Source text - English START-UP AND OPERATION:
With the installation of the filter station completed and the preliminary tests and adjustments concluded, the filter is now ready for operation.
Although some application procedures have been omitted due to the general nature of these instructions, the order of the procedures should be followed closely. Furthermore, since certain filter adjustments required by these applications cannot always be anticipated, some adjustments are being left to the judgement of the operator.
If serious difficulties are encountered, consult your nearest FLSmidth representative.
The following procedures are recommended for the start-up, as well as for the routine operation of the filter:
1. Complete all lubrication as specified in Section 4 and in the manufacturer's accessory equipment instructions in Section 10.
2. If furnished, barely open the valve in the top vacuum line between the filter valve and the receiver. When filtration begins, this will allow just enough vacuum to hold the cake on the discs, yet prevent excessive loss of vacuum through exposure to the atmosphere. If no valve is provided, cake formation will require more time.
3. Open the seal water lines to the agitator and start the agitator. Gland water must be clean.
CAUTION: Operate the agitator whenever slurry is in the tank.
4. Close the filter tank drains and start the slurry into the tank.
5. Turn on the seal water to the vacuum pump and the filtrate pump. The seal water must be clear.
6. When the slurry is near the operating level, start the filter drive, filtrate pump and vacuum pump, in that order.
Set the filter speed at minimum speed.
CAUTION: Do not start the vacuum pump before starting the filter drive because the build up of solids on the discs may overload and damage the drive. However, it is all right to start both the pump and drive simultaneously, since there is a time delay in reaching full vacuum in the system.
Never adjust the speed of a variable speed drive unless the motor is running.
7. Gradually open the top valve in the vacuum line to the receiver until it is wide open when the first of formed cake reaches the scrapers (if fitted).
8. Regulate the feed to maintain it at the operating level or just below the overflow weir. Check the slurry level often during the initial start-up and adjust the feed. If the feed rate is far above normal for the overflow, the slurry might spill over the sides of the tank and into the discharge chutes. On the other hand, if the level is too low, the sectors may be exposed to the atmosphere, causing loss of vacuum.
9. When the cake appears dry enough for discharge, which may be 1 to 2 revolutions of the discs, start the blow discharge:
a. Blower
Check the bags at inflation to be sure the cake is breaking away from the cloth. Although air pressure of 0.2 to 0.25BARS should give best results, a higher pressure may be required. If earlier or later blow is required, refer to Section 6, Page 16, "Adjusting the Valve Position and Bridge Setting."
b. Snap Blow or Sudden Blow
Check the discharge of cake. If necessary, adjust the air pressure and timer.
Check the timing of the blow. Note any changes required so that the cam ring or valve can be adjusted after shutdown. Refer to Section 6, Page 16, "Adjusting the Valve Position and Bridge Setting."
(1) Snap Blow — Good discharge is usually achieved at a pressure of 2 to 3 BARS and a timer setting of 0.5 seconds. Normally, the setting of the timer should vary with the air pressure; however, to retard bag wear, use only enough air to attain good discharge.
(2) Sudden Blow — Discharge is usually best at a pressure of 0.2 BARS and a timer setting of 4 to 5 seconds. Normally the timing should vary inversely proportional to the air pressure.
10. Adjust the filter speed, depending on the desired cake thickness or slurry density. By varying the speed of the discs, better pick-up can be obtained as the consistency of the feed slurry changes.
If the desired cake thickness cannot be obtained by adjusting the filter speed, it may be necessary to try one or a combination of the following:
Increase the density of the slurry and if possible reduce the speed of the agitator; or increase the cake-forming cycle by removing bridging from the filter valve.
In some cases, slow filter speeds are recommended at high slurry densities for the purpose of less discharge - air consumption, less fines in the filtrate, and less bag wear. If the cake is thicker than desired, increase the speed.
Note: Slowing the filter speed generally gives a thicker cake but seldom produces a drier cake. Where less moisture is required, the filter speed should be adjusted to obtain optimum results.
11. Vacuum should be maintained at a constant level to assure uniform cake thickness and moisture. Fluctuating vacuum may be caused by the following:
a. Torn or badly worn sector bags or blinded bags.
b. Malfunctioning vacuum pump. One of the first things to check for is an inadequate flow of seal water.
c. Malfunctioning filtrate pump or blocked barometric leg.
d. Low slurry level causing loss of air through exposed sectors.
e. Leaking pipes or connectors or improper tension on the filter valve.
