Source text - Arabic وحيث ان الطعن أقيم على ثلاثه اسباب حاصل ما تنعى به الشركه الطاعنه على الحكم المطعون فيه الخطأ فى تطبيق القانون إذا أيد الحكم المستأنف باعتبار الحجز كأن لم يكن لعدم اقامه دعوى صحه الحجز أمام المحكمه المختصه، بالمخالفه لنص المادتين 255 ، 261 من قانون الاجراءات المدنيه اللتين توجبا رفع الدعوى بثبوت الحق وصحه الحجز أمام المحكمه المختصه خلال ثمانيه أيام من تاريخ توقيع الحجز، فى حين أنها قدمت لمحكمه الموضوع بدرجتيها ما يفيد أقامه الدعوى بثبوت الحق أمام جهه التحكيم خلال المده القانونيه أعمالاً للبند رقم 20 /6 من شروط الاتفاقيه المبرمه مع المطعون ضدهما الذى ينص على ان يتم حل النزاع بموجب قواعد مركز دبى للتحكيم الدولى لعام 2007 باعتبارها الجهه المختصه بنظر الدعوى الموضوعيه لارتباط دعوى صحه الحجز بدعوى ثبوت الحق وتلازمهما معا، وإذ خالف الحكم المطعون فيه هذا النظر وقضى بتأييد الحكم المستأنف لعدم طلب الطاعنه صحه الحجز فى دعوى ثبوت الحق أمام جهه التحكيم رغم موافقته على أختصاص الجهه الأخيره، مما كان يتعين معه ترك أمر الحكم بصحه الحجز لهذه الجهه، مما يعيبه ويستوجب نقضه.
وحيث أن هذا النعى مردود، ذلك أن النص فى الماده (255 /2) من قانون الاجراءات المدنيه على انه (( ويجب على الحاجز خلال الثمانيه أيام على الأكثر من تاريخ توقيع الحجز - أن يرفع أمام المحكمه المختصه الدعوى بثبوت الحق وصحه الحجز، وذلك فى الاحوال التى يكون فيها الحجز بأمر من قاضى الامور المستعجله وإلا أعتبر الحجز كأن لم يكن)) يدل - وعلى ما جرى به قضاء هذه المحكمه - ان دعوى صحه الحجز تكون لاحقه لايقاعه، وتجب اقامتها خلال الثمانيه أيام فى اى تاريخ لا حق لايقاع الحجز، وان من المقرر ان الحكم بأصل الحق موضوع الدعوى لا يترتب عليه بطريقه تلقائيه صحه الحجز وعدم جواز بحث مدى توافر شروطه، وما يترتب على ذلك من أثر، كما أنه من المقرر ان لا يجوز التحكيم بصدد إجراءات الحجز والتنفيذ ولا الدعاوى اللازمه لصحتها - إلا إذا اتفق على اختصاص جهه التحكيم بها، فإذا تطلب القانون بصدد إجراءات الحجز رفع دعوى معينه فلا يجوز ان ترفع إلا الى المحكمه المختصه دون جهه التحكيم ما لم يتفق على خلاف ذلك، لما كان ذلك وكان الثابت بالبند رقم 20 /6 بالاتفاقيه المبرمه بين طرفى الدعوى والمتعلق بالتحكيم انه لم يتضمن النص على أختصاص جهه التحكيم باجراءات الحجز والتنفيذ والدعاوى اللازمه لصحتها فإنه - وعلى فرض أن النزاع الموضوعى حسبما أفترض الحكم المطعون فيه - فى الدعوى الماثله - قد اتفق على التحكيم بشأنه، وقد خلا الاتفاق على أختصاص تلك الجهه بالاجراءات التحفظيه وما يستتبع ذلك من الدعاوى لصحتها، فإن طلب صحه الحجز وتثبيته يكون من أختصاص المحاكم دون جهه التحكيم، مما كان لازمه على الطاعنه وقد أقامت دعوى ثبوت الحق أمام جهه التحكيم- بزعم أختصاصها بالدعوى الموضوعيه - ان تقوم برفع دعواها بصحه الحجز مستقله عن الدعوى الأخيره امام المحكمه المختصه، ذلك انه - وعلى ما جرى به قضاء هذه المحكمه - ان النص فى الماده (255) من قانون الإجراءات المدنيه على ان ترفع دعوى ثبوت الحق وصحه الحجز معا هو فى حاله أختصاص المحكمه بنظر الموضوع أما فى حاله عدم أختصاصها بنظر الموضوع فللمدعى الحق فى اقامه دعواه بصحه الحجز وتثبيته مستقله عن دعوى الموضوع، فالأصل هو الاباحه الى ان يوجد القيد، والقيد الوارد فى تلك الماده استثناء لا يجوز القياس عليه - وحتى لا يكون هناك بالتالى تسليط لجهه التحكيم على ما تتخذه المحاكم من إجراءات تحفظيه أو مستعجله فى حدود أختصاصها، وإذ خلص الحكم المطعون فيه صحيحا بتأييد الحكم المستأنف باعتبار الحجز كأن يكن لعدم رفع الطاعنه الدعوى بصحه الحجز أمام المحكمه المختصه، فإن النعى عليه بما ورد باسباب النعى يكون على غير أساس.
