As previously mentioned, this Regulation applies exclusively to uncontested claims. The European lawmakers’ baseline position is that the debtor consciously is not actively contesting the claim made upon him, adopting a passive position in the process, which may be based on acknowledgment of the claim made upon him or on simply ignoring the claim. Thus, in awarding the EEO, the court of the Member States needs to state that one of the specified motives really exists. In any case, the specified circumstances will be deemed to exist if the relevant processing documents were served on the respondent on time and he was warned of the consequences of adopting a passive position in the process; and likewise if the respondent does not do all that is necessary to fulfil his obligation of duly expediting the process (e.g. does not respond to the suit or suchlike).

Kā minēts iepriekš, šī regula attiecas tikai uz neapstrīdētiem prasījumiem. Eiropas likumdevēju pamatnostāja ir tāda, ka parādnieks apzināti aktīvi neapstrīd pret viņu celto prasību un ieņem pasīvu nostāju procesa gaitā, vai nu apstiprinot pret viņu celto prasījumu vai vienkārši to ignorējot. Tādējādi, pieņemot Eiropas izpildu rīkojumu, dalībvalstu tiesai jākonstatē, ka tiešām pastāv kāds no noteiktajiem motīviem. Katrā gadījumā var uzskatīt, ka minētie apstākļi pastāv, ja attiecīgos procesuālos dokumentus laicīgi piegādā atbildētājam un viņš tiek brīdināts par sekām, kādas radīsies, ja viņš ieņems pasīvu nostāju šajā procesā, un līdzīgi, ja atbildētājs nedara visu nepieciešamo lai pildītu savu pienākumu palīdzēt paātrināt procesu (piemēram, nereaģē uz prasījumu vai tamlīdzīgi).
