حماية الأطفال من العنف وتسلط الأقران (التنمر)
تضمن الشرعة الدولية والوطنية حقوقاً وحريات للطفل بوصفه إنساناً في جميع مراحل حياته وتجرم كل صور انتهاك تلك الحقوق والحريات التي من شأنها ان تجعله يعيش في بيئة مضطربة لا ترعى خصوصيته وكرامته البشرية.
فعلى سبيل المثال تنص المادة التاسعة عشر من اتفاقية حقوق الطفل لعام 1989 على جميع الدول اتخاذ جميع التدابير التشريعية والإدارية والاجتماعية والتعليمية الملائمة لحماية الطفل من كافة أشكال العنف والضرر أو الإساءة البدنية أو العقلية والإهمال أو المعاملة المنطوية على الإهمال وإساءة المعاملة أو الاستغلال، وأضاف الدستور العراقي لعام 2005 في المادة التاسعة والعشرون تكفل الدولة حماية الأمومة والطفولة والشيخوخة وترعى النشء والشباب وتوفر لهم الظروف المناسبة لتنمية ملكاتهم وقدراتهم، وانتهى البند الرابع من المادة عينها إلى منع كل أشكال العنف والتعسف في الأسرة والمدرسة والمجتمع، ولما كان الدستور أعلى القوانين واسماها منزلة والملزم للسلطات كافة واتفاقية حقوق الطفل باتت جزء من القوانين العراقية بعد المصادقة عليها بالقانون رقم (3) لسنة 1994 ما يعني وجوب حظر العنف تجاه الأطفال، وبعبارة أخرى هنالك التزام قانوني على الجميع أفراداً وسلطات عامة مقتضاه عدم استعمال العنف تجاه الجميع والأطفال خاصة، سواء اتخذ العنف صورة الإضرار بالبدن أو بالقوى والملكات العقلية والإدراكية أو النفسية، يستوي في ذلك ان يكون فعل الاعتداء ايجابياً أو سلبياً ناتج عن تعمد ام إهمال أو إساءة معاملة أو استغلال.
وكل أنواع العنف والتسلط وتجاوز الحدود بالعدوان على حقوق الغير وحرياته ويشار ان الاعتداء قد يصدر من أحد البالغين أو الأحداث ازاء الطفل ولا فرق بين ان اتحد المعتدي والمعتدى عليه بالجنس ام اختلفا، الا ان ما نود التركيز عليه هو العدوان الصادر من حدث ضد حدث أخر، وهو تسلط الأقران (التنمر) الذي يعد واحداً من الاعتداءات التي تطال الأطفال أحياناً ويحدث بصورة متكررة حينما يكون هنالك اختلال في موازين القوة العضلية والبناء الجسماني أو الملكات الذهنية اذ يشعر الحدث الضحية بالضعف والعجز عن الدفاع عن نفسه ورد العدوان وفي الوقت الذي يشعر الطرف الآخر بالقوة والاقتدار فيجنح إلى تحقير الغير والمساس بسلامته الجسدية بالضرب أو غيره.
ويحدث التسلط بين الأقران من جنس واحد، وتزداد هذه الظاهرة وضوحاً في أوساط المدارس لاسيما الابتدائية أو الدراسة الأساسية والمتتبع يلاحظ بجلاء اعتياد بعض التلاميذ في إيذاء بعضهم البعض الآخر بل يشاهد العديد منهم يمارس هواية ركل الآخرين أو التلفظ بحقهم ألفاظاً غير لائقة ما تخلف شعوراً بالإهانة ويصل الأمر إلى التهديد وإتلاف بعض الممتلكات ما يجعل الطفل في حالة من الخوف والقلق يظهر بصورة التمنع من الذهاب إلى المدرسة.
Translation - English The protection of children from violence and bullying
The International and National Bill guarantees the rights and freedoms of the child as a human being at all stages of his life and criminalizes all forms of violation of those rights and freedoms that would make him live in a turbulent environment that does not respect his privacy and human dignity.
For example, the nineteen articles of the 1989 Convention on the Rights of the Child provides that all States shall take appropriate legislative, administrative, social and educational measures to protect the child from all forms of violence, including physical or mental violence, injury or abuse, neglect or negligent treatment, maltreatment or exploitation. Article twenty-nine of the Iraqi Constitution of 2005 stipulates that the State shall protect maternity, childhood and old age, and take care of youth, and provide them with the appropriate conditions for the development of their talents and abilities, and the fourth section of the same article has ended up by preventing all forms of violence and abuse in the family, school and society.