وحيث انه ولما تقدم فإنه يتعين رفض الطعن.

Translation - English Whereas the appeal is based on three grounds for which the Appellant challenges the challenged judgment as misapplying law because it affirmed the appealed judgment rendering the attachment null and void for no attachment validation claim was brought before a court of competent jurisdiction which violates the provisions of Articles 255 and 261 of the Code of Civil Procedure which make it obligatory to bring a claim for the substantiation of the right and the validation of attachment before a court of competent jurisdiction within eight days from the attachment imposition date, though it offered to the trial court including its who grades evidence that a claim for the substantiation of the right was brought before the arbitral tribunal during the legally fixed period pursuant to Clause No. 20/6 of the agreement concluded with the Appellees which provides that a dispute shall be resolved by virtue of the 2007 Rules of Dubai International Arbitration Centre in its capacity as the entity which has the jurisdiction to consider the substantive action given the correlation between the attachment validation claim and the right substantiation claim,
Whereas the challenged judgment violated that and decided to affirm the appealed judgment for the Appellant’s did not apply for the attachment validation in the right substantiation claim before the arbitral tribunal despite its agreement to the latter’s jurisdiction which required giving up the judgment on attachment validation to this entity; therefore, it is deemed defective and reversible.
Whereas this challenge is rejected for Clause 255/2 of the Code of Civil Procedure provides that: “the Attacher shall, within at most eight days from the attachment imposition date, bring to a court of competent jurisdiction a claim for the substantiation of the right and the validation of attachment in case attachment is ordered by the summary judge. Otherwise, attachment shall be rendered null and void.”
Whereas, in consideration of the foregoing, this court frequently judges that the attachment validation claim should be subsequent to attachment imposition, within eight days from any attachment imposition date.
It is established that a judgment establishing the original right subject of the claim does not automatically validate attachment or make it impressible to consider to which extent its conditions are satisfied and the consequent effect.
It is also established that arbitration may not apply to the attachment and execution proceedings or the claims required for their validation except in case of agreement that the arbitration tribunal shall have the jurisdiction to consider the same.
So, if the law on attachment proceedings requires bringing a certain claim, it may not be brought except to a court of competent jurisdiction rather than an arbitral tribunal unless otherwise agreed.
Whereas, in consideration of the foregoing, it is established that Clause No. 20/6 of the agreement concluded between the two parties to the claim concerning arbitration did not provide that the arbitral tribunal shall have the jurisdiction to consider the attachment and execution proceedings or the claims required for their validation,
Supposing that the substantive dispute, as assumed by the challenged judgment in the subject claim, is subject to arbitration agreement, but it is devoid of sub-agreement to the arbitral tribunal’s jurisdiction to consider such precautionary proceedings and the ensuing claims required for the validation of the same, the application for attachment validation and affirmation is still subject to the jurisdiction of the courts of law rather than the arbitral tribunal.
Accordingly, while the Appellant brought a claim for the substantiation of the claim before the arbitral tribunal allegedly for having the jurisdiction to consider the subject-matter claim, it had to bring an independent claim for the validation of attachment before the court of competent jurisdiction.
This court frequently judges that Article 255 of the Code of Civil Procedure provides that a claim shall be brought for both the substantiation of the right and the validation of attachment at the same time in case the court has the jurisdiction to consider the subject matter. However, in case it does not have the jurisdiction to consider the subject matter, the Plaintiff may bring an attachment validation and affirmation claim which is independent from the subject-matter claim.
Therefore, as a rule, permission continues to be valid until a restriction exists. The restriction set out under this article is an exception with which analogy may not be drawn so that the arbitral tribunal will not have authority over the precautionary or summary proceedings courts may institute within the boundaries of their jurisdiction.
