فيما يتعلق بأي التزام مضمون.
7-3 حق النفاذ
يجوز تنفيذ هذا العقد على المحيل دون أن يكون للمقرض حق السبق في اللجوء إلى أي حق أو تدبير إنصافي أو ضمان أو فائدة ضمان يحتفظ بها المقرض أو متاحة له.
8. مسؤولية المحيل المتعلقة بأصول الضمان
بصرف النظر عن أي شيء وارد في هذا العقد أو يدل ضمنيا على عكس ذلك، يظل المحيل مسئولا عن مراقبة وأداء كافة الشروط والالتزامات الذي تعهد بها فيما يتعلق بأصول الضمان. ولا يقع على المقرض أي التزام بأداء أو تحقيق أي شرط أو التزام أو تقديم أي دفعة فيما يتعلق بأي شرط او التزام.
9. وكيل العقارات
9-1 تعيين وكيل عقارات
يقر المحيل بموجب هذا العقد بأنه يجوز للمقرض تعيين وكيل عقارات من اختيار المقرض أو يطلب من المحيل تعيين وكيل عقارات، ويخضع هذا التعيين لموافقة المقرض القبلية. ويقوم وكيل عقارات بما يلي:
(أ) تنفيذ أي عقود إيجار و/أو بيع فيما يتعلق بالممتلكات.
(ب) تقديم نموذج إشعار المستأجر (المستأجرين) الوارد في المحلق (1) لتنفيذه.
(ج) التصرف نيابة عن المقرض لضمان تحصيل المستحقات وإيداعها في الوقت المناسب في أي حساب تحصيل أولي أو حساب التحصيل.
9-2 توكيل وكيل العقارات
يوافق المحيل على منح توكيل إلى وكيل العقارات
9-3 تقديم المحيل تعويض
يوافق المحيل على تعويض والاستمرار في تعوض المقرض ضد أي تكاليف ونفقات ومصاريف أخرى أو رسوم ("رسوم وكيل العقارات") يتحملها وكيل العقارات فيما يتعلق بتحصيل المستحقات وأية أنشطة ذات صلة.
9-4 دفع رسوم وكيل العقارات
يوافق المحيل على دفع رسوم وكيل العقارات في غضون يومي عمل من استلام المحيل طلب دفع من المقرض.
9-5 ضمان إضافي
يقدم المحيل، على نفقته الخاصة وعلى حسابه الخاص، المساعدة التي قد يطلبها وكيل العقارات أو المقرض, وفق رأي المقرض وحده, لتسهيل تحصيل المستحقات.
10. تحصيل المستحقات
10-1 السداد في حساب التحصيل
يقوم المحيل بما يلي:
(أ) فور استلام جميع الأموال, سداد جميع الأموال التي تلقاها فيما يتعلق بالمستحقات في:
(1) حساب التحصيل الأولي؛ أو
(2) ذلك الحساب الآخر (الحسابات الأخرى) لدى المقرض حسب توجيهات المقرض من وقت لآخر.
(يطلق على كل حساب فضلا عن جميع الإضافات إليه أو التجديدات عليه أو الإحلالات به (بأي عُملة) "حساب تحصيل")؛ و
(ب) تعليق الدفع في حساب التحصيل، والاحتفاظ بجميع الأموال الواردة بناء على حساب الدائن إلى المقرض.
10-2 الدفع المباشر
يضمن المحيل، اذا طلب منه المقرض ذلك، أن كل مستأجر يدفع جميع الأموال المتعلقة بالمستحقات بشكل مباشر في حساب المجموعة.
10-3 التعامل مع المستأجرين
لا يجوز للمحيل, بدون موافقة خطية مسبقة من المقرض أن:
(أ) يعفي، أو يغير، أو يجمع، أو يجري مقاصة، أو يمنح وقت أو مهلة, أو ينقل مسئولية أي مستأجر فيما يتعلق بأية مستحقات (سواء عن طريق تقليل المبلغ المستحق أو تمديد فترة السداد أو غير ذلك)؛ أو
(ب) يسمح بتقليل أية مستحقات أو تأجيلها, أو يفعل أو يسمح بفعل أي شيء قد يؤخر أو يمس استعادتها بالكامل, أو يوافق أو يحاول القيام بذلك.
10-4 إجراءات إضافية
بدون تقييد عمومية المادة 19 (تأكيدات إضافية)، إذا طلب المقرض, يقوم المحيل, على نفقته الخاصة بما يلي:
(أ) تنفيذ الحوالة القانونية لجميع المستحقات أو أي منها بذلك الشكل الذي قد يطلبه المقرض؛
(ب) إرسال إشعار بهذه الإحالة إلى المستأجرين ذوي الصلة؛
(ج) اتخاذ أي خطوات أخرى قد يطلبها المقرض لإتمام هذه الحوالة، و/أو
(د) في حالة الصكوك القابلة للتداول، التصديق على جميع المستندات اللازمة لجعل المقرض حامل هذه المستندات.
11. حسابات التحصيل
11-1 عدم السحب
لا يجوز للمحيل، دون الحصول على موافقة خطية مسبقة من المقرض، سحب، أو محاولة سحب أو الحق في سحب (أو توجيه أي تحويل إلى) جميع أو أي جزء من الأموال القائمة كرصيد دائن في حساب التحصيل. ويحق للمقرض (وفقا لتقديره المطلق) رفض السماح بأي سحب أو تحويل.
11-2 عدم التغيير
لا يجوز للمحيل، دون الحصول على موافقة خطية مسبقة من المقرض، السماح أو الموافقة على أي تغيير في أي حق مرتبط بأي حساب تحصيل.
11-3 طلب الحصول على الأموال المودعة في حسابات التحصيل
إن المقرض مفوض في أي وقت أو أية أوقات (سواء في حالة وقوع حدث التقصير أو عدم وقوعه), دون إرسال إشعار إلى المحيل, بتقديم طلب للحصول على أية أموال قائمة كرصيد دائن في أي حساب تحصيل في مقابل أي من الالتزامات المضمونة المستحقة أو الواجبة الدفع.
12. الإقرارات
12-1 عام
يقوم المحيل بعمل الإقرارات والضمانات المنصوص عليها في هذه المادة 12 إلى المقرض.
12-2 عدم وجود فوائد ضمان
تكون أصول الضمان، أو عند الحصول عليها ستكون، مملوكة ملكية منفعة للمحيل خالية من أي فائدة ضمان أخرى غير الناشئة عن هذا العقد.
12-3 عدم التجنب
يُنشئ هذا العقد فائدة الضمان التي يهدف إلى إنشائها وليس مسؤولا عن تجنبها أو بخلاف ذلك استبعادها عند إفلاس، أو تصفية, أو حل المحيل أو غير ذلك.
12-4 ملكية أصول الضمان
