وهذا الاتجاه هو الذي أخذ به المشرع المصري وذلك قبل صدور قانون التحكيم المصري رقم 27 لسنه 1994 ، إذ جاء في المذكرة الإيضاحية لقانون المرافعات أن: "حكم المحكمين ليس حكما قضائيا"ولا شك أن هذا الإتجاه يبرز الطابع التعاقدي للتحكيم ، إذ لا يمكن اعتبار عمل المحكم عملا قضائيا بحتا ، لأن هذا العمل لا يماثل العمل القضائي سواء من الناحية المادية أو الناحية الشكلية فمن الناحية المادية ليس للمحكم سلطة الأمر الذي يتمتع بها القاضي فهو لا يستطيع مثلا إلزام شاهد بالحضور أمامه وتوقيع غرامة عليه إذا لم يحضر ، بل يجب عليه إذا أراد ذلك أن يرجع إلى القضاء ، ومن الناحية الشكلية لا يلتزم المحكمون باتباع الإجراءات التي يتطلبها القانون والتي تكفل الضمانات الأساسية للمتقاضين ، ومن الممكن أن يتجاهل المحكمون هذه الإجراءات اللهم إلا قدراً ضئيلاً منها ، ألزمهم المشرع به وهي الإجراءات المنصوص عليها في باب التحكيم ، أضف إلى ذلك أنه لا يلزم أن تتوافر في المحكمين الشروط التي يجب توافرها في القضاء ، بل أنه من الممكن أن يكون المحكم جاهلا بالقراءة والكتابة ولذلك فأنه من قبيل المبالغه أعتبارهم قضاة أو إضفاء الطبيعة القضائية على عملهم . (1) ويرى البعض (2) أن هذا النوع من التحكيم (العقدي) يستند إلى قانون الإرادة باعتباره ضابط للإسناد في خصوص العقود الدولية التي تتضمن عنصرا أجنبيا . ومن قبيل هذه العقود ، في مجال التجارة الدولية الاتفاقيات الدولية المنشأة للمشروعات العامة الدولية ، حيث تقوم هذه الاتفاقيات على أساس تعاقدي وتتضمن النص على لجوء الأطراف إلى محاكم تحكيم خاصة للفصل فيما يثور بينهم من منازعات حول تفسير أو تطبيق الإتفاقية ومثال هذه الاتفاقيات: الاتفاقية المنشأة للبنك العربي الافريقي المبرمة عام 1964 بين مصر والكويت وعدد من الدول العربية . ذلك أن هذه الاتفاقيات الدولية تتضمن النص على شرط التحكيم مع بيانها لطريقة تكوين هيئات التحكيم المختصة بالفصل في المنازعات والقانون الواجب التطبيق أمامها ، وبالتإلى تظهر إرادة الأطراف المتعاقدة في الإفلات بهذه المنازعات من سلطان القضاء العادي وإخضاعها لمحاكم التحكيم الخاصة . Translation - English
Indeed, the Egyptian legislator adopted such orientation, before introducing the Egyptian Arbitration Law (Law No. 27/1994), where the Explanatory Memorandum to the Procedures Law states that: "Arbitrators' award shall not be considered a court ruling." This orientation unquestionably shows the contractual nature of arbitration, as the arbitrator's task cannot be considered as merely tribunal in nature, being unequal, materially and formally, to judicial work. As for material inequality, it is because the arbitrator does not assume a prerogative authority like that granted to the judge; for example, he can not summon a witness to appear before him, or charge him with a fine if he failed to appear; indeed, the arbitrator shall refer back to courts in the latter case. As for the formal level, arbitrators do not abide by legal procedures, which provide basic guarantees to litigants. They may not even observe such proceedings to a great extent, though such procedures are legally binding, and are expressly stated in the Arbitration section. In addition, arbitrators are not necessarily required to meet the same qualifications set for judges. An arbitrator might be illiterate, for instance, which means that classifying them as judges, or even magistrating their job may fairly sound like an overstatement. (1) Such type of (contractual) arbitration is considered(2) to be based on the law of will, being the connecting factor with international contracts involving a 'foreign element.' In international trade, for instance, there are the international agreements executed for global projects. These agreements share a contractual basis, clearly stipulating that parties may proceed with arbitration, in case any conflict or dispute arises regarding the interpretation or implementation of the provisions of the contract. The Arab African International Bank Agreement, executed jointly between Egypt and Kuwait (among other Arab countries) in 1964, stands as a good example for this type of agreements. International agreements normally stipulate an arbitration clause, specifying how arbitration panels are formed for settling disputes as well as the governing laws. Therefore, the will of contracting parties appear in moving away with such disputes from traditional jurisdiction, to the legal authority of private arbitration.(3)