Whereas the challenged judgment validly affirmed the appealed judgment rendering the attachment null and void for the Appellant did not bring an attachment validation claim before a court of competent jurisdiction; therefore, challenging it based on the above grounds is deemed baseless.
Therefore, this challenge should be rejected.

Source text - Arabic وحيث إن هذا النعي في محله، ذلك انه لما كانت المادة 22 من قانون الإجراءات المدنية تنص على ان المحاكم تختص بالأمر بالإجراءات المستعجله والتحفظية التي تنفذ في الدولة ولو كانت غير مختصة بالدعوى الأصلية، وكان من المقرر وعلى ما جرى به قضاء هذه المحكمة ـ أنه لا يجوز التحكيم بصدد اجراءات الحجز والتنفيذ ولا الدعاوي اللازمة لصحتها ـ إلا إذا اتفق على اختصاص جهة التحكيم بها، فإذا تطلب القانون بصدد اجراءات الحجز رفع دعوى معينه فلا يجوز ان ترفع إلا إلى المحكمة المختصة دون جهه التحكيم ما لم يتفق على خلاف ذلك ـ وإذا كان النزاع الموضوعي ـ في الدعوى المعروضه ـ قد اتفق على التحكيم بشأنه .. ـ وخلا عقد ايجار السفينة ـ من الإتفاق على اختصاص تلك الجهة بالإجراءات التحفظية وما يستتبع ذلك من دعاوي لصحتها، فإن طلب توقيع الحجز التحفظي على أموال المطعون ضدهم في دبي وطلب صحته وتثبيته يكون من اختصاص محاكمها، فإن الحكم المطعون فيه إذ خالف هذا النظر وقضى بعدم اختصاص محاكم دبي بنظر دعوى صحة الحجز ونفاذه على أساس أن محاكم دبي غير مختصة بنظر دعوى الحق فتكون غير مختصة بدعوى صحة وتثبيت الحجز التحفظي واستمرار الدعوى امام المحكمة لحين صدور حكم المحكمين في أصل الحق، وإذ كانت المادة 255 من قانون الإجراءات المدنية توجب على الحاجز خلال ثمانية أيام على الأكثر من توقيع الحجز ان يرفع امام المحكمة المختصة الدعوى بثبوت الحق وصحة الحجز وذلك في الأحوال التي يكون فيها الحجز بأمر من قاضي الأمور المستعجلة وإلا إعتبر الحجز كأن لم يكن وإذا كانت الدعوى بالحق مرفوعة من قبل وقدمت دعوى صحة الحجز إلى ذات المحكمة لتنظرهما معاً ـ فإن هذه المادة تتناول حالة ما إذا كانت المحاكم مختصة بنظر الموضوع فإنها تختص بنظر دعوى صحة الحجز وتثبيته، أما إذا لم تكن مختصة بنظر الموضوع فللمدعي الحق في إقامة دعواه بصحة الحجز وتثبيته مستقله عن دعوى الموضوع فالأصل هو الإباحه إلى أن يوجد القيد، والقيد الوارد في تلك المادة استثناء لا يجوز القياس عليه ـ وحتى لا يكون هناك بالتالي تسليط لجهة التحكيم على ما تتخذه المحاكم من اجراءات تحفظيه او مستعجلة في حدود اختصاصها، ومن ثم فإن الحكم المطعون فيه يكون قد خالف القانون مما يتعين معه نقضه مع الإحالة.
Translation - English Whereas this challenge is valid for Article 22 of the Code of Civil Procedure provides that courts shall have the jurisdiction to order the summary and precautionary proceedings to be executed inside the country even if they do not have the jurisdiction to consider the original claim.
Whereas this court frequently judges that arbitration may not apply to the attachment and execution proceedings or the claims required for their validation except in case of agreement that the arbitration tribunal shall have the jurisdiction to consider the same.
So, if the law on attachment proceedings requires bringing a certain claim, it may not be brought except to a court of competent jurisdiction rather than an arbitral tribunal unless otherwise agreed.
Whereas the substantive dispute in the subject claim is subject to an arbitration agreement but the charter is devoid of any sub-agreement that the arbitral tribunal shall have the jurisdiction to consider the precautionary proceedings and the ensuing claims required for their validation, the application for the attachment of the Appellees’ property in Dubai and its validation and affirmation shall be subject to the jurisdiction of Dubai Courts.
Whereas the challenged judgment violated that and decided that Dubai Courts do not have the jurisdiction to consider the attachment validation and enforcement claim for since Dubai Courts do not have the jurisdiction to consider the claim for the right, they do not have the jurisdiction to consider the attachment validation and affirmation claim and that the claim would be pursued before the court until the arbiters pass their award on the original right.
