4- General Conditions for Tender
Scope of Work: The organization reserves the right to vary the scope of work specified in
the tender documents without any changes in unit price or other terms and conditions
mentioned in the bill of quantity and to accept or reject any, all, or part of submitted offers.
Qualifying Conditions: The main criteria for admission to the tender are as follows:
a) Work permission (Valid Business Registration, Tax Card).
b) Certificate of Business Registration.
c) Certificate of past experience.
d) Recognized international bank account ( the organization will make all payments in
bank checks or through bank transfer).
Proof of the above must be provided if requested.
Tender Basis:
All tender documents must be completed in full, or the application may be
disqualified.
All applicants will receive identical documents. No applicant should add, omit, or
change any item, term or condition on original papers.
Each applicant may make one bid only ( i.e, no bids from subsidiary companies).
Bids shall be made in writing calculated in USD only, clearly stated on the appropriate
forms.
All prices must include all taxes.
The bill of quantities must include all information requested.
Eligibility of Applicants: Applicants cannot apply if they:
Are not registered in Yemen.
Are bankrupt of in the process of going bankrupt.
Have been convicted for an offense concerning professional conduct.

Have been guilty of grave professional misconduct (proven by any means which the
contracting authorities can justify.
Have not fulfilled obligations related to payment of social security and taxes.
Are guilty of serious misinterpretations in supplying information.
Are in situations of conflict of interest (with prior relationship to project or family or
business relationship to parties on commission).
Were declared at serious fault of implementation owing to a breach of their contractual
obligations.
Are on any list of sanctioned parties issued by the United Nations.
Bid Evaluation: The committee will check the tenders to ensure that they contain no
amendment to the terms or any other (calculation) errors. The offers will be evaluated
according to: price, payment terms, past experience, qualification of vendors, locations
covered in Yemen and the scope of work (1) provided by the organization.
Other Evaluations: After ranking companies according to financial and technical criteria,
the commission may make into account other criteria, including, but not limited to record of
past performance, integrity, and community rapport.
Acceptance of Successful Tender:
Taking into consideration the recommendation of the commission, the organization will
make the final choice of the awarded firm. It will then send a letter of acceptance to the
successful applicant. After submitted documentation from the selected firm has been
verified, the firm will then be obliged to sign the contract from the stated amount. Any
amendment to the awarded tender will be documented as an " annex" to the contract and will
be determined by the organization.

حساب مصرفي في أحد البنوك العالمية المعترف بها (ستسلم المنظمة جميع المستحقات التي عليها من خلال الشيكات المصرفية او الحوالات البنكية).
ويجب من المتقدمين تسليم الوثائق المذكورة للمنظمة عند الطلب.
شروط التقدم لنيل المناقصة:
يجب تعبئة كآفة وثائق المناقصة مالم فان الطلب سيكون غير مؤهل لبوله.
سيحصل جميع المتقدمين على نسخة مطابة من جميع اوراق وثيقة المناقصة. ولا يجب على اي متقدم اضافة او حذف او تغيير اي مادة او شرط او بند في الاوراق الاصلية للمناقصة.
يجوز لكل متقدم ان يقدم طلباً واحداً فقط لا غير ( ويمنع تقديم عطاءات من شركاتهم الفرعية).

تقييم العطاء المقدم:
ستتولى اللجنة القيام بفحص العطاءات لتضمن عدم احتواء البنود على تعديلات او اية اخطاء حسابية. وستكون العروض مقيمة حسب القيمة، شروط الدفع، الخبرات السابقة، مؤهلات المتقدمين، المواقع المشمولة في اليمن ونطاق العمل للمنظمة.
التقييمات الاخرى:
وبعد القيام بتصنيف الشركة حسب المعايير المالية والتقنية، ستتخذ اللجنة بعين الاعتبار المعايير الاخرى ومن ضمنها، وليست محصورة على سجل الخبرات السابقة، والنزاهة والصلة الوثيقة بالمجتمع.
قبول العطاء الافضل:
وبالأخذ بعين الاعتبار بالتوصيات المقدمة من اللجنة، ستتخذ المنظمة قرارها النهائي بمن رسا عليه العطاء. وسيتم في حينها ارسال رسالة موافقة على صاحب العطاء الافضل الذي اعلن نجاحة. وبع تسليم الوثائق المطلوبة من المؤسسة التي رسا عليها العطا، ستكون المؤسسة/المكتب التي/الذي نال المناقصة ملزمة بتوقيع العقد وتولي المهمة الموكلة ابتداء من المدة المذكورة بالعقد. وأن اي تعديلات تضاف الى العقد لصاحب العطاء الفائز ،كما هو مبين باللائحة، سيتم تحديده من قبل المنظمة.