المحيل هو المالك الشرعي والمستفيد الوحيد من أصول الضمان.
12-5 المستحقات
جميع المستحقات:
(أ) تنشأ عن بيع أو تأجير, بشروط تجارية عادية, ممتلكات أو بضائع متاحة أو تسليمها أو شحنها إلى حساب المستأجر وفقا للعقد ذي الصلة؛
(ب) تشكل التزامات سارية المفعول وملزمة على المستأجرين ذوي الصلة؛
12-6 العقود ذات الصلة
(أ) لا تخضع المدفوعات التي يقدمها الطرفان في كل عقد ذي صلة لحقوق المقاصة أو حقوق مماثلة.
(ب) يشكل كل عقد ذي صلة التزاما قانونيا وساري المفعول وملزم على كل طرف فيه.
(ج) لا يعتبر المحيل مقصرا في أي من التزاماته بموجب أي عقد ذي صلة.
(د) لا يوجد ما يمنع حوالة أي عقد ذي صلة، ولا يشكل دخول المحيل في هذا العقد انتهاكا لأي عقد ذي صلة.
12-7 وقت تقديم الإقرارات
(أ) يقدم المحيل جميع الإقرارات والتعهدات الواردة في هذه المادة 12 في تاريخ هذا العقد، وتعتبر أيضا أنها تم تقديمها من قبل المحيل في كل يوم لاحق خلال فترة الضمان.
(ب) كل إقرار أو تعهد تم تقديمه بعد تاريخ هذا العقد يعتبر أنه تم تقديمه بالرجوع إلى الوقائع والظروف السائدة في تاريخ اعتبار تقديم الإقرار أو التعهد.
13. تعهدات المحيل
13-1 القيود المفروضة على التعامل
لا يجوز للمحيل القيام أو الموافقة على القيام بأي مما يلي, دون الحصول على موافقة خطية مسبقة من المقرض:
(أ) وضع أو السماح بإنشاء أي فائدة ضمان على المستحقات أو أي أصول ضمان أخرى غير التي تنشأ بموجب هذا العقد؛ أو
(ب) بيع، أو نقل، أو تأجير، أو إقراض, أو حوالة، أو رهن, أو تحليل إلى عوامل, أو خصم, أو التعامل بأي أسلوب آخر مع, أو التصرف في (سواء عن طريق معاملة واحدة أو عدد من المعاملات وسواء كانت ذات صلة أم لا)، فائدته في أية مستحقات أو أصول ضمان أخرى بأكملها أو جزء منها.
13-2 التعاملات العامة مع المستحقات
يتعامل المحيل مع المستحقات (سواء التي تم تحصيلها أو لم يتم تحصيلها) وأي حساب تحصيل وفقا لأية توجيهات يعطيها المقرض خطيا من وقت لآخر، وفي حالة قصور التوجيهات ومع مراعاة هذه التوجيهات, لا يتعامل إلا وفقا لهذا العقد.
13-3 الوصول
يسمح المحيل للمقرض (أو ممثليه المعينين) بناء على إشعار خطي معقول بما يلي:
(أ) الوصول خلال ساعات العمل العادية إلى مكاتبه، أو حساباته، أو حاسبه الآلي, أو السجلات الأخرى والأوراق الأخرى, أو سجلات المحيل حسبما يرغب المقرض؛
(ب) فحص هذه السجلات وأخذ مستخرجات أو صور أو نسخ منها؛
ويقدم (على حساب المحيل) مثل هذه المساعدة الخطية وغيرها التي قد يطلبها المقرض بشكل معقول للقيام بذلك.
13-4 معلومات عامة
يقدم المحيل إلى المقرض ما يلي:
(أ) تلك المعلومات المتعلقة بكمية وطبيعة المستحقات التي قد يطلبها المقرض من وقت لآخر بشكل معقول (مع الأخذ في الاعتبار متطلبات المستندات المالية)؛ و
(ب) أية معلومات أخرى قد يطلبها المقرض بشكل معقول فيما يتعلق بأصول الضمان؛
13-5 العقود ذات الصلة
(أ) لا يجوز للمحيل، إلا بموافقة خطية مسبقة من المقرض (التي يجوز أن يقدمها وكيل العقارات مباشرة لأغراض هذا البند 13-5 (أ) نيابة عن المقرض)، تعديل أو التنازل عن أي بند من بنود أي عقد ذي صلة، أو إنهاء أي عقد ذي صلة, أو إعفاء أي طرف آخر من التزاماته بموجب أي عقد ذي صلة.
(ب) يؤدي المحيل التزاماته على النحو الواجب بموجب كل عقد ذي صلة ويخطر المقرض بأي تقصير مادي يقع منه أو من أي طرف آخر في إطار أي عقد ذي صلة.
(ج) يقدم المحيل، في أقرب وقت ممكن بعد الاستلام، إلى المقرض نسخ من جميع الإشعارات التي قد يستلمها من وقت لآخر من أي طرف آخر فيما يتعلق بأي عقد ذي صلة.
13-6 عدم الحكم مسبقا
(أ) لا يجوز للمحيل أن يتخذ, أو يغفل اتخاذ, أي إجراء من شأنه أن يقلل أو يعوق استعادة أي أصل من أصول الضمان.
(ب) لا يجوز للمحيل أن يفعل، أو يتسبب في فعل أو يسمح بفعل أي شيء يمكن أن يخفض أو يعرقل أو بخلاف ذلك يخل بأي شكل من الأشكال بقيمة أو تسويق أي أصل من أصول الضمان (أو يقوم بأي إغفال له مثل هذا التأثير).
14. عدم وجود التزامات على المقرض
مع عدم الإخلال بالمادة 8 (مسؤولية المحيل المتعلقة بأصول الضمان) لا يكون المقرض ملزما بما يلي:
(أ) اتخاذ أي خطوات ضرورية للحفاظ على، أو تحقيق, أو تنفيذ أي أصل من أصول الضمان؛
(ب) تنفيذ أي مستحقات (أو أي بند من بنود العقد ذي الصلة) ضد أي مستأجر أو أي شخص آخر؛ أو
(ج) تقديم أية استفسارات فيما يتعلق بطبيعة أو كفاية أية مدفوعات يتلقاها بموجب هذا العقد.
15. صلاحية تقديم تدابير إنصافية
15-1 صلاحية تقديم تدابير إنصافية
إذا لم يمتثل المحيل, في أي وقت, لأي من التزاماته بموجب هذا العقد، يحق للمقرض (دون الإخلال بأية حقوق أخرى تنشأ نتيجة عدم الامتثال) (ولكن ليس ملزما) تصحيح هذا التقصير. ويفوض المحيل بشكل لا رجعة فيه المقرض وموظفيه ووكلائه (بما في ذلك, على سبيل المثال لا الحصر, وكيل العقارات) على سبيل الضمان, بالقيام بجميع الأشياء (بما في ذلك دخول ممتلكات المحيل) التي تعتبر ضرورية أو مرغوب فيها لتصحيح هذا التقصير.