Whereas Article 255 of the Code of Civil Procedure makes it obligatory for the Attacher to bring a claim for the substantiation of the right and the validation of attachment before a court of competent jurisdiction within at most eight days from the attachment imposition date, in case attachment is ordered by the summary judge. Otherwise, attachment shall be rendered null and void.
If the claim for the substantiation of the right had been already brought and the attachment validation claim is brought to the same court for the consideration of both claims, the above article addresses the case where courts have the jurisdiction to consider the subject matter, in which case they will have the jurisdiction to consider the attachment validation and affirmation claim.
However, if they do not have the jurisdiction to consider the subject matter, the Plaintiff may bring an attachment validation and affirmation claim which is independent from the subject-matter claim.
As a rule, permission continues to be valid until a restriction exists. The restriction set out under this article is an exception with which analogy may not be drawn so that the arbitral tribunal will not have authority over the precautionary or summary proceedings courts may institute within the boundaries of their jurisdiction.

As the COVID-19 pandemic spread across the Maghreb, the measures taken by governments will have far-reaching consequences on their already struggling economies and volatile political dynamics.
As the COVID-19 pandemic spread across the Maghreb, the measures taken by governments will have far-reaching consequences on their already struggling economies and volatile political dynamics.
As the COVID-19 pandemic spread across the Maghreb in March 2020, governments in Morocco, Algeria, and Tunisia sought to slow its progression though drastic steps, including suspending all travel, partially demobilizing the workforce, closing mosques, using military and police forces to impose mandatory confinement, shutting down schools and businesses, and banning public gatherings. These measures will have far-reaching consequences on their already struggling economies and volatile political dynamics. In the medium term, Maghreb economies will contract as the outbreak and associated restrictions negatively impact key sectors and lead governments to increase public spending to protect citizens. The region’s political landscape will also shift as social movements re-direct their focus toward outbreak-related problems (such as weak welfare provision, social inequality, and/or poor healthcare), and as regimes increase their use of repression – either to enforce confinement (as is happening across the region) or to contain opposition actors (as has been happening this past year in Algeria and Morocco).
Interestingly, the pandemic has brought to light important revelations about state capacity across the Maghreb. While all three regimes have successfully used their coercive apparatus to impose lockdowns, Morocco has emerged as a stronger state than might have been expected. The kingdom successfully acquired and produced medical supplies (including protective masks[1] and ventilators[2]), while elites rallied behind the regime by donating over three billion dollars to an emergency fund to fight the outbreak.[3] On the other hand, the military regime in Algeria, which ten years ago was able to survive and surpass Arab Spring-related shocks,[4] is currently facing a crisis of legitimacy, and the military-imposed president[5] struggles to deal with the crisis as oil prices continue to dip. In Tunisia, where parliament granted the government special powers for up to two months to deal with the outbreak,[6] the government is unlikely to abuse these powers or resort to excessive force. Rather, what may threaten or strengthen the fledgling democracy is how the state deals with the economic fallout from the outbreak.
Tough economic conditions
The pandemic will negatively impact the Maghreb’s economic performance by disrupting trade flows, reducing tourism, and leading to increased public spending. These are significant consequences for a region that, despite some positive macroeconomic indicators, already faces deeply-rooted structural economic issues (ranging from overdependence on a low-performing agricultural sector in Morocco, unsustainable levels of public spending in Tunisia, and reliance on hydrocarbon exports in Algeria).
