Source text - French MENTION LEGALE D'INFORMATION
L’Office notarial dispose d’un traitement informatique pour l’accomplissement des activités
notariales, notamment de formalités d’actes, conformément à l’ordonnance n°45-2590 du 2 novembre 1945.
Pour la réalisation de la finalité précitée, les données sont susceptibles d’être transférées à des tiers,
notamment : les partenaires légalement habilités, les Offices notariaux participant à l’acte, les
établissements financiers concernés, les organismes de conseils spécialisés pour la gestion des activités
notariales, le Conseil supérieur du notariat ou son délégataire, pour être transcrites dans une base de
données immobilières, concernant les actes relatifs aux mutations d’immeubles à titre onéreux, en
application du décret n° 2013-803 du 3 septembre 2013.
La communication de ces données aux tiers peut être indispensable afin de mener à bien
l’accomplissement de l’acte. Toutefois, aucune donnée n’est transférée en dehors de l’Union Européenne ou
de pays adéquats.
Les données sont conservées dans le respect des durées suivantes :
• 30 ans à compter de l’achèvement de la prestation pour les dossiers clients (documents permettant d’établir les actes, de réaliser les formalités)
• 75 ans pour les actes authentiques, les annexes (notamment les déclarations d’intention d’aliéner), le répertoire des actes.
Les personnes concernées peuvent accéder aux données les concernant directement auprès de
l’Office notarial ou du Correspondant informatique et libertés désigné par l’Office à l’adresse suivante : [email protected].
Le cas échéant, les personnes concernées peuvent également obtenir la rectification, l’effacement
des données les concernant ou s’opposer pour motif légitime au traitement de ces données, hormis les cas
où la réglementation ne permet pas l’exercice de ces droits. Toute réclamation peut être introduite auprès de
la Commission Nationale de l’Informatique et des Libertés.
PLURI REPRESENTATION
Le mandant autorise dès à présent le mandataire à déroger au principe édicté par l'alinéa premier de
l'article 1161 du Code civil qui dispose qu'un représentant ne peut agir pour le compte des parties au contrat
ni contracter pour son propre compte avec le représenté. Dans cette hypothèse, le mandataire ne devra pas
faire prédominer les intérêts de l'une des parties au préjudice de l'autre.
DECHARGE DE MANDAT
A la suite de ces opérations, le mandataire sera bien et valablement déchargé de tout ce qu’il aura
fait en vertu du présent mandat par le seul fait de la signature de l’acte, lequel s’il ne contient aucune réserve
autre que celle pouvant être incluse aux présentes emportera de plein droit la décharge du mandataire, sans
qu’il soit besoin à cet égard d’un écrit spécial.
Aux effets ci-dessus, passer et signer tous actes, documents et pièces, élire domicile,
substituer et généralement faire le nécessaire.
Translation - English LEGAL INFORMATION
The notary firm has data processing facilities to carry out notarial duties, and in particular formalities relating to legal documents, in accordance with order no. 45-2590 of 2 November 1945.
To this end, your data is likely to be passed on to third parties, and in particular: legally authorised partners, notary firms involved in the legal document, the financial establishments concerned, consultancy organisations specialised in managing notarial activities, the Conseil Supérieur du Notariat (the High Council of French Notariat) or its delegate, to be transcribed in a real estate database, regarding the legal documents relating to transfers of property subject to payment, in application of decree n° 2013-803 of 3 September 2013.
Passing this data on to third parties may be essential in order to successfully complete the legal document. However, no data is transferred outside the European Union or relevant countries.
The data is kept for the following periods:
• 30 years from the date the service is completed for customer cases (documents which make it possible to draw up legal documents and complete formalities)
• 75 years for notarised legal documents, appendices (in particular notices of intent to alienate property) and the register of legal documents.
Individuals concerned can access the data concerning them directly via the notary's office or the information technology and freedoms representative appointed by the firm at the following address: [email protected].
If applicable, individuals concerned may also get data about them modified or deleted or oppose its processing for a legitimate reason, except where the regulations do not make it possible to exercise these rights. Any claim may be lodged with the Commission Nationale de l’Informatique et des Libertés (French National Commission for Information Technology and Liberties).
MULTI-REPRESENTATION
The principal now authorises the representative to break with the principle decreed in the first paragraph of article 1161 of the French Civil Code which states that a representative may not act on behalf of parties to the contract nor enter into agreements on their own behalf with the represented party. In this scenario, the representative should not favour the interests of one of the parties over that of the other.
DISCHARGE FROM POWER OF ATTORNEY
Following these operations, the representative shall be fully and validly discharged of all that they shall have fulfilled by virtue of this power of attorney simply by signing the document, which, if it contains no reservations other than that which may be included in this document, shall automatically lead to the discharge of the representative, without it being necessary to specifically put this is writing.
For the above purposes, agrees to, and signs all legal documents, documents and items, elects domicile, substitutes and generally does what is required.