بعد أن يصبح هذا الضمان واجب النفاذ، يجوز للمقرض, وفقا لتقديره المطلق, تنفيذ جميع أو أي جزء من الضمان بالطريقة التي يراها مناسبة.

For the first time in the development world, a government can see its own funded projects along with any donor projects in any particular field or sector in one system. The Iraq Development Management System (IDMS) is a comprehensive bi-lingual (Arabic/English) web-based application that manages the whole cycle of government and donor-funded development projects in Iraq, inclusive of social and economic as well as environmental projects. The IDMS will also serve as a reliable, credible, and invaluable source of information on the distribution of development projects according to sectors, provinces and implementing agencies. The IDMS was designed to support and accompany the implementation of the National Development Plan (NDP) 2010-2014, which envisages approximately 3000 projects with a total value of US$100 billion to be implemented over five years.
This instrument will not only contribute to greater efficiency and effectiveness of all investment projects taking place in Iraq but will also help ensure greater transparency and accountability of all decision making on the allocation of development funds across different thematic and geographic sectors. It will also allow the international community to align their support strategies with Iraq’s national priorities. Ultimately, this represents a concrete e-governance application and a critical effort in modernizing Iraq’s public administration. It is also a cutting-edge tool that is currently unique anywhere in the World.
IDMS Development
The IDMS was designed and developed by Synergy International Systems Inc. for the Ministry of Planning in Iraq with assistance and funding from USAID/Tatweer, the United Nations Development Programme (UNDP) and the United Nations Office for Project Support (UNOPS), the European Union and the Government of Spain. The IDMS (version 1.0) is a live tool and is likely to go through further development processes during the course of the upcoming years.
A regional application of the IDMS called the Kurdistan Management Development System (KDMS) has also been established and is planned to be fully synchronized with the IDMS. It can be accessed either through the IDMS itself or through the KRG Ministry of Planning web portal.
Applications
In the current design (version 1.0), the IDMS consists of five applications, which are:
External Assistance Projects – this application is designed to track the ongoing projects that are financed from external sources, e.g. donor community, International NGOs, etc. Once you have accessed this application, you are able to view project details, track aid flows to the country, and create analytical reports in the forms of Lists, Charts, and Maps. Moreover, in this application you can add new projects or modify the information of existing projects through the built-in Online Data Entry Module.
Donor Profile - this application is designed to track the donor profile information. Moreover, it gives the donor organizations / entities the possibility to provide information about the amount of assistance provided to the country, etc. This is done in the built-in Online Data Entry Module. Also, you can create analytical reports in the forms of Lists and Charts.
Capital Investment Projects: this application is designed to track the capital investment projects that have been approved for the implementation and the projects that are currently being implemented. These projects comprise the Public Investment Portfolio and are financed out of the national budget. Once you have accessed this application. Moreover, in this application you can add new projects or modify the information of existing projects, which is done in the built-in Online Data Entry Module.
Iraq Development Project Activity - this application is designed to consolidate the data from the two applications: External Assistance Projects and Capital Investment Projects.
NDP Sectors Monitoring - this application is designed to track progress in 15 sectors as mentioned in the NDP based on 565 Indicators.
Users
The IDMS will be used by Government officials at all central and decentralized levels of Government. This includes staff from the Ministry of Planning, staff from the line ministries, the governors’ offices, and the executive offices of the Government of Iraq. Components of the IDMS will also be accessible to donors in order to allow them to more meticulously harmonize their efforts with the objectives of the Government of Iraq.
The progress reports generated by the IDMS regarding project implementation and performance will be delivered straight to the Council of Ministers in an annual report and on an ad hoc basis as and when required.