Algeria, Morocco, and Tunisia—which have medium-to-low GDPs—all struggle with high inequality (the inequality index score was 40.9 in Morocco, 40 in Tunisia, and 35.3 in Algeria in 2019),[7] high unemployment rates, especially among young people (30.8% of the labor force in Algeria, 21.9% in Morocco, and 34.8% in Tunisia),[8] and high public spending (around 38% of GDP in Algeria, 30% in Morocco, and 30% in Tunisia).[9]
Hydrocarbon-importing Morocco and Tunisia have towering public debts (65.2% of GDP for Morocco in 2018,[10] and71.4% in Tunisia[11]), while Algeria’s economy is highly dependent on hydrocarbon exports and is currently suffering from the recent drop in oil prices which are unlikely to recover soon (in fact, the situation is made worse as oil companies consider the possibility of oil prices falling to 10 dollars per barrel).[12] Furthermore, the ongoing political instability triggered by anti-regime Hirak protests (which will restart as soon as the outbreak is under control) will impact the country’s economy due to investment uncertainty, an adverse business environment, and the re-distribution of revenues from public spending toward social measures.[13]
Disruptions to trade with China as a result of the outbreak will negatively impact Morocco, Algeria, and Tunisia. In 2017, 2.5 % of Moroccan exports went to China, compared to 1.1% from Tunisia, and 1.8% in Algeria. That same year, Moroccan imports from China reached 3.14 billion dollars, compared to 1.85 billion in Tunisia, and a record 7.8 billion in Algeria.[14]
As Europe heads towards a recession (which the EU commission expects will be deeper than the 2008 crisis),[15] key economic partners in the Maghreb will suffer. European markets will likely fall as concerns over the rising numbers of confirmed cases persist.[16] The EU estimates that one million citizens in EU states have already lost their jobs in recent weeks.[17] A prolonged European crisis will be particularly difficult for Morocco, which is Europe’s largest trade partner in the Mediterranean.[18]
Travel restrictions imposed by Maghreb governments to slow the pandemic’s spread will harm key sectors for Morocco and Tunisia’s GDP growth, namely tourism, air and sea transport, agricultural exports, and— in Morocco’s case—phosphate exports.
Finally, the informal sector in all three countries will take a hit during the mandatory confinement period, especially given the partial demobilization of the workforce. All three governments have addressed the ensuing loss of income of informal workers by pledging emergency stipends over the coming months. However, workers who have already lost their jobs are struggling as the stipends (some of which are yet to be released) only partially cover their basic expenses.
Political impact
On the political front, the outbreak comes at a challenging time for the Maghreb countries, and it will likely lead to new developments in terms of popular contestation and the use of repression by regimes. Indeed, protest movements will recur across the Maghreb once the pandemic has ended, and, in the medium term, citizens and opposition actors will re-focus on healthcare needs, social inequality, and welfare benefits. Furthermore, the freedom which Maghreb regimes currently enjoy in terms of pandemic response may lead to increased repression in the long-term, especially in Morocco and Algeria where authorities show a recent pattern of imprisoning critics and activists.[19]
In Algeria, anti-regime protests had been taking place for over a year and persisted despite unseating former President Abdelaziz Bouteflika, who had ruled the country for twenty years. In Morocco, which over the last year has seen smaller-scale protests over socioeconomic conditions, heightened regime repression against critics and activists has led to significant criticism by domestic and foreign sources.[20] Tunisia’s President Kais Saied, who was elected in the end of 2019, only named a cabinet in February 2020.
In the short-term, the Algerian regime will benefit from the Hirak movement’s decision to delay protests (for the first time since February 2019) to avoid exacerbating the number of infected cases. However, this delay will mark only a brief respite for the regime, as regular protests will almost certainly continue once the outbreak is controlled. In the meantime, the population will closely watch the recently and controversially elected President Abdelmadjid Tebboune, whose socioeconomic and security policies during the crisis will be scrutinized. His lofty promise to not cut wages or the education and health sectors will be undermined by the announced plans to drastically reduce spending (i.e., cutting the country’s energy import bill by 10 billion dollars, halving Sonatrach’s budget, freezing state-funded projects, and reducing the state’s operating budget by 30 percent).[21] Politically, whatever Tebboune’s actions during the pandemic, the opaque military leadership will remain in power, most likely triggering further protests in the future. For now, the Hirakmovement will likely seek to organize on new platforms; hence, online activism will increase. The movement will have ample opportunity to re-direct its criticism during confinement toward the country’s poor healthcare system, regional inequality, and social benefits.
The Moroccan regime’s swift and firm reaction to the pandemic will likely increase the legitimacy of key actors in the eyes of the population, which has been mostly supportive of the government’s decisions. King Mohammed VI’s contribution to Morocco’s COVID-19 fund will pay off in terms of approval ratings, despite the lack of a royal speech to address the situation. However, the wide gap between the wealthy and poor will continue to be a source of popular discontent. Indeed, in the kingdom, which ranks lower than its neighbors in terms of healthcare,[22] people are forced to pay high prices in private clinics. Furthermore, inequality is especially prevalent in rural areas; indeed, poverty rates amongst the rural population are twice as high as at the national level and the rural population accounts for 79.4% of the poor.[23] Although the regime currently enjoys popular support, once the outbreak is controlled, small protests targeting inequality will likely take place. If different factions of the opposition come together, these fragmented protests may boil over to a full-blown movement demanding concrete and effective socioeconomic reforms.