Oxfam’s Joint Code of Conduct
As one ‘Oxfam’* we are a strategic network of
organizations working together internationally to find
lasting solutions to poverty and injustice. We share a
common vision, common philosophies and, to a large
extent, common working practices. We all have the same
brand values, the same passion and commitment. We
have joined forces as an international confederation
because we believe we will achieve greater impact by
working together in collaboration with others.
Together we are working towards a world in which people
can live with dignity, have their basic needs met and their
basic rights respected, and have the ability to control their
own lives.
As we work to achieve our ambition and vision of ‘a just
world without poverty’ we should always remain true to
our core mission, aims and values. This Code of Conduct
will help you live by them by providing guidance in the
face of ethical dilemmas you may experience. It shows
you what to do when a situation is complex by providing
standards and values for you to follow and how to protect
against situations that may damage you or Oxfam. It also
seeks to ensure that employees avoid using possible
unequal power relationships for their own benefit.
The rules and guidelines contained in this Code of
Conduct, together with your employing affiliate’s policies
and procedures and the terms and conditions of your
employment (as outlined in your employment contract or
your collective agreement if applicable), provides a
framework within which all Oxfam employees, regardless
of location, undertake to discharge their duties and to
regulate their conduct. They also support Oxfam in our
role in implementing, monitoring and enforcing these
standards.
The Code does not exempt anyone and in accordance
with relevant employing affiliate’s policies and procedures,
any breach may result in disciplinary action (including
dismissal in some instances), and in some cases could
lead to criminal prosecution.
In accepting your appointment you undertake to discharge
your duties and to regulate your conduct in accordance
with the requirements of this Code, thereby contributing to
Oxfam’s quality of performance and reputation. The code
describes what Oxfam expects from its employees and
what the employees can expect from Oxfam.
Whilst recognising that local laws and cultures differ
considerably from one country to another, Oxfam is an
International Non-Governmental Organisation (INGO) and
therefore the Code of
Conduct is developed from International and UN
standards.
This Code is subject to relevant international human rights
law, wherever the employee is employed and shall be
read in a manner that is compliant with that law
‘Oxfam’* means any Oxfam Affiliate and/or Oxfam
International throughout the world.
Code of Conduct: Standards and Values
As an Oxfam employee I will:
1. Uphold the integrity and reputation of Oxfam by
ensuring that my professional and personal conduct
is demonstrably consistent with Oxfam’s values and
standards.
I will seek to maintain and enhance public confidence in
Oxfam by being accountable for the professional and
personal actions I take and ensuring that I manage the
power that comes with my Oxfam position with
appropriate restraint.
Whilst observing the requirements of the Code of
Conduct, I will also be sensitive to, and respectful of, local
customs and culture, even if the norms and values in that
cultural context differ from the Code of Conduct. I will if
necessary seek (and will receive) support and advice from
Oxfam.
I will not work under the influence of alcohol or use, or be
in possession of, illegal substances on Oxfam premises,
vehicles or accommodation.
2. Treat all people with respect and dignity and
challenge any form of harassment, discrimination,
intimidation, exploitation or abuse
Oxfam staff hold a privileged position of power and trust in
relation to our partners and the communities that we come
from and serve. When carrying out Oxfam’s mission I
understand that it is important not to abuse my own
position of power/unequal power relationships in any way.
Recognising my role in Oxfam’s mission to challenge
injustice and poverty, I will respect all peoples’ rights,
including children’s rights, and I will contribute to a
working environment characterised by mutual respect,
integrity, dignity and non-discrimination.
I will ensure that my relationships and behaviour are not
exploitative, abusive or corrupt in any way, and I will not
engage in any form of sexual abuse or exploitation of any
persons of any age.
In line with international standards I will not have sexual
relations with children (defined as under 18 years old) or
with beneficiaries (in exchange for assistance or any other
reason) recognising the inherent unequal power dynamics
involved, and that such behaviours can undermine the
integrity and credibility of Oxfam's work;
I will also not exchange money, offers of employment,
employment, goods or services for sex or sexual favours,
nor any other forms of humiliating, degrading or
exploitative behaviour, understanding that these
standards exist to challenge sexually exploitative and
abusive behaviour.
I will use my best endeavours to report any such
behaviours or malpractice in the workplace by others to
my line management or through recognised confidential
reporting systems.