ON THE IMPLEMENTATION OF Capacity Building for Human Development Reporting and Advocacy in Iraq
WHEN UNDP SERVES AS IMPLEMENTING PARTNER
Dear Mr. Al-Ajly,
1. Reference is made to the consultations between officials of the United Nations Development Programme (hereinafter referred to as “UNDP”) in Iraq and officials of Ministry of Planning with respect to the realization of activities by Baytal Hikma in the implementation of the project ID 00075295, Capacity Building for Human Development Reporting and Advocacy in Iraq, as specified in Attachment 1: Project Document, to which UNDP Iraq has been selected as implementing partner.
2. In accordance with the Project Document and with the following terms and conditions, we confirm our acceptance of the activities to be provided by Baytal Hikma towards the project, as specified in Attachment 2: Description of Activities (hereinafter referred to as “Activities”). Close consultations will be held between Baytal Hikma and UNDP on all aspects of the Activities.
3. Baytal Hikma shall be fully responsible for carrying out, with due diligence and efficiency, all Activities in accordance with its Financial Regulations and Rules.
4. In carrying out the activities under this Letter, the personnel and sub-contractors of Baytal Hikma shall not be considered in any respect as being the employees or agents of UNDP. UNDP does not accept any liability for claims arising out of acts or omission of Baytal Hikma or its personnel, or of its contractors or their personnel, in performing the Activities or any claims for death, bodily injury, disability, damage to property or other hazards that may be suffered by Baytal Hikma, and its personnel as a result of their work pertaining to the Activities.
5. Any subcontractors, including NGOs under contract with Baytal Hikma, shall work under the supervision of the designated official of Baytal Hikma. These subcontractors shall remain accountable to Baytal Hikma for the manner in which assigned functions are discharged.
6 Upon signature of this Letter, UNDP will make payments to Baytal Hikma, according to the schedule of payments specified in Attachment 3: Schedule of Activities, Facilities and Payments.
7. Baytal Hikma shall not make any financial commitments or incur any expenses which would exceed the budget for the Activities as set forth in Attachment 3. Baytal Hikma shall regularly consult with UNDP concerning the status and use of funds and shall promptly advise UNDP any time when Baytal Hikma is aware that the budget to carry out these Activities is insufficient to fully implement the project in the manner set out in the Attachment 2. UNDP shall have no obligation to provide Baytal Hikma with any funds or to make any reimbursement for expenses incurred by Baytal Hikma in excess of the total budget as set forth in Attachment 3.
8. Baytal Hikma shall submit a cumulative financial report each quarter (30 June, 30 September and 31 December in 2012). The report will be submitted to UNDP through the UNDP Country Director or UNDP Resident Representative within 30 days following those dates. The format will follow the standard UNDP expenditure report [a model copy of which is provided as Attachment 4]. UNDP will include the financial report by Baytal Hikma in the financial report for 00075295, Capacity Building for Human Development Reporting and Advocacy in Iraq.
9. Baytal Hikma shall submit such progress reports relating to the Activities as may reasonably be required by the project manager in the exercise of his or her duties.
10. Baytal Hikma shall furnish a final report within 12 months after the completion or termination of the Activities, including a list of non-expendable equipment purchased by Baytal Hikma and all relevant audited or certified financial statements and records related to such Activities, as appropriate, pursuant to its Financial Regulations and Rules.
11. Equipment and supplies that may be furnished by UNDP or procured through UNDP funds will be disposed as agreed, in writing, between UNDP and Baytal Hikma.
12. Any changes to the Project Document which would affect the work being performed by Baytal Hikma in accordance with Attachment 2 shall be recommended only after consultation between the parties.
13. For any matters not specifically covered by this Letter, the Parties would ensure that those matters shall be resolved in accordance with the appropriate provisions of the Project Document and any revisions thereof and in accordance with the respective provisions of the Financial Regulations and Rules of the Baytal Hikma and UNDP.
14. The arrangements described in this Letter will remain in effect until the end of the project, or the completion of activities of Baytal Hikma according to Attachment 2, or until terminated in writing (with 30 days notice) by either party. The schedule of payments specified in Attachment 3 remains in effect based on continued performance by Baytal Hikma unless it receives written indication to the contrary from UNDP.
15. Any balance of funds that is undisbursed and uncommitted after the conclusion of the Activities shall be returned within 90 days to UNDP.
16. Any amendment to this Letter shall be effected by mutual agreement, in writing,
17. All further correspondence regarding this Letter, other than signed letters of agreement or amendments thereto should be addressed to Beter Batchelor, Country Director, UNDP Iraq, 16 Majed Edwan Street, Shmeissani, Amman 11194, Jordan.
18. Baytal Hikma shall keep the UNDP Country Director/Resident Representative fully informed of all actions undertaken by them in carrying out this Letter.
19. UNDP may suspend this Agreement, in whole or in part, upon written notice, should circumstances arise which jeopardize successful completion of the Activities.
20. Any dispute between the UNDP and Baytal Hikma arising out of or relating to this Letter which is not settled by negotiation or other agreed mode of settlement, shall, at the request of either party, be submitted to a Tribunal of three arbitrators. Each party shall appoint one arbitrator, and the two arbitrators so appointed shall appoint a third arbitrator, who shall be the chairperson of the Tribunal. If, within 15 days of the appointment of two arbitrators, the third arbitrator has not been appointed, either party may request the President of the International Court of Justice to appoint the arbitrator referred to. The Tribunal shall determine its own procedures, provided that any two arbitrators shall constitute a quorum for all purposes, and all decisions shall require the agreement of any two arbitrators. The expenses of the Tribunal shall be borne by the parties as assessed by the Tribunal. The arbitral award shall contain a statement of the reasons on which it is based and shall be final and binding on the parties.
21. The intellectual rights of the Background Papers and the published NHDR will remain with Baytal Hikma. However, UNDP reserves the right to use its logo on these products as well as the logos of other partnering agencies. UNDP also maintains the right to contribute a foreword to the report.
22. Baytal Hikma shall provide UNDP with the bank account number which will be used for the transfer of advances from UNDP to Baytal Hikma. Baytal Hikma shall also provide UNDP with the name of their Accountant who will be in charge of the project’s accounts.
23. Activities implemented by Baytal Hikma will be audited at the end of the project. Baytal Hikma shall maintain all deposit and expenditure records of transactions related to the project with their supporting documents and make them available to the auditors assigned by UNDP when the project’s audit takes place.
24. If you are in agreement with the provisions set forth above, please sign and return to this office two copies of this Letter. Your acceptance shall thereby constitute the basis for your, Baytal Hikma participation in the implementation of the project.