The government of Tunisia, which has a better healthcare system than Morocco and Algeria, will face contestation triggered by economic hardship. Although the International Monetary Fund (IMF) gave Tunisia $400 million to alleviate the outbreak’s impact on the population, and the government pledged an additional $850 million for the same cause, the economy is bound to suffer.[24] First, the confinement will negatively impact the informal sector, which accounts for around 40% of the economy,[25] and will leave some members of this workforce without wages and force others to choose between earning a living and staying at home. The current situation will therefore highlight informal workers’ lack of social security benefits, which may fuel further small-scale protests to those that took place on March 30, 2020.[26]Although the government announced an aid plan to help close to 285,000 low-income, unemployed, or poor families,[27]it is unclear whether this aid will be directed towards workers in the informal sector. These workers’ inherent vulnerability may discourage people from seeking employment in this sector in the future and may strengthen Tunisians’ preference for public sector jobs.[28] This may lead to a higher demand for public sector jobs to fight unemployment, which would require more public spending. The latter—which Tunisia’s international lenders (such as the IMF) have repeatedly discouraged—[29] is bound to increase due to the government’s aforementioned pledge. These factors will exacerbate Tunisia’s economic outlook and may lead the government to impose austerity measures once the outbreak is under control. This would result in further protests.
Conclusion
In the immediate future, the COID-19 pandemic will cause significant loss of human life across the Maghreb. In fact, as of April 13, 2020, the number of confirmed deaths due to COVID-19 has increased by a factor of 2.3 over the last eight days in Algeria, by a factor of 2 over the last eight days in Morocco, and by a factor of 2.4 over the last nine days in Tunisia.[30] While the outbreak-triggered crisis will likely end in the medium term, it will leave Maghreb governments to deal with far-reaching economic and political impacts. Indeed, Maghreb economies are bound to contract as key sectors and trade flows are being disrupted while governments increase public spending. Furthermore, state repression may increase in Morocco and Algeria as regimes are granted even greater powers to control the pandemic. Increased repression in Morocco and Algeria, along with an outbreak-inspired focus on social inequality and poor welfare provision across the Maghreb will lead to protests seeking socioeconomic and political reform. These protests may be delayed in Morocco, whose strong state response to the pandemic will improve the regime’s approval ratings, but not in Algeria (whose military-controlled leadership will be weakened by the ongoing situation) nor in Tunisia (whose fledgling democracy may be threatened by the economic fallout from the outbreak).

Morocco’s diversified alliance base and its role as a key regional security player make it less likely to accept EU criticism of its domestic policies – although it will likely continue to heed recommendations on its economy for so long as it receives EU funding

The Moroccan regime, led by King Mohammed VI, rules over a country lacking in energy resources and plagued by persistent socioeconomic problems and a long-running territorial dispute over Western Sahara. Morocco sees the European Union as a key source of support in addressing these problems. This gives the EU significant influence in Morocco – even as the country moves to strengthen its hand in the relationship.
Morocco depends on European trade, financial aid, and diplomatic support over Western Sahara. It particularly values its relationship with France, which the monarchy sees as its most steadfast ally. However, the Moroccan authorities regard Morocco’s overdependence on Europe as a source of weakness. Indeed, to maintain trade relations and continue to receive bilateral aid from the EU, the Moroccan regime has often had to accept trade restrictions and criticism of its human rights record from some European countries. In recent years, this has led Moroccan decision-makers to diversify the country’s support base, by strengthening ties with Gulf Cooperation Council (GCC) countries and by seeking out new relationships with non-traditional partners, such as China and Russia.
Morocco’s economic overdependence on Europe stems from the EU’s position as both the kingdom’s main trading partner and its largest source of bilateral aid. Indeed, Morocco is the biggest beneficiary of EU aid in the Mediterranean, having received billions of euros from both the European Neighbourhood Instrument and the European Investment Bank between 2014 and 2017.
While the regime views EU aid and trade in a positive light, it has been irritated by Europe’s criticism of its approach to human rights – especially that linked to the repression that followed the 2011 Arab uprisings – and its refusal until recently to negotiate over Western Sahara. This could be seen in King Mohammed VI’s speech at the 2016 GCC summit, at the height of the tension between Morocco and some international organisations (including the EU and the United Nations) over the territorial dispute. He made clear that the regime would not accept any interference in its domestic politics.
Aware that Morocco’s economic survival depends on trade with Europe and EU aid, Rabat has worked to maintain good relations with the bloc despite this tension. Even in his speech at the summit, the king insisted that, while Morocco forged new alliances with Russia and China, it would strive to maintain its partnerships with its current allies (such as EU states). Nonetheless, these new partnerships allow Morocco to strengthen its negotiating position vis-à-vis Europe.