12. The positions of the scrapers can be adjusted after shutdown, if changes are required.
13. Any adjustments required for vacuum in the pick-up, drying or blow zones should be noted so that the filter valve may later be removed and the bridging adjusted.
CAUTION: In the case of power failure, drain the filter tank immediately, unless this would cause serious trouble else¬where in the plant.
SHUTDOWN:
Normal Shutdown:
1. Shut off the slurry feed.
2. When the slurry recedes to a level where cake formation is poor, shut off the vacuum pump and its seal water or cooling water.
WARNING: Do not stop the filter drive while there is slurry in the tank without first stopping the vacuum pump, or both the drive and the pump simultaneously. Do not stop the agitator if any slurry remains in the tank.
3. Stop the filtrate pump, if furnished, and shut off its seal water.
4. Stop the blower or snap blow.
5. Turn on cloth wash sprays until filter has been washed clean.
6. Stop the filter drive.
7. Drain the tank, then stop the agitator and shut off the stuffing box seal water.
8. Thoroughly clean the filter and discs. If barometric legs are used, clean the sumps.
9. Inspect the filter, referring to the various sections in this manual.
10. Lubricate the filter.
Temporary Shutdown for Changing Sector Bags:
1. Shut off the slurry feed.
2. Stop the vacuum pump and the filtrate pump. Leave the seal water on.
3. Shut off the blow.
4. Operate cloth wash sprays.
5. Stop the filter drive.
CAUTION: Do not stop the filter more than a couple of minutes with the slurry in the tank while the agitator is operating. This will wash fine solids through the filter bags of the submerged sectors, causing the bags to burst from internal pressure or the bulging bags to be ripped by the scrapers.

När filtreringen börjar kommer detta att tillåta precis tillräckligt med vakuum för att hålla kakan på skivan och samtidigt förebygga onödig förlust av vakuum genom exponering till atmosfären. Om ingen ventil finns kommer kakformationen att ta mer tid.
3. Öppna de tätande vattenledningarna till omröraren och starta omröraren. Vattnet i packningshylsan måste vara rent.
VARNING: Kör omröraren när det finns slam i tanken.
4. Stäng filtertankens dränering och börja fylla tanken med slam.
5. Slå på vattentätningarna till vakuumpumpen och filterpumpen. Tätningsvattnet måste vara klart.
6. När slammet är nära driftnivå, starta filtenheten, filterpumpen och vakuumpumpen i den ordningen.
Ställ in filtret på lägsta hastighet.
VARNING: Starta inte vakuumpumpen innan filterenheten startas eftersom fasta partiklar kan samlas på skivorna och överbelasta och skada enheten. Däremot kan man starta både pumpen och enheten samtidigt eftersom det finns en tidsfördröjning innan fullt vakuum i systemet uppnås.
Justera aldrig varvtalsregulatorn om motorn inte är igång.
7. Öppna toppventilen gradvis i vakuumlinjen till mottagern tills den är helt öppen när den första formade kakan når skraparmarna (om dessa finns).
8. Justera inmatningen för att hålla den på driftnivå eller precis under överflödesfördämningen. Kontrollera slamnivån ofta under början av uppstarten och justera inmatningen. Om inmatningshastigheten är över det normala för överflödet kan slammet spilla över sidorna på tanken och in i utmatningskanalerna. Om nivån däremot är för låg kan sektorerna exponeras för atmosfären, vilket medför vakuumförlust.
9. När kakan verkar tillräckligt torr för utmatning, vilket kan vara 1 till 2 rotationer av skivan, börja blåsutmatningen:
a. Blower
Kontrollera säckarna vid uppblåsning för att försäkra att kakan lossnar från tyget. Även om lufttryck mellan 0.2 och 0.25 bör ge bästa resultat kan ett högre tryck vara nödvändigt. Om tidigare eller senare utblås behövs, se avsnitt 8, sida 16, "Justering av ventilposition och brygginställning.”
b. "Snap blow" eller "Sudden Blow”
Kontrollera utmatningen av kakan. Justera lufttrycket och timern om nödvändigt.