3. Perform my duties and conduct my private life in a
manner that avoids possible conflicts of interest with
the work of Oxfam.
I will declare any financial, personal, family (or close
intimate relationship) interest in matters of official
business which may impact on the work of Oxfam (e.g.
contract for goods/services, employment or promotion
within Oxfam, partner organizations, beneficiary groups).
I will advise Oxfam of any intention to seek a nomination
as a prospective candidate or another official role for any
political party or public office to clarify whether any
conflict, or perceived conflicts, with my duties with Oxfam
may arise.
Even when the giving and acceptance of gifts is normal
cultural practice I will reject monetary gifts or inappropriate
gifts from governments, beneficiaries, donors, suppliers
and other persons, which have been offered to me as a
result of my employment with Oxfam. Where the giving
and acceptance of gifts is normal cultural practice, I will
ensure that such gifts are within the limits of reasonable
judgements and in accordance with procurement policies
and I will report gifts to the line management and where
appropriate hand them onto Oxfam.
I will assure that assistance by Oxfam is not provided in
return of any service or favour from others.
I will act against any form of corruption and not offer,
promise, give or accept any bribes.
4. Be responsible for the use of information,
equipment, money and resources to which I have
access by reason of my employment with Oxfam.
I will use my discretion when handling sensitive or
confidential information.
I will seek authorization before communicating externally
in Oxfam’s name and will avoid any unintended
detrimental repercussions for me or Oxfam.
I will appropriately account for all Oxfam money and
property, (e.g. vehicles, office equipment, Oxfam-provided
accommodation, computers including the use of internet,
email and intranet).
5. Protect the health, safety, security and welfare of all
Oxfam employees, volunteers and contractors.
I will undertake and act on appropriate risk assessments.
I will comply with local security management guidelines
and be pro-active in informing management of any
necessary changes to such guidelines.
I will behave in such a way as to avoid any unnecessary
risk to the safety, health and welfare of myself and others,
including partner organizations and beneficiaries.
6. Promote human rights, protect the environment and
oppose criminal or unethical activities.
I will ensure that my conduct is consistent with the human
rights framework to which Oxfam subscribes.
I will use my best endeavours to protect the natural
environment and work in a sustainable way.
I will contribute to preventing all forms of criminal or
unethical activities.
I will inform Oxfam of any relevant criminal convictions or
charges I have had prior to my employment in which
Oxfam may have a legitimate interest.
I will also notify Oxfam if I face any criminal charges
during my employment that may impede my ability to
perform the duties of my position subject to national
legislation.

وتضمنت مدونة قواعد السلوك القوانين والارشادات، جنباً الى جنب، مع سياسات التوظيف والاجراءات والبنود والشروط الواجب اتباعها في طلب التوظيف (كما هو مذكور بإيجاز في عقد العمل الخاص بك والموافقات التي حصلت عليها ان كانت قابلة للتطبيق)، فهي تقدم اطار العمل الذي يتعهد كافة موظفي الاكسفام، وبغض النضر عن المناصب التي يشغلونها بإنجاز المهام الموكلة اليهم وضبط سلوكياتهم، وكذلك بدعم الاوكسفام من خلال التحكم في تنفيذ ومتابعة وتقوية هذه المعايير.
ولا تستثني مجموعة هذه القوانين والإرشادات أي أحد، لذلك فأن ارتكاب أي مخالفة قد تستوجب اتخاذ إجراء صارم (قد يصل الى حد تسريح الموظف من منصبه كما في بعض الامثلة)، وفي بعض الحالات قد تؤدي الى رفع دعوى قضائية على من ارتكب المخالفة.
وعند قبولك للوظيفة والعمل لدى ال أوكسفام، فإنك تتعهد بإنجاز المهام الموكلة اليك وأن تقوم بضبط سلوكياتك طبقاً لما يتطلب تنفيذ هذا القانون، وبهذا الاجراء فأنك تساهم بعملك بجودة الأداء والسمعة الحسنة للأوكسفام. وتوضح مدونة السلوك ما الذي تتوقعه الأوكسفام من موظفيها وأيضاً ما الذي يتوقعه الموظفون الحصول عليه من الأوكسفام.
وبالرغم من القوانين والثقافات المحلية تختلف بشكل كبير من بلد الى آخر كما هو معروف، إلا أن مدونة قواعد السلوك قد تم تطويرها من المعايير الدولية والأمم المتحدة، وذلك لكون الأوكسفام منظمة دولية غير حكومية.
