Source text - English Once upon a time, there were three beautiful butterflies. All three of them were different colours: one was red, one was yellow, and one was white. They were best friends.
One day they were flying around a park, and spotted many luscious flowers around them. It was spring, and so it was the season that it would rain so that plants could grow. The best butterfly friends could see dark clouds in the sky, and knew it would rain soon. They began looking for shelter in the many flowers that surrounded them.
There was a pretty white lily sat close by and the butterflies flew together towards it.
They asked the lily: “May we use your beautiful white petals as shelter from the rain, please?”
She responded: “Only you, white butterfly, because you are the same colour as my petals!”
Because this meant that the other two butterflies would get wet, they decided to fly towards the pretty multicoloured tulip instead, which was slightly bigger in size.
“Excuse me tulip, would it be possible to use your beautiful petals as shelter from the rain?” asked the yellow butterfly.
“You, yes, yellow butterfly. And your red friend too! As you can see my petals are yellow and red. But not the white butterfly, because he doesn’t match my petals!”
“All three of us, or none of us!” shouted all three butterflies in unison.
The shining sun, looking down through the dark clouds, watched how united all three butterflies were, and drove away the rain.

एक दिन वे एक पार्क के चारों तरफ उड़ रही थीं, ओर अपने चारों तरफ बहुत से रसभरे फूलों को चिन्हित कर रहीं थी । यह बसंत था, इसलिए यह वह मौसम था जब बरसात होती है और पौधे बढ़ सकते हैं। सबसे अच्छी तितलियां दोस्तर आसमान में घने बादलों को देख सकतीं थी और जानती थी कि जल्द बारिश हो सकती है। उन्होंने अपने आसपास के बहुत से फूलों में आश्रय भी देखना शुरू कर दिया ।

इसका मतलब अन्य दो तितलियां बरसात में भीग जाएंगी, उन्होंने इसकी बजाय उड़कर प्यारे रंगबिरंगे टयूलिप की तरफ जाने का फैसला किया, जो आकार में भी थोड़ा बड़ा था।
“ माफ करें टयूलिप, क्यार यह मुमकिन है कि आपकी खूबसूरत पंखूडि़यां बरसात में बतौर आश्रय इस्तेमाल की जा सके”? पीली तितली ने पूछा।
“ तुम, हां, पीली तितली और तुम्हारी लाल दोस्तक भी! जैसा कि तुम देख सकती हो कि मेरी पंखुडि़यां लाल और पीली है। परन्तुत सफेद तितली नहीं, क्योंतकि वह मेरी पंखुडि़यों के साथ मेल नहीं खाती”!

In this case there were multiple respondents and a relation between the various claims which were part of the same body of facts. One of the respondents invoked a choice of forum clause in the terms and conditions. The court considered that for reasons of fitness for purpose, and to prevent contrary decisions, it would be desirable that the proceedings would be given an opinion on by only one court. This means that it is contrary with the requirements of proper rules of procedure that the claims are cut up, in the sense that the court would (only) be competent when it comes to the claims towards one respondent (but not towards the claims towards the other respondent due to the choice of forum clause), as a result of which a strongly intertwined case would have to be submitted to various courts. The court considered itself to be competent pursuant to article 107 CCP (legal ground 4.4 – 4.6).