Since the Constitution is the highest and most binding law for all authorities, and the Convention on the Rights of the Child has become part of Iraqi laws after it has been ratified by Act No. 3 of 1994, which means that violence against children must be prohibited. In other words, there is a legal obligation on all individuals and public authorities to refrain from using violence against everyone and children in particular whether the violence takes the form of harm to the body or to mental, cognitive or psychological forces. The act of aggression is equally positive or negative, as a result of intentional, negligent, maltreatment or exploitation.
All kinds of violence, predations, and transgressions of aggression against the rights and the freedoms of others, and it is pointed out that the attack may be issued by an adult or juvenile against the child, and there will be no difference whether the victim and the perpetrator have the same sex or not. However, what we would like to focus on is the aggression of one juvenile against another, that is peer bullying, which is the aggressive behavior occurring repeatedly against children when there is a physical or mental imbalance, and where the victim feels vulnerable and powerless to defend himself or to prevent the aggression, while the other party feels strong and able to alienate others and harm their physical integrity by beating or otherwise.
Bullying occurs between peers of the same sex, and this phenomenon is increasingly evident among schools, particularly primary and secondary education, and the follower clearly notes the habit of some pupils harming each other, by kicking and insulting which creates a sense of shame, and even by threatening and the destruction of property, making the child experience fear, anxiety and even misses classes.

أقلعت عن التدخين ألف مرة و مرة و عدت إليه ألف مرة و مرة و كنت أدخن مائة وعشرين سجارة في اليوم و لم أكن أستعمل عود الكبريت إلا مرة أو مرتين في اليوم و ذات ليلة في شهر ديسمبر كانت الأمطار تسقط بغزارة في القاهرة و أصوات الرعد و البرق تهز فراشي, و إستيقضت لأدخن سجارة و فوجئت أن البيت ليس فيه سجارة واحدة. و كانت الساعة الرابعة صباحا فقمت من فراشي و ارتديت ملابسي و وضعت حول عنقي كوفية من الصوف و غطيت نفسي بمعطف ثقيل و نزلت إلى الشارع أبحث عن دكان سجائر أشتري منه سجائر أو فاعل خير يمشي في الشاعر أشحد منه سجارة ووجدت كل الدكاكين مغلقة و لم أجد أحدا في الشارع يدخن سجارة و ركبت سيارتي و مضيت أبحث عن محل سجائر مفتوح و بعد نصف ساعة وجدت محلا في ميدان التحرير إشتريت منه علبة سجائر وعدت الى بيتي و في فمي سجارة و كنت أسعد رجل في العالم و لكن عدت و معي برد شديد أبقاني في الفراش سبعت أيام ثم دخلت السجن و في السجن كانوا يضايقوني بالتحكم في عدد سجائري مرة يسمحون لي بعشر سجائر في اليوم, و في اليوم التالي يجعلوها سجارة واحدة ثم خمسة سجائر ثم لا سجائر و شعرت بإذلال عجيب لم أعرف مثله طول حياتي
Translation - English cigarettes’ Humiliation
I quit smoking a thousand times, and I restarted smoking a thousand times and once. I used to smoke one hundred and twenty cigarettes a day by using only one or two matches. One night in December, It was raining heavily in Cairo, and the lightning and the thunder sound was shaking my bed. I woke up to smoke a cigarette but I was surprised that there were no cigarettes in the house. It was four a clock in the morning, when I get out of the bed, get dressed and put a woolen Kofiah around my neck. I covered myself with a heavy coat and went down the street I look for a cigarette shop to buy some cigarettes or a good person whom I can beg for a cigarette. Unfortunately, I found all the shops closed and I did not come across anyone smoking in the street. To that end, I got in my car and went on the lookout for an open cigarette shop. After half an hour, I found a shop in Tahrir square, I bought a pack of cigarettes and I went home with a cigarette in my mouth. I was the happiest man in the world but I come back with a heavy cold that kept me in bed for seven days. Then I was imprisoned, and in prison, they were harassing me by controlling the number of my cigarettes. Once they let me have ten cigarettes a day, the next day they make it one than five cigarettes than none. I have never felt so humiliated in my life.

Au milieu de ce contexte social fait de contrastes et de compromissions s’épanouit une jeunesse qui demande à vivre les principes qu’elle apprend et sent battre en son sœur une soif de grandeur et de vérité, soif qu’elle parvient difficilement à concilier avec les cadres étroits et trop bien étudies de la société forgée par ses ainés.