وللعلم فإن مدونة قواعد السلوك الخاصة بالتوظيف لدى الأوكسفام مرتبطة بصلة وثيقة مع القانون الدولي لحقوق الانسان، وحالما يتم تعيين الموظف الجديد، فيلزم عليه/ها أن يكون مطلعاً وخاضعاً لأحكامها
مدونة قواعد السلوك: المعايير والقيم المثلى:
أتعهد بصفتي احد موظفي منظمة أوكسفام بأني سـ:
1 - أحافظ على سمعة وسلامة منظمة أوكسفام بأن أضمن أن يكون سلوكي المهني والشخصي متوافق مع القيم والمعايير الخاصة ب أوكسفام.
سأبذل ما بوسعي للحفاظ على سمعة منظمة أوكسفام وتعزيز ثقة المجتمع بها بأن أكون مسؤولاً عن تصرفاتي وأفعالي المهنية والشخصية التي أقوم بها، وأضمن بأن أستخدم السلطة الممنوحة لي ضمن صلاحيات منصبي بالمنظمة.
وعلاوة على ملاحظة متطلبات مدونة قواعد السلوك، سأكون أيضاً مراعياً ومحترماً للعادات والتقاليد والثقافات المحلية، حتى وإن كانت القوانين والسلوكيات والقيم الخاصة بهم تختلف عن مدونة السلوك الخاصة ب أوكسفام، وسأطلب المشورة والنصح (وسأتلقى الدعم) والتأييد من ال أوكسفام إن لزم الأمر.
2 - أعامل جميع الناس باحترام وكرامة وأن لا أرضى بأن يتعرضوا لأي نوع من الأذى، او التمييز في المعاملة، او الترهيب، او الاستغلال، او الأذى النفسي والبدني.
يتمتع موظف أوكسام بامتياز وظيفي بما يملك من سلطة يمارسها في عمله وثقة بالتعامل مع شركائنا والمجتمعات التي نحن منها ونقوم بخدمتها. فعندما أنفذ مهمة للمنظمة، فأنا أعي تماماً بأهمية عدم اساءة استخدام سلطة منصبي/ وسلطات غير متكافئة بالعلاقات بأي شكل من الأشكال.
أقر بأن دوري في مهام منظمة أوكسفام هو لمكافحة الظلم والفقر، وسأحترم كافة حقوق الناس ومن ضمنها حقوق الاطفال، وسأساهم بخلق بيئة عمل تمتاز بالاحترام المتبادل والنزاهة وبكرامة وبلا تمييز في المعاملة.
وسأضمن بأن لا تكون علاقاتي مع الآخرين وسلوكي الشخصي استغلالية، سيئة او فاسدة بأي شكل من الاشكال، ولن اتورط في الاساءة او الاستغلال الجنسي لأي نوع من الناس وبأي عمر كانوا.
وبحسب ما يتوافق مع المعايير الدولية، فأني اتعهد بعدم القيام بعلاقات جنسية مع القاصرين (من لم يبلغوا سن ال 18 )، او مع المستفيدين (سواء كان بمقابل الحصول على مساعدة او بأي سبب آخر) متذكراً على الدوام عدم التكافؤ في القوى والغرائز الكامنة، و إن القيام بأية سلوكيات مخلة بالآداب المتعارف عليها قد يؤثر سلباً مصداقية وأمن و سلامة منظمة أوكسفام وكوادرها.
ولن اقدم المال، او اقوم بعرض وظيفة، او توظيف، او سلع وخدمات بمقابل ممارسة علاقة جنسية او مجرد منفعة مرتبطة بشهوات جنسية، ولا حتى لأي شكل من أشكال الانحطاط الآدمي او السلوكيات الاستغلالية، واعياً بشكل تام بأن هذه المعايير إنما وجدت للقضاء غلى الاستغلال الجنسي والسلوكيات المؤذية.
وسأبذل ما بوسعي للإبلاغ عن اي سلوكيات مخالفة مما سبق ذكرة، او اي ممارسات سيئة في موقع العمل يقوم بها الآخرون الموجودين في نفس السياق الاداري بالإبلاغ عنها بطريقة التقارير الموثوقة المتعارف عليها.
2 – تأدية المهام الموكلة إلي على أكمل وجه والتحكم بحياتي الخاصة وفق اخلاق تجنبي احتمال الوقوع في تضارب بالمصالح مع منظمة أوكسفام.