Kontrollera tidpunkten för utblåset. Notera alla förändringar som behövs så att kamringen eller ventilen kan justeras efter nedstängning. Se avsnitt 6, sida 16, ”Justera ventilposition och brygginställning.”
(1) Snap Blow – bra utmatning åstadkoms oftast vid ett tryck på 2 till 3 Bar och en tidsinställning på 0.5 sekunder. Vanligtvis varierar tidsinställningen i förhållande till lufttrycket, men använd bara tillräckligt med luft för att få en bra utmatning för att fördröja säckslitage.
(2) Sudden Blow – bra utmatning åstadkoms oftast vid ett tryck på 0.2 BAR och en tidsinställning på 4 till 5 sekunder. Vanligtvis bör tidsinställningen vara omvänt proportionell mot lufttrycket.
10. Justera filterhastigheten, beroende på den önskade kaktjockleken eller slamdensiteten. Genom att variera skivornas hastighet kan en bättre upphämtning erhållas allteftersom konsistensen på matarslammet ändras.
Om den önskade kaktjockleken inte kan erhållas genom att justera filterhastigheten kan det vara nödvändigt att prova en eller en kombination av de följande:
Öka slammets densitet och om möjligt sänk hastigheten på omröraren, eller öka kakformningscykeln genom att avlägsna bryggan från filterventilen.
I vissa fall rekommenderas låga filterhastigheter vid hög slamdensitet för att erhålla mindre utmatning, luftkonsumption, färre småpartiklar i filtratet och minskat säckslitage. Om kakan är tjockare än vad som önskas, öka hastigheten.
Notera: Att sänka filterhastigheten producerar oftast en tjockare kaka men producerar sällan en torrare kaka. När mindre fukt krävs bör filterhastigheten justeras för att erhålla bästa resultat.
11. Vakuum bör hållas vid en konstant nivå för att säkerställa en enhetlig tjocklek och fuktighet på kakan. Fluktuerande vakuum kan orsakas av följande:
a. Trasiga eller väldigt utslitna sektorsäckar eller tomma säckar.
b. Felfungerande vakuumpump. En av de första sakerna som bör kontrolleras är otillräckligt flöde av tätningsvatten.
c. Felfungerande filterpump eller blockerad barometerledning.
d. Låg slamnivå som leder till luftförlust genom exponerade sektorer.
e. Läckande rör eller anslutningar eller felaktig spänning på filterventilen.
12. Skraparmarnas position kan justeras efter nedstängning om förändringar behövs.
13. Justeringar som krävs på vakuumet i upphämning-, torkning- eller blåszoner bör noteras så att filter ventilen senare kan avlägsnas och bryggan justeras.
VARNING: Vid strömavbrott dränera tanken omedelbart om detta inte skulle medföra allvarliga störningar i andra områden av anläggningen.
NEDSTÄNGING:
Normal nedstängning:
1. Stäng av slammataren.
2. När slammet sjunker till en nivå där kakformeringen är dålig, stäng av vakuumpumpen och dess tätningsvatten eller kylvatten.
VARNING: Stoppa inte filterenheten när det finns slam i tanken utan att först stoppa vakuumpumpen eller stoppa både drivenheten och pumpen samtidigt. Stoppa inte omröraren om det finns slam kvar i tanken.
3. Stoppa inte filterpumpen, om sådan finnes, och stäng av dess tätningsvatten.
4. Stoppa blowern eller snap blowern.
5. Sätt på tygrengöringssprayen tills filtret har tvättats rent.
6. Stoppa filterenheten.
7. Töm tanken, stoppa sedan omröraren och stäng av anslutningsnipplarnas tätningsvatten.
8. Rengör filtret och skivor grundligt. Om en barometeranslutning används, rengör trågen.
9. Inspektera filtret, se olika avsnitt i den här manualen.
10. Smörj filtret.
Tillfällig nerstängning vid byte av sektorsäckar:
1. Stäng av slammataren.
2. Stoppa vakuumpumpen och filterpumpen. Lämna tätningsvattenledningarna på.
3. Stäng av utblåset (blow).
4. Kör tygrengöringssprayerna.
5. Stoppa filterenheten.
VARNING: Stoppa inte filtret mer än några minuter när det är slam i tanken samtidigt som omröraren är i drift. Detta kommer att skölja finkorniga partiklar genom filtersäckarna i de nedsänkta sektorerna, vilket medför att säckarna brister på grund av inre tryck eller att de utbuktande säckarna rivs upp av skraparmarna.