DESCRIPTION OF ACTIVITIES

Results to be achieved by Baytal Hikma
Baytal Hikma will ultimately be responsible for the delivery of the final reviewed draft of the Iraq National Human Development III in Arabic to UNDP. Towards that result, Baytal Hikma will assign a Lead Author and undertake the recruitment of national experts who will write the Background Papers and the report chapters. Baytal Hikma will also arrange the consultations with Government institutions, and other non-government institutions through consultative meetings, focus group discussions and interviews, and will process the outcome of the meetings to feed into the report’s analysis. Baytal Hikma will also be responsible to coordinate with the Central Statistics Office for the production of the supporting data and statics needed for the report. Baytal Hikma will participate in the review meetings that will be arranged, and will manage the revision of the report in response to the comments and suggestions that come of the review activities.
The results are linked to the following output of the project as detailed in the Project Document (Attachment 1):
Output 1: Iraq NHDR III (Focus Area: Youth)
Work to be performed by Baytal Hikma
1. Assign the Lead Author for the Iraq NHDR III
1.1 Baytal Hikma shall assign a Lead Author who will guide the authoring process of the Iraq NHDR III 1.1.1Baytal Hikma shall identify the suitable candidate for the Lead Author for the Iraq NHDR III as per Terms of Reference in Attachment 5.
1.1.2 Baytal Hikma will officially notify the Ministry of Planning and UNDP Iraq to the assignment of the Lead Author for the Iraq NHDR.
1.1.3 Upon the written approval of both the Ministry of Planning and UNDP, Baytal Hikma shall contract the Lead Author using Baytal Hikma’s contractual modality for individuals.
1.1.4 Baytal Hikma will pay the Lead Author upon the fulfillment of the requirements detailed in the Terms of Reference in Attachment 5 and the included schedule of payments.
2. Prepare the Iraq NHDR III Background Papers
2.1 Recruitment of Background Paper Authors: Baytal Hikma shall carry out a competency-based recruitment process to ensure that the best expertise is assigned to the authors of the background papers needed for the report.
.1.1 Advertise the job in the locally using all available means, including Baytal Hikma web site and the media.
2.1.2 Form a committee that includes representation from the Ministry of Planning and UNDP to screen applications, examine applicants (written/interview), and recommend author for the each of the background paper identified.
2.1.3 Contract the selected background paper author using Baytal Hikma’s guidelines for contracting individuals. The contract should indicate that the payment to the author shall be done upon the satisfactory completion of the background paper in terms of its compliance with the specifications required for the paper and the time set for its completion
2.1.5 Baytal Hikma shall coordinate with UNDP to train the background paper authors on NHDR Authoring workshop that will be arranged by UNDP, [date].
2.1.6 Pay the background paper author upon the proper completion of the services provided in their contracts.
2.2 Submission of Background Papers: Baytal Hikma shall ensure that the background papers comply with the Analysis Guidelines detailed in Attachment 7, and submit to UNDP by [date]
2.2.1 Baytal Hikma shall coordinate with all background paper authors to complete the drafts by [date]. Lead Author assigned by Baytal Hikma shall review papers and ensure their compliance with the quality criteria and submit first drafts of background papers to UNDP by [date].
2.2.2 Upon receipt of UNDP’s review of the background papers, Baytal Hikma shall coordinate with the background paper authors to revise the papers as per UNDP review report.
2.2.3 Baytal Hikma shall submit the revised final background papers to UNDP by [date]
2.2.4 Baytal Hikma shall participate with background paper authors in the Background Papers review workshop that shall be arranged by UNDP on [date].
3. Draft Iraq NHDR III