سأظهر أية مصالح شخصية ذو صلة بعملي الرسمي سواء كانت مالية، شخصية، عائلية (او كانت مجرد علاقة حميمية) والتي قد تؤثر على عمل الاوكسفام، على سبيل المثال:( ابرام عقود شراء السلع الغذائية،تقديم خدمات، توظيف، او منح ترقيات في منظمة أوكسفام، او المنظمات الشريكة، او حتى مع جماعات المستفيدين).
سأقدم النصح والمشورة لمنظمة أوكسام إن كانت لدي نوايا لطلب تزكيتي كمرشح مرتقب او لتأدية مهمة رسمية اخرى لأي حزب سياسي او لدى اي جهة رسمية اخرى لتوضيح ما اذا كان هناك احتمال نشوب صراع او اختلاف بالمفاهيم مع مسؤولياتي الوظيفية في الأوكسفام.
وبالرغم من ان تقديم الهدايا وقبولها تعتبر ممارسات عادية، إلا أني سأرفض قبول الهدايا المادية أو الهدايا الغير ملائمة التي يتم عرضها علي كوني موظف أحد كوادر موظفي أوكسفام سواء كانت مقدمة من جهات حكومية، أو مستفيدون، او مانحون، او موردون، او أياً كان. وحينما تكون ممارسات تقديم الهدايا او قبولها في اطار المعاملات العادية، فسأضمن ان تكون هذه الهدايا محدودة ضمن احكام منطقية ووفقاً للسياسات الخاصة بالحيازة والتملك. وسأقوم بالإبلاغ عن الهدايا للإدارة المسؤولة المباشرة وأستفسر منهم عن الطريقة المثلى لتسليمها للأوكسفام.
سأضمن بأن المساعدة المقدمة من الأوكسفام ليست بمقابل الحصول على اي خدمة او معروف من المحتاجين.
سأمنع وسأقف ضد كافة أشكال الفساد، ولن امنح الوعود الفياضة وكذلك لن أقدم او أقبل الرشاوى أبداً.
4 – أتعهد بأن مسؤولاً عن استخدام المعلومات، المعدات، الأموال والموارد الخاصة بمنظمة أوكسفام التي امتلك صلاحية الوصول اليها كوني موظف بها.
سأكون حريصاً للغاية عند التعامل واستخدام معلومات حساسة او سرية للغاية تخص المنظمة.
سأحرص على الحصول على تصريح قبل اجراء اتصالات خارجية باسم المنظمة ولن أتسبب بأية اضرار ناتجة بغير قصد وتؤثر علي او على الأوكسفام.
أتعهد بأن اكون مسؤولاً عن أموال وممتلكات الأوكسفام (كالآليات، والمكتبيات، والسكنات التي توفرها المنظمة، وأجهزة الحاسوب، وما تشملها من استخدام للأنترنت، أو البريد الالكتروني، او شبكة الانترنت الداخلية للأوكسفام.
5 – المحافظة على صحة، وسلامة، وأمن كافة موظفي، ومتطوعي، ومقاولي المنظمة والتمني لهم بوافر الخير والسعادة.
أتعهد بأن أتصرف حسب تقييمات المخاطر الملائمة.
سأتبع الارشادات الجهات الامنية الداخلية وسأساهم بإبلاغ الادارة بأية تعديلات هامة فيما يخص الارشادات الامنية.
و أن يكون سلوكي وتصرفاتي مثالية بالطريقة التي تجنبني التسبب او الوقوع بأية مخاطر انا في غنىً عنها سواءً على سلامتي وصحتي ورفاهيتي الخاصة أو على الآخرين بما فيهم المنظمات الشريكة والمنتفعون ايضاً.
6 – أن ادعم حقوق الانسان وأن احمي البيئة وأن اقف ضد الاعمال الاجرامية او الغير اخلاقية.
سأحرص بأن تكون سلوكياتي وتوجهاتي ثابتة مع الاطراف المعنية بحقوق الانسان التي تؤيدها منظمة الأوكسفام.
سأسعى جاهداً للعمل على حماية البيئة الطبيعية.
سأساهم بمنع وقوع كافة اشكال الاعمال الاجرامية والغير اخلاقية على حد سواء.
سأبلغ منظمة أوكسام عن أية ادانات جنائية او تهم تم توجيهها الي من قبل ان اعمل لدى المنظمة والتي بدورها تتعارض مع المصالح المشروعة للمنظمة.
وسأقوم كذلك بإبلاغ المنظمة عن ما اذا وجهت الي اية تهم جنائية والتي قد تعيق قدرتي على اداء مهامي الوظيفية في الأوكسفام التي تمتثل بشكل كامل للقانون العام للبل