Defendants PARTICULARS OF CLAIM
1. At all material times:
a. The Claimant was an aircraft mechanic. He was employed by the First Defendant under a contract of employment governed by English law. He was and is domiciled and habitually resident in England.
b. The First Defendant was a company domiciled in England that specialised inter alia in supplying workers to end users in the aeronautical industry.
c. The Second Defendant is a company domiciled in and incorporated under the laws of the Kingdom of Sweden. It owned and operated a hangar at Malmo Airport in Sweden, 'the airport', at which it carried out work on aircraft for reward.
2. At some stage unknown to the Claimant but prior to January 2009 the First Defendant entered into an arrangement to supply workers to one First People
Supply Solutions Limited for reward, in order to enable FPSL to perform a contract to supply workers to the Second Defendant.
3. Pursuant to its contract of employment with the Claimant, the First Defendant duly required the Claimant to provide services to FPSL's order and the Claimant was thereby required to provide temporary services as an aircraft mechanic to the Second Defendant under the direction and management of the Second Defendant at the Second Defendant's premises at the airport.
4. The Claimant therefore travelled out to Sweden in around January 2009 and commenced work at the airport on around 26 January 2009 in the Second Defendant's premises under the direction and control of the Second Defendant's servants and agents.
5. The applicable law as between the Claimant and the First Defendant is English law pursuant to Article 4.2 of Regulation (EC) No. 864/2007 of the European Parliament and of the Council of 11 July 2007 on the law applicable to non-contractual obligations, 'Rome II'.
6. The applicable law between the Claimant and the Second Defendant is Swedish law pursuant to Article 4.1 of Rome II.
7. The provisions of Directive 89/654/EEC of 30 November 1989 concerning the minimum safety and health requirements for the workplace (as amended), as enacted into Swedish law, applied as between the Claimant and the Second Defendant.
8. On around 28 April 2009 the Claimant was engaged in work at the hangar. His supervisor, Dennis Westin, an employee of the Second Defendant, instructed him to change the fuel filter on the auxiliary power unit at the rear of a British Aerospace regional jet 146 aircraft.
9. At about 1430 hours the Claimant was standing on the staging in the vicinity of the air brakes whilst a colleague held on to the filter. The top half of his body was pressed flat against the area between the air brakes to enable him to access the filter.
10. Suddenly and without warning the air brake doors closed onto the Claimant, crushing his chest and causing him injury, loss and damage as set out below.
11. The air brake doors closed because, unbeknownst to the Claimant, one of the Second Defendant's employees (whose name is not known to the Claimant) had switched on the hydraulic pumps in the cockpit of the aircraft.
12. Under Swedish law the Second Defendant is vicariously liable for the wrongful acts and omissions of its servants and agents including the technician who turned on the hydraulics and Dennis Westin as his supervisor.
13. The accident was caused by the negligence or breach of contract of the First Defendant its servants and agents in that they:
PARTICULARS OF NEGLIGENCE AND/OR BREACH OF CONTRACT OF THE FIRST
DEFENDANT
a. Failed to carry out any or adequate risk assessment of the Claimant's workplace.
b. Failed to provide the Claimant with any or adequate training.
c. Failed to take any or adequate steps to provide the Claimant with a safe place of work.
d. Failed to discharge its non-delegable duty of care to the Claimant as its employee.
e. Otherwise failed to take reasonable care for the Claimant's safety.
