Translation - English ● The Securities and Exchange Surveillance Commission (SESC) took action after a May, 2007, incident in which the share price of OHT, a TSE Mothers listed company, (“the stock”), declined sharply, leaving many margin trading securities firms with insufficient income to cover their customers’ losses, and a large amount of credit was needed; subsequently, the SESC requested reports from the affected securities firms, conducted on-site inspections at their offices, and performed examinations to understand the conditions under which the credit transactions arose, as well as the firms’ internal systems for customer management and credit risk management.

Source text - Japanese 保険の募集・支払、保険料積立金の支払を巡っては、平成17 年から始められた保険法現代化の検討過程で議論となり、募集に関する規定を保険法に設けるかどうか等が論点となった。結論としては、それらの規定を保険法には設けないこととされたが、その後、本ワーキング・グループにおいて、保険法改正の議論の経緯も踏まえ、保険募集・支払全般に関し幅広く議論を行うこととし、その旨、金融審議会第二部会に報告した。

Translation - English Concerning insurance recruiting and payments, and insurance due reserve payments, starting in 2005 there was discussion during the Insurance Law’s review prior to the law’s modernization. One point of contention was whether or not the law should include regulations pertaining to insurance recruiting. It was concluded that regulations of this nature would not be included in the revised law, but subsequently the relevant Working Group began discussing the detailed law revisions and conducted a wide-ranging discussion of all insurance recruitment and payment issues, and reported its results to the Financial Systems Council, Second Sub-Committee.
