in answer to the questions referred to it by the VAT and Duties Tribunal, London hereby rules:
1. Articles 29, 32 and 33 of Council Regulation (EEC) No 2812/93 of 12 October 1993 establishing the Community Customs Code must be construed as meaning that a buying commission which is included in the customs value declared and is not shown separately from the selling price of the goods in the import declaration must be considered to be part of the transaction value within the meaning of Article 29 of that regulation and is, therefore, dutiable.
2. In a situation where the customs authorities have agreed to undertake revision of an import declaration and have adopted a decision regularising the situation within the meaning of Article 78(3) of Regulation No 2812/93 taking account of the fact that the declaration was incomplete as a result of an inadvertent error by the declarant, those authorities may not go back on that decision.

v reakci na otázky vznesené londýnským Soudním dvorem pro DPH a celní poplatky rozhodl takto:
1. Články 29, 32 a 33 Nařízení Rady (EHS) č. 2812/93 z 12. října 1993 zřizující Celní zákoník Společenství musejí být vykládány v tom smyslu, že nákupní provize, která je zahrnuta v celní hodnotě uvedené v celním prohlášení a která není v dovozním prohlášení uvedena odděleně od prodejní/tržní ceny zboží, musí být považována za součást transakční hodnoty ve smyslu článku 29 tohoto nařízení, a podléhá tedy clu.
2. V případě, že celní orgány souhlasily s přezkoumáním dovozního prohlášení a přijaly rozhodnutí, jež uvádí situaci do pořádku ve smyslu článku 78 (odstavce 3) Nařízení č. 2812/93, s ohledem na skutečnost, ze prohlášení bylo neúplné z důsledku neúmyslné chyby deklaranta, tyto orgány nesmí ono rozhodnutí zvrátit.

Source text - English With around 2% growth, Europe was again unable to keep up with the pace of growth set by other regions in 2004. Although the economic upturn remained relatively stable in the face of high oil prices and the strong appreciation of the euro, moderate growth only allowed for labour market stagnation. The German economy was no exception, although the difference between the export economy and domestic demand was more pronounced than the European average. High export surpluses and falling retail sales were prominent features of a divided economy. In spite of this, the German economy succeeded in putting an end to a three-year stagnation period in 2004, with around 1.6% growth.
Translation - Czech S přibližným dvouprocentním růstem nebyla Evropa opět schopna udržet tempo růstu dané ostatními regiony v roce 2004. Ačkoli ekonomické zlepšení zůstalo relativně stabilní tváří v tvář vysokým cenám ropy a silnému zhodnocení eura, samotný mírný růst pouze umožnil stagnaci trhu práce. Německá ekonomika nebyla výjimkou, a to přesto, že rozdíl mezi vývozní ekonomikou a domácí poptávkou byl více výrazný než evropský průměr. Vysoké vývozní přebytky a klesající maloobchodní ceny byly hlavními znaky rozděleného hospodářství. Přese všechno, německé hospodářství v roce 2004 uspělo v ukončení tříletého období ekonomické stagnace, s růstem okolo 1,6%.