C’est parce que cette jeunesse n’a pas encore été suffisamment rodée à la science du décalage, pour admettre de prôner des principes et de ne pas pour autant les appliquer, qu’elle éprouve un sentiment de déception et de frustration et que de tous côtés on la voit qui bouge, essayant de ramener les choses et les événements aux dimensions de ses propres aspirations.
Que dans cette recherche de l’idéal et de la vérité elle commette des excès, ceci ne saurait être contesté. Ces débordements de la jeunesse sont certainement très dangereux et peuvent compromettre la réalisation de l’idéal même qui en est à la base. Il n’en demeure pas moins qu’il faut les orienter et non les brider. Ils sont un précieux aiguillon pour ceux qui tiennent encore entre leurs mains les rênes du pouvoir ou qui par leur activité intellectuelle et scientifique influent grandement sur la vie des nations.
Sans la contestation d’une certaine jeunesse dans un pays ami, on n’aurait pas vu les reformes bienfaisantes qu’ont appliquées les dirigeants, et sans le réveil calme et lucide de la jeunesse libanaise on ne verra peut-être pas s’édifier le Liban de demain.
Translation - Arabic خيبة امل الشباب
في خضم هذا السياق الاجتماعي الذي يتكون من التناقضات و التنازلات , هناك شباب يريد ان يعيش المباديء الذي تعلمها وجعلت قلبه ينبض لتعطشه للعضمة و الحقيقة , تعطش بالكاد يتمكن من التوافق مع الاطر الضيقة و المدروسة جيدا في المجتمع , و التي تم صياغتها من طرف الحكماء.
فذلك راجع الى ان هذا الشباب لم يرتكز بعد على نحو كامل في علم التفاوت , للاعتراف بمادئ الوعض و عدم تطبيقها , مما يخلق شعور بلاحباط و الخيبة في كل اتجاه يتحركون اليه , محاولين بذلك وضع الاشياء و الاحداث الى حد تطلعاتهم .
في حذا البحث على المثالبة و الحقييقة يرتكب هذا الشباب عدة تجاوزات لانستطيع تقبلها , ان تجاوزات الشباب هذه خطيرة للغاية و يمكن ان تحول دون تحقيق المثالية التي كانوا يرمون اليها فالاصل.
ومع ذلك فمن الضروري توجيههم و عدم كبحهم لانهم عامل مهم , للذين مازالوا يحتفضون بزمام السلطة , او اللذين يؤثرون بشكل كبير على حياة الامم من خلال نشاطهم الفكري و العلمي .
لولا التحدي الذي واجهه بعض الشباب في البلدان الصديقة لما راينا الاصلاحات المفبدة التي ينفذها القادة , ولما راينا تشييد لبنان الغدد بدون الصحوة الهادئة و الفطنة للشباب اللبناني .

In the old distinction between teachings versus story-telling, the essayist cleverly camouflages his intentions, he is a bit of a teacher or a reformer, and an essay is intended to convey the same point to each of us.
This emphasis upon the mind is what makes essays less universal in their appeal than stories. they are addressed to an educated, perhaps a middle-class, reader, with certain presuppositions shared, a frame of reference, even a commitment to civility that is shared not the grand and golden empathy inherent in every man which the story-telling has a chance to tap...”
Translation - Arabic مخاطبة العقول
إن بيع القصص القصيرة مهما كانت أنواعها أيسر بكثير في بيعها من المقالات بالنسبة للكاتب، ولهذا تجد الكثير منها طريقها للطبع. إلا أن المقالات من جهة أخرى تشمل على مستويات أقل من القصص القصيرة، لأننا غير ملزمين بمناقشة معانيها. ففي التمييز التقليدي بين التعليم وسرد القصص. فإن كاتب المقالات مهما حاول تمويه نواياه بذكاء فيه شيء من المعلم أو المصلح. فهدف المقالة تبليغ نفس الرسالة لكل واحد منا. التأكيد حول مخاطبة العقول هو ما يجعل المقالات اقل شمولية في جذب القارئ مقارنة بالقصص.
انما موجهة لقارئ متعلم ربما ينتمي إلى طبقة متوسطة يتقاسم افتراضات مسبقة وإطار مرجعي بالإضافة الى الحس المدني الذي. يشاطر به الاخرين وليس ذلك التعاطف الوجداني النبيل الساكن في جوارح كل انسان الذي يكون بإمكان القاص التلاعب بأوتاره.