SECURITY AND MIGRATION CONCERNS
In the last few years, as disorder resulting from the Arab uprisings grew across the region, security concerns about terrorism, migration, and state breakdown have dominated EU-north African relations. Morocco is a rare zone of relative stability in a volatile region. This has allowed Morocco to present itself as a reliable ally for Europe and a safe destination for European investment, as well as a major player in resolving the crisis of radicalisation in north Africa and stopping terrorist plots before they unfold on European soil (especially in Belgium, France, and Spain). This gives the regime leverage in its dealings with the EU, offsetting its dependence on European financial and diplomatic support.
Morocco also increasingly uses its role in limiting irregular migration to Europe, particularly Spain, to strengthen its hand in its relations with the EU. Many Moroccan citizens have high regard for Europe – although this appears to be changing. According to a study by EU Neighbours South, the share of Moroccans who viewed the EU positively fell by 13 percentage points between 2017 and 2018. However, even with the drop, 59 percent of respondents still had a positive view of the EU. Many Moroccan respondents linked the bloc to concepts such as human rights, democracy, and individual freedoms. European cultural influence in Morocco is enhanced partly by television and social media, especially that from France and Spain.
Furthermore, many young people in Morocco idealise life in Europe, making it a major attraction for migrants from the country. The percentage of respondents who argue that the EU should play a greater role in their country – through trade, economic development, and migration – is higher in Morocco than in any other state in the Maghreb. Indeed, a striking 71 percent of Moroccan respondents think that the EU has a positive impact on their country’s development. In this environment, the EU can boost the reach it has in Morocco through aid programmes directed at local communities.
CONCLUSION
The Moroccan regime knows it cannot survive without European trade and aid. However, its diversification efforts – through alliances with GCC and African countries, as well as China and, potentially, Russia – will make it less dependent on the EU in the future. Morocco’s role in constraining irregular migration and fighting terrorism will continue to make it a valuable ally for the EU. Morocco will be less likely to accept EU criticism of its human rights record or its territorial dispute – although it will likely continue to heed recommendations on its economy for so long as it receives EU funding. French-Moroccan relations will remain strong. Paris may even increase its influence in Morocco, not least due to the extremely positive views of France among both the regime and the population.
Finally, and most importantly, the Western Sahara dispute will remain a red line for the Moroccan regime in its relations with Europe. Morocco has welcomed the EU’s apparent acceptance of this fact, as reflected in the position adopted in June 2019 by Federica Mogherini, then the EU’s high representative for foreign and security policy. The Moroccan regime will almost certainly distance itself from the EU and its member states if it believes that they have supported any infringement of Moroccan territorial sovereignty.

يحكم النظام المغربي بقيادة الملك محمد السادس بلدا يفتقر إلى موارد الطاقة ويعاني من مشاكل اجتماعية واقتصادية مستمرة ونزاع إقليمي طويل المدى على الصحراء الغربية. ويرى المغرب في الاتحاد الأوربي مصدرا رئيسيا للدعم في مواجهة هذه المشاكل. ويعطي ذلك الاتحاد الأوربي نفوذا كبيرا في المغرب – حتى مع تحرك البلاد نحو تعزيز موقفها في هذه العلاقة.

كما يزداد استغلال المغرب لدوره في الحد من الهجرة غير الشرعية إلى أوربا ولاسيما إسبانيا وذلك لتعزيز موقفه في علاقاته مع الاتحاد الأوربي، حيث يكن الكثير من المواطنين المغربيين احتراما شديدا لأوروبا – بالرغم من أنه يبدو أن ذلك يتغير حاليا. فوفقا لدراسة دول الجوار الأوربي بالجنوب "EU Neighbours South"، انخفض معدل المغربيين الذين ينظرون إلى الاتحاد الأوربي نظرة إيجابية بنسبة 13 نقطة مئوية ما بين عامي 2017 و2018. ومع ذلك، حتى مع الانخفاض، لايزال لدى 59 بالمائة من المستجيبين للدراسة نظرة إيجابية للاتحاد الأوربي. وربط الكثير من المغربيين المستجيبين للدراسة الاتحاد بمفاهيم مثل حقوق الإنسان والديمقراطية والحريات الفردية. ومن عوامل تعزيز المد الثقافي الأوربي في المغرب التلفاز ووسائل التواصل الاجتماعي ولاسيما في فرنسا وإسبانيا.