14. Further or alternatively the accident was caused by the negligence and breach of duty contrary to Swedish law of the Second Defendant its servants or agents in that they:
PARTICULARS OF BREACH OF DUTY OF THE SECOND DEFENDANT
a. Failed to ensure that safety equipment and devices intended to prevent or eliminate hazards were regularly maintained and checked. In particular there was no gag (or safety strut) positioned between the air brakes. The Claimant understands that the Second Defendant had a written rule to this effect. Had a gag been in place, the accident would not have happened.
b. Failed alternatively to implement or enforce a system of work whereby a gag was positioned between the air brakes whenever work was carried out in the vicinity of the air brakes such as on the auxiliary power unit to
prevent or minimise the risk that the air brakes would close on someone working next to them.
c. Failed by Dennis Westin or otherwise to check that the gag was in place before instructing the Claimant to change the filter.
d. Failed to give any or adequate warning to the Claimant before switching on the hydraulic pumps and therefore causing the air brake doors to close.
e. Failed to ensure that the Claimant had heard and understood any warning that the hydraulics were about to be switched on.
f. Failed to take any or adequate steps to check the air brake position before turning on the hydraulics.
g. By Dennis Westin, instructed the Claimant to change the fuel filter when it was not safe for him to do so.
h. Failed to carry out any or any adequate risk assessment of the task the Claimant was required to undertake.
i. Failed to ensure that notice was given to anyone entering the cockpit that work was being carried out on the auxiliary power unit. Had it been, no-one (competent) would have switched on the hydraulic pumps and risked the air brakes closing.
j. Failed to take any or adequate care to check whether it was safe to switch on the hydraulic pumps. In particular the risk that the air brakes would close when the hydraulics were switched on was an obvious one.
k. Failed to carry out any or adequate checks to ensure that no-one was in the way of the air brakes before switching on the hydraulic pumps in the cockpit. Had the technician who switched them on checked the air brake area he would have ascertained that the Claimant was working directly in the path of the air brakes.
I. Failed to take any or adequate steps to supervise the Claimant as he changed the fuel filter.
m. Failed to provide its employees with any or adequate training. In particular, whoever switched on the hydraulic pumps had not had sufficient
training as to the risks of switching on the hydraulic pumps if anyone was working in the vicinity of the air brakes.
n. Alternatively, if sufficient training was given, the Second Defendant is vicariously liable for the negligence of the employee who switched on the hydraulic pumps.
o. Failed to provide the Claimant with any or adequate training.
p. Failed to provide the Claimant with a reasonably safe place of work during the Claimant's temporary posting to the Second Defendant's premises.
q. Failed to discharge the duty owed to the Claimant as visitor to the hangar occupied by it.
r. Otherwise failed in all the circumstances to take reasonable care for the Claimant's safety during his temporary posting working under the Second Defendant's direction and control.
15. By reason of the accident the Claimant suffered personal injury, loss and damage as set out below.
PARTICULARS OF PERSONAL INJURY
The Claimant was born on 23 April 1942 and was 67 at the date of the accident. He suffered a crushing injury to the neck and spine with injuries to the chest and both arms. He sustained fractures of C7, Th3-Th7 and multiple fractures of ribs on both sides. He fractured his right scapula. He sustained a partial brachial plexus injury to the non-dominant left side. He was taken by ambulance to the local hospital and admitted into the Intensive Care Unit where he remained for about a week. He was ventilated and required a tracheotomy and chest drain for bilateral pneumothoraces and lung contusions. He remained in hospital in Sweden for several weeks when he was repatriated. He continued to receive treatment in England as an inpatient and an outpatient. He suffered chest pain for many months. He continues to suffer from symptoms of pain, stiffness and restriction of movement of the neck and thoracic spine. He has weakness, tingling and stiffness of the left arm and hand with reduced sensation and occasional tremors. He has discomfort and stiffness in both shoulders and crepitus of the right shoulder. His symptoms are permanent. There is significant scarring to his chest. He requires regular pain killing medication. He suffered some minor psychological effects as a result of the accident.
He was unable to return to work after the accident. Whereas he would otherwise
have continued working (notwithstanding his age) at least until age 70, he will not
now be able to return to work. His sleep was disturbed for a long time. His hobbies
and ability to undertake domestic chores have been adversely affected.
The Claimant relies further on the expert medical report dated 8 March 2012 of Mr
Derek Boston, consultant orthopaedic surgeon, a copy of which is annexed.
The Claimant reserves to update this evidence and to adduce further expert evidence
in due course.
PARTICULARS OF LOSS AND DAMAGE
A preliminary schedule of past and future loss and damage is annexed.