II. Organizational Context
Under the guidance and supervision of the UNDP NHDR Team and the Lead Expert appointed by UNDP, the Lead Author is in charge of the preparation of Iraq NHDR III on Youth, according to the attached concept note. She/he provides assessment of and recommendations on human development in Iraq and on Youth in the Human Development field and its effects on Iraq human development dimensions, ensuring high quality and consistency of work. The Lead Author works in close collaboration with all project stakeholders, to supervise the background and chapter authors, and deliver the final draft of the report.
Background
“Human development is about people, about expanding their choices to live full, creative lives with freedom and dignity. Economic growth, increased trade and investment, technological advance – all are very important. But they are means, not ends. Fundamental to expanding human choices is building human capabilities: the range of things that people can be. The most basic capabilities for human development are living a long and healthy life, being educated, having a decent standard of living and enjoying political and civil freedoms to participate in the life of one’s community.”

UNDP has supported the preparation of two NHDRs prior to this report. The first was the Iraq NHDR 1995 which was prepared by the Iraq Economist Union and focused on the effects of the sanctions imposed on Iraq in the year 1990. The second report was prepared in 2008 and focused on Human Security in Iraq.
The theme of this report will be Youth. In Iraq, Youth (age 15-24) represent the largest segment of the Iraqi society. They face many challenges in access to services, employment, and participation. It is very important to address Youth issues with a focused, integrated, and comprehensive approach. This report will look into the challenges and deprivations in detail, and will analyze the causes and make policy recommendations. It will specifically support the national Youth Strategies to be multi-dimensional so that it addresses the youth’s rights to social, economical, and political development.

The objectives of the NHDR Lead Author are as follows:
1. Coordinate the process of preparing the Iraq NHDR III (2012) on Youth
2. Contribute substantively to the preparation of the report.
3. Promote a participatory approach to the preparation of the report, and participate in its promotion and dissemination.
1. Coordinate the NHDR team ensuring that:
A smooth communication among all team members takes place in all phases of the process
An efficient and effective division of labour is allowing all team members to focus on their discipline, and the specific approach required by the various sectors, while facilitating cross fertilisation through brainstorming, joint reviews and collaboration.
Coordinate with the UNDP NHDR Team and the Lead Expert assigned by UNDP to ensure that all team members apply UNDP NHDR standards and procedures as codified by the NHDR Concept Note and the NHDR Toolkit
Ensures that background papers and report chapters are submitted as per specifications and deadlines detailed in the Letter of Agreement between UNDP and Baytal Hikma.
Reviews the English translations and provide comments for its revision so that the English version captures the exact meaning of the Arabic orginal.
2 Contribute to the preparation of the report in terms of:
Preparing the introductory chapter and the final chapter on conclusions and recommendations.
Provide on-going guidance, advice and substantive comments to the contributions at defined stages in the process, and ensures adequate reviews and consultations, particularly on sensitive topics and materials , Edit the various draft of the NHDR to ensure consistency throughout the report and to include comments and suggestions received during the consultation process to the possible extent.
Supports the UNDP Lead Expert in preparing the Executive Summary
3. Ensure a participatory approach and the promotion of the report by:
Ensuring that all members of the NHDR team consult relevant stakeholders during the preparation of their contributions. These stakeholders include the relevant Government and non-government institutions, academia, UN, and relevant international agencies.
Actively participating in the consultation process organised throughout the preparation of the report.
In close collaboration with the UNDP office, and the NHDR team brief counterparts on process and findings as they emerge.

Attachment 7: Analysis Guidelines
Content
Authors should go beyond description and simple narrative of phenomena. They should be analytical, providing extensive analysis of the histories, trends, underpinning, and dynamics of the issues and processes. It would be interesting to draw attention to specifities as well as commonalities within the country and in comparison with other countries and critically discuss the underlying causes of the similarities and the differences. While it is necessary to look at formal structures, institutions and processes, the authors should endeavour to train the searchlight on informal, non-state, non-formal and people=based initiatives and their motif forces. In the circumstances, authors should not regard phenomena as given but as actuated and activated by social forces and movements. The composition, interests, structures, processes, outcomes and decomposition o f the social forces and movements should be critically discussed.
Authors should eschew judgmental positions but rather analyze scenarios and prospects in order to reveal causes, be they remote or immediate. In this regard, it will be necessary in all cases to identify independent, dependent and intervening variable as well as their interconnections. The guiding framework is: Where are we coming from? Where are we? Where do we desire to be in the near and mid-term future? In summary, the papers and chapters should normally have an introduction, a theoretical overview, statement of the problem, discussion on methodology and constraints, discussion on historical background, present trends and future scenarios as well as presentation of findings and recommendation. Recommendations should normally specify actors.
Authors should apply UN standards in their analysis and establish linkages with the development frameworks mentioned in sections 3.1.1 through 3.1.5, especially those relating to gender and human rights using the guidelines that will be developed by the HDR and Gender Specialists who will support the report preparation process.
Presentation
A multidisciplinary social science perspective is recommended. Authors should in the circumstances avoid jargons and models that would make the work incomprehensible to multiple audiences. Language should be clear. Long paragraphs should be avoided and authors are encouraged to illustrate their ideas with tables, diagrams, maps, etc. Authors should also make available the list of references used in preparing the required analysis.
Pagination
Authors should not be constrained by pages. In the first draft, all facts, figures and analysis should be presented as far as is possible. The paper or chapter should not be less than 25 pages and may be up to 50 pages.