وأخيرا، والأهم من ذلك كله أن النزاع على الصحراء الغربية سيظل خطا أحمرا بالنسبة للنظام المغربي في علاقاته مع أوربا. ولقد رحب المغرب بقبول الاتحاد الأوربي الواضح لهذه الحقيقة حسبما ينعكس في الموقف الذي تبنته في يونيو 2019 فدريكا موغريني ثم الممثل السامي للاتحاد الأوربي للشؤون الخارجية والسياسة الأمنية. ومن شبه المؤكد أن النظام المغربي سينأى بنفسه عن الاتحاد الأوربي والدول الأعضاء فيه إذا رأى أنهم يدعمون أي انتهاك للسيادة الإقليمية المغربية.

Wir bitten Sie um Teilnahme an dieser Studie, weil Sie die Möglichkeit haben, während Ihrer Dickdarmspiegelung Darmschleimhaut- und Blutproben zur Erforschung weiterer wissenschaftlicher Erkenntnisse zur Verfügung zu stellen. Ihre Schleimhautproben sind insofern wissenschaftlich bedeutend, da
• aufgrund ihrer Krankheitssymptome ein Verdacht besteht, dass Sie an einer chronisch entzündlichen Darmerkrankung (Morbus Crohn oder Colitis ulcerosa) leiden, oder
• eine chronisch entzündliche Darmerkrankung bei Ihnen bereits bekannt ist, oder
• bei Ihnen lang andauernde Magen-Darm Beschwerden unklarer Ursache bestehen.
Ziel der Studie
In dieser wissenschaftlichen Studie untersuchen wir spezialisierte weisse Blutkörperchen. Diese Zellen befinden sich normalerweise im Blut und können bei Bedarf in die Darmschleimhaut wandern. Es ist bisher bekannt, dass gewisse Darmbakterien diese Zellen aktivieren können und es dadurch zu einer Entzündungsreaktion in der Darmschleimhaut kommen kann. Wir wollen nun untersuchen, ob diese Zellen einen Einfluss auf die Krankheitsentstehung bei chronisch entzündlichen Darmerkrankungen haben.
Die abgenommenen Schleimhautproben werden auf das Vorkommen dieser speziellen weissen Blutkörperchen und auf die Bildung von verschiedenen Eiweissen, die für die Entstehung einer Entzündungsreaktion wichtig sind, getestet. Die Untersuchungen dieser Schleimhautproben oder Ihrer Blutprobe können Untersuchungen von Molekülen auf der Zelloberfläche einschliessen, die in Ihrem persönlichen Erbgut festgelegt sind.
Im Rahmen dieser Studie werden zum Teil auch genetische Analysen durchgeführt und schliessen eine Untersuchung Ihres Erbmaterials ein, sowie die Untersuchung von Genen und DNA (Desoxyribonukleinsäure, ein wichtiger Bestandteil der Gene). In Ihrem Erbmaterial ist neben vielen anderen Eigenschaften (z.B. We ask you to participate in this study as you have the opportunity to provide intestinal mucosa and blood samples during your colonscopy for exploring further scientific findings. Your mucosa samples are scietifically significant for:
• Based on your disease symptoms, there is a suspicion that you suffer a chronic inflammatory bowel disease (Crohn’s disease or colitis ulcerosa), or
• You have a chronic inflammatory bowel disease which is already known, or
• You have long, ongoing gastrointestinal complaints of unclear causes
The Objective of the Study
In this scientific study, we investigate the white blood cells. Those cellls are normally found in blood and can if necessary wander in the intestinal mucosa. It is known so far that certain intestinal bacteria can activate those cells and this can lead to inflammatory response in the intestinal mucosa. Now, we want to investigate whether those cells have influence on the pathogenesis of chronic inflammatory bowel diseases.
The mucosa samples drawn are tested upon the occurrence of those special white blood cells and the formation of various proteins which are important for the production of the inflammatory response. The investigations of those mucosa samples or your blood samples may include investigations of molecules on the cell surface which are set in your personal genetic material.
Within the framework of this study, also genetic analyses are partly carried out, including investigation of your genetic materials as well as investigation of genes and the DNA (deoxyribonucleic acid, which is the more important component of the gene). In your genetic material, beside many other propoerties (e.g. your physical appearance or the color of your hair), it is also determined whether you tend to develop certain diseases, how you respond to treatment with certain medicines and which side effects can occur and to which extent.

This scientific study is carried out at Basel University Hospital as a unique center. It is carried out in accordance with the Swiss legislation and the international recognized guidelines. It was approved by the competent, independent ethics committee of the Canton.