16. Further the Claimant seeks interest on such damages as he may be awarded pursuant to section 69 of the County Courts Act 1984; alternatively as against the Second Defendant pursuant to Swedish law. In particular the Claimant claims interest to judgment or sooner payment on general damages at 2 per cent per annum from the date of service of the claim and on special damages at half the special account rate from the date of the accident; alternatively at such rate and for such period as the Court may think fit.
17. The Claimant's claim for general damages for pain, suffering and loss of amenity exceeds £1,000. His claim overall is expected to exceed £25,000.
18. These proceedings may be served on the Second Defendant out of the jurisdiction as the claim made against the Second Defendant is one that this Court has power to determine under Article 6(1) of the Judgments Regulation. The Second Defendant is domiciled in a Regulation State, namely Sweden.
19. No other proceedings between the parties concerning the same claim are pending in the Courts of any other part of the United Kingdom or any other Regulation State.
AND the Claimant claims as against the Defendants and each of them:
(1) Damages in excess of £25,000.
(2) Interest pursuant to section 69 of the County Courts Act 1984 as aforesaid; alternatively as against the Second Defendant pursuant to Swedish law.

Svarandens UPPGIFTER OM YRKANDE
1. I allt väsentligt:
a. Käranden var flygplansmekaniker: Han anställdes av den förste svarande på ett arbetskontrakt i enlighet med engelsk lag. Han var och är bosatt och har sin hemvist i England.
b. Den förste svarande var ett företag med hemvist i England som bland annat specialiserat sig på att erbjuda och tillhandahålla arbetskraft till slutkunder inom aeronautisk industri.
c. Den andre svarande är ett företag med hemvist i Sverige och som arbetar under kungadömets Sveriges lagar. Det ägde och drev en hangar vid Malmö Airport i Sverige, ”flygplatsen”, vid vilken det utförde arbeten på flygplan mot betalning.
2. Vid ett tillfälle okänt för käranden men innan januari 2009 ingick förste svaranden ett avtal att tillhandahålla arbetskraft till ett First People
Supply Solutions Limited mot betalning för att ge FPSL möjlighet att under kontrakt tillhandahålla arbetskraft till den andre svarande.
3. I enlighet med kontraktet mellan käranden krävde förste svarande att kärande skulle tillhandahålla tjänster till FPLS och käranden var därmed tvungen att tillhandahålla tillfällig tjänst som flygplanstekniker till andre svarande under ledning av den andre svarande vid den andre svarandes lokaliteter vid flygplatsen.
4. Käranden reste därför ut ur Sverige i januari 2009 och började arbeta vid flygplatsen omkring den 26 januari 2009 i den andre svarandes lokaliteter, under ledning och kontroll av den andre svarandes tjänsteutövare och agenter.
5. Den lag som kan tillämpas mellan käranden och förste svarande är engelsk lag i enlighet med Artikel 4.2 i regelverket (EC) nr. 864/2007 i Europaparlamentet och rådet den 11 juli 2007 i enlighet med lagen som är tillämplig för ickekontraktsanställdas skyldigheter, “Rome II”.
6. Den lag som kan tillämpas mellan käranden och andre svarande är svensk lag i enlighet med artikel 4.1 av "Rome II".
7. Bestämmelserna i direktiv 89/654/EEC från den 30 november 1989 beträffande minimikrav för säkerhet och hälsa på arbetsplatsen (med ändringar) som antogs i svensk lag, tillämpas mellan käranden och andre svarande.
8. Omkring den 28 april 2009 arbetade käranden i hangaren. Hans överordnande, Dennis Westin, en anställd hos andre svarande instruerade honom att byta bränslefilter på en extra hjälpmotor vid den bakre änden på ett British Aerospace regional jet 146 flygplan.
9. Omkring kl 14.30 stod käranden på ställningen i närheten av tryckluftsbromsarna medan en kollega höll fast filtret. Övre kroppshalvan var tryckt platt mot ytan mellan tryckluftsbromsarna för att kunna komma åt filtret.
10. Plötsligt utan varning stängdes dörrarna till tryckluftsbromsarna rakt på käranden, krossade hans bröstkorg och orsakade personskador, förluster och skador enligt nedan.