1. بالإشارة إلى المشاورات بين المسؤولين في برنامج الأمم المتحدة الإنمائي (يشار إليه فيما بعد باسم "البرنامج الإنمائي") في العراق والمسؤولين من وزارة التخطيط فيما يتعلق بتحقيق الأنشطة التي يقوم بها بيت الحكمة في تنفيذ المشروع رقم 00075295، بناء قدرات إعداد التقارير والمساندة في مجال التنمية البشرية في العراق، على النحو المحدد في الملحق (1): وثيقة المشروع, التي من أجلها تم اختيار برنامج الأمم المتحدة الإنمائي في العراق ليكون الشريك المنفذ.
2. وفقا لوثيقة المشروع والشروط والبنود التالية، نؤكد قبولنا للأنشطة التي سيقدمها بيت الحكمة فيما يخص المشروع، على النحو المحدد في الملحق (2): وصف الأنشطة (يشار إليها فيما بعد باسم "الأنشطة"). وستعقد مشاورات وثيقة بين برنامج الأمم المتحدة الإنمائي وبيت الحكمة بشأن جميع جوانب الأنشطة.

8. يقدم بيت الحكمة تقرير مالي تراكمي كل ثلاثة أشهر (30 حزيران، 30 أيلول, 31 كانون الأول 2012). ويُقدم التقرير إلى برنامج الأمم المتحدة الإنمائي من خلال المدير القطري أو الممثل المقيم لبرنامج الأمم المتحدة الإنمائي في غضون 30 يوما من هذه التواريخ. وتكون صيغة التقرير هي صيغة تقرير النفقات النموذجي الخاص ببرنامج الأمم المتحدة الإنمائي [مرفق نسخة نموذجية في المحلق (4)]. وسيقوم برنامج الأمم المتحدة الإنمائي بإدراج التقرير المالي المقدم من بيت الحكمة في التقرير المالي رقم 00075295، بشأن بناء قدرات إعداد التقارير والمساندة في مجال التنمية البشرية في العراق.
9. يقدم بيت الحكمة تقارير مرحلية تتعلق بالأنشطة حسب طلب مدير المشروعات بشكل معقول لممارسة واجباته.
10. يقدم بيت الحكمة تقرير نهائي في غضون 12 شهرا بعد انتهاء أو إنهاء الأنشطة، بما في ذلك قائمة بالمعدات غير المستهلكة التي اشترتها بيت الحكمة, وجميع البيانات المالية ذات الصلة المراجعة أو المصدقة, والسجلات المتعلقة بالأنشطة، حسب الاقتضاء, وفقا للأنظمة والقواعد المالية الخاصة به.
11. يتم التصرف في المعدات واللوازم التي قد يكون قدمها البرنامج الإنمائي أو تم شراؤها من قبل البرنامج الإنمائي على النحو المتفق عليه، كتابيا، بين البرنامج الإنمائي وبيت الحكمة.

13. فيما يتعلق بأي مسائل غير واردة في هذا الخطاب على وجه التحديد، يضمن الطرفان أن يتم حل هذه المسائل وفقا للأحكام المناسبة الواردة في وثيقة المشروع وأية تنقيحات لها وفقا للأحكام ذات الصلة بالأنظمة والقواعد المالية الخاصة ببيت الحكمة والبرنامج الإنمائي.
14. تبقى الترتيبات الواردة في هذا الخطاب سارية المفعول حتى نهاية المشروع، أو إتمام أنشطة بيت الحكمة وفقا للملحق (2)، أو حتى إنهاؤها كتابيا (بإرسال إشعار مدته 30 يوما) من أي من الطرفين. ويبقى جدول المدفوعات الوارد في الملحق (3) ساري المفعول على أساس الأداء المستمر من جانب بيت الحكمة إلا إذا استلم إشعار خطي بعكس ذلك من البرنامج الإنمائي.
15. يعاد أي رصيد متبقى من الأموال لم يتم صرفه أو التعهد به بعد إتمام الأنشطة في غضون 90 يوما إلى برنامج الأمم المتحدة الإنمائي.
16. يسري أي تعديل على هذا الخطاب عن طريق الاتفاق المتبادل، كتابيا
17. ترسل جميع المراسلات الخاصة بهذا الخطاب، غير خطابات الاتفاقات أو التعديلات الموقعة، إلى السيد/ بيتر باتشلر المدير القطري لبرنامج الأمم المتحدة الإنمائي في العراق، على العنوان التالي: 16 شارع ماجد عدوان، الشميساني، عمان 11194، الأردن.
18. يُبقي بيت الحكمة المدير القطري/ الممثل المقيم لبرنامج الأمم المتحدة الإنمائي علم تام بجميع الإجراءات التي يتخذها في إطار في تنفيذ هذا الخطاب.
19. يجوز لبرنامج الأمم المتحدة الإنمائي تعليق هذا الاتفاق، كليا أو جزئيا، بناء على إشعار خطي، إذا نشأت ظروف تُعرض إتمام الأنشطة بشكل ناجح للخطر.
20. أي نزاع ينشأ بين برنامج الأمم المتحدة الإنمائي وبيت الحكمة عن أو فيما يتعلق بهذا الخطاب ولم يتم تسويته عن طريق التفاوض أو أي طريقة تسوية أخرى تم الاتفاق عليها، يحال, بناء على طلب أي من الطرفين، إلى هيئة تحكيم تتألف من ثلاثة محكمين. ويعين كل طرف محكما واحدا، ويعين المحكمان المعينان محكم ثالث، يكون رئيسا لهيئة التحكيم. وإذا لم يتم تعيين المحكم الثالث، في غضون 15 يوما من تعيين المحكمَين، يجوز لأي طرف أن يطلب من رئيس محكمة العدل الدولية تعيين المحكم المشار إليه. وتحدد هيئة التحكيم إجراءاتها الخاصة، شريطة أن يشكل أي محكمان النصاب القانوني لجميع الأغراض، وجميع القرارات تقتضي موافقة أي محكمَين. ويتحمل الطرفان نفقات هيئة التحكيم على النحو الذي تقدره الهيئة. ويحتوي قرار التحكيم على بيان الأسباب التي يستند إليها ويكون نهائياً وملزماً للطرفين.
21. تبقى حقوق الملكية الفكرية لأوراق المعلومات الأساسية وتقرير التنمية البشرية الوطني المنشور ملكا لبيت الحكمة. ومع ذلك، يحتفظ برنامج الأمم المتحدة الإنمائي بالحق في استخدام شعاره على هذه المنتجات، فضلا عن شعارات الجهات المشاركة الأخرى. كما يحتفظ برنامج الأمم المتحدة الإنمائي بحق المساهمة في التقرير.

1-1 يعين بيت الحكمة كاتبا رئيسيا يقود عملية كتابة تقرير التنمية البشرية الوطني الثالث في العراق 1-1-1 يحدد بيت الحكمة المرشح المناسب لوظيفة الكاتب الرئيسي لتقرير التنمية البشرية الوطني الثالث في العراق وفقا للشروط المرجعية الواردة في الملحق (5)
1-1-2 يخطر بيت الحكمة بشكل رسمي وزارة التخطيط وبرنامج الأمم المتحدة الإنمائي في العراق بتعيين الكاتب الرئيسي لتقرير التنمية البشرية الوطني في العراق.
1-1-3 فور الحصول على موافقة خطية من كل من وزارة التخطيط وبرنامج الأمم المتحدة الإنمائي، يتعاقد بيت الحكمة مع المؤلف الرئيسي مستخدما الشروط التعاقدية لبيت الحكمة الخاصة بالتعاقد مع الأفراد.

2. إعداد أوراق المعلومات الأساسية لتقرير التنمية البشرية الوطني الثالث في العراق
2-1 توظيف كاتبي أوراق المعلومات الأساسية: يجري بيت الحكمة عملية التوظيف على أساس الكفاءة لضمان تعيين أفضل الخبرات لكتابة أوراق المعلومات الأساسية اللازمة للتقرير. 2-1-1 الإعلان عن الوظيفة باستخدام جميع الوسائل المتاحة محليا، بما في ذلك الموقع الالكتروني لبيت الحكمة ووسائل الإعلام.

4. مؤهلات التعيين
شهادة معترف بها (ويفضل أن يكون حاصل على الدكتوراه) في [أدخل مجال التخصص]. التعليم
10 سنوات خبرة على الأقل في المؤسسات الأكاديمية أو البحثية، وخصوصا في [أدخل مجال التخصص]. ويشترط الخبرة في تحليل النوع الاجتماعي.
والخبرة في العمل مع المنظمات الدولية شرط أساسي

الملحق (7): إرشادات بشأن التحليل
المحتوى
ينبغي أن يتجاوز الكتّاب الوصف والسرد البسيط للظواهر. وينبغي أن يكون تحليليين، ويقدموا تحليل واسع لتواريخ واتجاهات وأساسيات وديناميكيات القضايا والعمليات. ومن المهم لفت الانتباه إلى النوعيات فضلا عن القواسم المشتركة داخل البلد، وبالمقارنة مع بلدان أخرى، ويناقشوا بشكل دقيق الأسباب الكامنة وراء أوجه التشابه والاختلاف. ففي حين أنه من الضروري النظر في الهياكل الرسمية, والمؤسسات, والعمليات، ينبغي أن يسعى الكتّاب إلى التدريب الكشاف على المسائل العامية، وغير الحكومية، وغير الرسمية, والمبادرات القائمة على الناس, وقواهم المحفزة. وفي ظل هذه الظروف، ينبغي على الكتّاب عدم النظر إلى الظواهر على أنها ظواهر معطاة ولكن النظر إليها على أنها ظواهر مفعلة ومحركة بواسطة قوى اجتماعية. وينبغي مناقشة تشكيل ومصالح وهياكل وعمليات ونتائج وتحلل القوى والحركات الاجتماعية بشكل نقدي.

يوصى باستخدام منظور العلوم الاجتماعية متعددة التخصصات. وينبغي أن يتجنب الكتّاب في هذه الظروف المفردات التخصصية والنماذج التي من شأنها أن تجعل العمل غير مفهوم لجماهير متعددة. وينبغي أن تكون اللغة واضحة. وينبغي تجنب الفقرات الطويلة, ويتم تشجيع الكتاب على توضيح أفكارهم بالجداول والرسوم البيانية والخرائط وغير ذلك. وينبغي أيضا أن يوفر الكتّاب قائمة المراجع المستخدمة في إعداد التحاليل اللازمة.
ترقيم الصفحات
ينبغي ألا تعوق الكتاب عدد الصفحات. ففي المسودة الأولى، ينبغي تقديم جميع الحقائق والأرقام والتحليل بقدر ما هو ممكن. وينبغي ألا تقل ورقة المعلومات الأساسية أو الفصل عن 25 صفحة، ويمكن أن يصلا إلى 50 صفحة.