11. Tryckluftsbromsarna stängdes därför att, käranden ovetande, en av den andre svarandes anställda (vars namn käranden inte känner till) hade slagit på de hydrauliska pumparna i cockpit i flygplanet.
12. Enligt svensk lag är den andre svarande indirekt ansvarig för felaktigt agerande och underlåtenheten hos dess anställda och agenter inkluderande den tekniker som slog på de hydrauliska pumparna och Dennis Westin som hans överordnade.
13. Olyckan orsakades genom försumlighet eller brott mot förste svarandes kontrakt och dess tjänsteutövare och agenter i det att:

KONTRAKT
a. Underlät att genomföra en eller adekvat riskanalys av kärandes arbetsplats.
b. Underlät att ge kärande någon eller adekvat utbildning.
c. Underlät att ta något eller adekvata steg för att ge kärande en säker arbetsplats.
d. Underlät att uppfylla sin icke delegerbara plikt att ta hand om kärande som sin anställde.
e. I övrigt underlät att ta rimligt ansvar för kärandes säkerhet.
14. Dessutom eller alternativt orsakades olyckan genom försumlighet eller brott mot förste svarandes kontrakt och dess tjänsteutövare och agenter i det att:

a. Underlät att säkerställa att säkerhetsutrustning och enheter avsedda att förebygga eller eliminera risker underhölls och kontrollerades regelbundet. Särskilt påpekas att det inte fanns något stag ( eller säkerhetsstötta) mellan tryckluftsbromsarna: Kärande var införstådd med att andre svarande hade skriftliga instruktioner beträffande detta. Hade ett stag funnits på plats skulle olyckan inte skett.
b. Underlät att antigen införa eller verkställa ett system där ett stag var positionerat mellan tryckluftsbromsarna närhelst arbete i närheten av dem, såsom i den extra hjälpmotorn, skulle genomföras
så att risken att dörrarna till tryckluftsbromsarna stängs på någon som arbetar intill dem förebyggs eller minimeras.
c. Underlät att genom Dennis Westin eller på annat sätt kontrollera att staget var på plats innan kärande instruerades att byta filter.
d. Underlät att ge någon eller adekvat varning till kärande innan de hydrauliska pumparna sattes igång och orsakade därför att dörrarna till tryckluftsbromsarna stängdes.
e. Underlät att säkerställa att kärande hade hört och förstått någon varning om att hydrauliken skulle sättas på.
f. Underlät att vidta några eller adekvata steg att kontrollera tryckluftsbromsarnas position innan hydrauliken sattes igång.
g. Dennis Westin instruerade kärande att byta bränslefilter när det inte var säkert att göra det.
h. Underlät att utföra några eller adekvata riskanalyser av den uppgift som kärande var ombedd att utföra.
i. Underlät att säkerställa att en varning gick ut till alla som gick in i cockpit om att arbete pågick i extra hjälmotorn. Hade detta gjorts, hade ingen (kompetent) slagit på de hydrauliska pumparna och riskerat en stängning av tryckluftsbromsarna.
j. Underlät att göra någon eller adekvat kontroll om det var säkert att slå på de hydrauliska pumparna. Särskilt som det var en uppenbar risk att tryckluftsbromsarna skulle stängas om hydrauliken slogs på.
k. Underlät att utföra några eller adekvata kontroller för att säkerställa att ingen befann sig i vägen för tryckluftsbromsarna innan de hydrauliska pumparna i cockpit slogs på. Hade teknikern som slog på dem kontrollerat tryckluftsbromsarnas område hade han konstaterat att kärande arbetade direkt i vägen för tryckluftsbromsarna.
l. Underlät att vidta några eller adekvata steg att övervaka käranden när han bytte bränslefiltret.
m. Underlät att ge sina anställda någon eller adekvat utbildning. I synnerhet den som slog på de hydrauliska pumparna hade inte tillräcklig
träning vad gäller riskerna med att slå på de hydrauliska pumparna om någon arbetade i närheten av tryckluftsbrosmarna.
n. Alternativt, om tillräcklig träning hade erhållits är andre svarande indirekt ansvarig för vårdslöshet hos anställde som slog på de hydrauliska pumparna.
o. Underlät att ge kärande någon eller adekvat utbildning.
p. Underlät att ge kärande en rimligen säker arbetsplats under kärandes tillfälliga placering inom den andre svarandes lokaliteter.
q. Underlät att uppfylla plikten till kärande som besökare i den delen av hangaren.
r. I övrigt underlät att under alla omständigheter ta rimligt ansvar för kärandes säkerhet under hans tillfälliga arbetspostering under den andre svarandes ledning och kontroll.
15. På grund av olyckan har kärande lidit personskada, förlust och skador enligt nedan.
UPPGIFTER OM PERSONSKADA
Kärande är född 23 april 1942 och var vid tidpunkten för olyckan 67 år. Han erhöll krosskador på nacken och ryggraden med skador på bröstkorgen och båda armarna. Han fick skador på C7, T3-T7 och en mängd frakturer på båda sidorna av revbenen. Han högra skulderblad fick frakturer. Han erhöll en partiell skada på plexus brachialis på den icke-dominanta vänstra sidan. Han togs med ambulans till det lokala sjukhuset och lades in på intensivavdelningen där han blev kvar i cirka en vecka. Han blev lagd i respirator och genomgick en trakeotomi och ett thoraxdränage sattes på grund av bilateral lungkollaps och skador på lungorna. Han blev kvar på sjukhus i Sverige under flertalet veckor innan han repatrierades. Han fortsatte att erhålla behandling i England både som inlagd patient och som dagpatient. Han led av smärtor i bröstkorgen i flera månader. Han fortsätter att lida av smärtor, stelhet och begränsad rörelseförmåga i nacken och ryggraden i höjd med bröstkorgen. Han är svag, har stickningar och är stel i vänster arm och hand och har minskad känsel och tillfälliga skakningar. Han har obehag och stelhet i båda axlarna och krepitation i höger axel. Hans symptom är permanenta. Det är en stor ärrbildning på bröstkorgen. Han behöver smärtstillande medicinering regelbundet. Han led av mindre psykiska besvär som ett resultat av olyckan.
Han kunde inte återgå till arbete efter olyckan. Han skulle annars
ha fortsatt arbeta (oaktat hans ålder) till 70 års ålder, han kommer nu inte
att kunna återvända till arbetslivet. Hans sömn var störd under en lång tid. Hans fritidsysselsättningar och förmåga att ta del av hemmasysslor har också blivit lidande.
Kärande förlitar sig vidare på den medicinska expertrapporten daterad 8 mars 2012 gjord av Hr.Derek Boston konsulterande ortopedisk kirurg, av vilken en kopia är bifogad.
Kärande reserverar sig rätten att uppdatera detta bevismaterial och vidare åberopa bevis i sinom tid.
UPPGIFTER OM FÖRLUSTER OCH SKADOR
En preliminär skiss av dåtida och framtida förluster och skador är bifogad.
16. Vidare vill käranden ha ränta på skadestånd som han kan bli beviljad i enlighet med avsnitt 69 i civildomstolslagen 1984; alternativt som mot den andre svarande i enlighet med svensk lag. I synnerhet kräver kärande ränta på domslut eller tidigare betalning på allmänna skadeståndet på 2 procent per år från delgivningsdatum och på särskilda skador halva specialkontoräntan från dagen för olyckan, alternativt med sådan utbetalningshastighet för en period som domstolen anser lämplig.
17. Kärandes anspråk för det allmänna skadeståndet för sveda, värk och förlust av livskvalitet överskrider £1,000. Hans övergripande anspråk förväntas överskrida £ 25,000.
18. Detta förfarande kan delges den andre svarande utanför domstolens jurisdiktion eftersom stämningen är delgiven den andre svarande på så sätt att domstolen har rätt att bestämma i enlighet med artikel 6(1) i domstolens regelverk. Den andre svarande har sin hemvist i en förordnad stat, nämligen Sverige.
19. Inga andra förfaranden mellan parterna som härrör denna stämning pågår i domstol i någon del av Storbritannien eller någon annan förordnad stat.
OCH kärandes anspråk på de svarande och var en av dem är:
(1) Skadestånd på mer än £25,000.
(2) Ränta i enlighet med avsnitt 69 i civildomstolslagen 1984 som tidigare sagts; alternativt som mot den andre svarande i enlighet med svensk lag.
