An Act to protect the rights of married Muslim women and to prohibit divorce by pronouncing talaq by their husbands and to provide for matters connected therewith or incidental thereto.
BE it enacted by Parliament in the Seventieth Year of the Republic of India as follows:
CHAPTER-I
PRELIMINARY
1. Short title, extent and commencement.—(1) This Act may be called the Muslim Women (Protection of Rights on Marriage) Act, 2019.
(2) It shall extend to the whole of India except the State of Jammu and Kashmir.
(3) It shall be deemed to have come into force on the 19th day of September 2018.
2. Definitions. In this Act, unless the context otherwise requires, - (a) "electronic form" shall have the same meaning as assigned to it in clause (r) of sub-section (1) of section 2 of the Information Technology Act, 2000 (21 of 2000); (b) "Magistrate" means a Judicial Magistrate of the first-class exercising jurisdiction under the Code of Criminal Procedure, 1973 (2 of 1974), in the area where the married Muslim woman resides; and (c) "talaq" means talaq-e-biddat or any other similar form of talaq having the effect of instantaneous and irrevocable divorce pronounced by a Muslim husband.
CHAPTER II
DECLARATION OF TALAQ TO BE VOID AND ILLEGAL
3. Talaq to be void and illegal.—Any pronouncement of talaq by a Muslim husband upon his wife, by words, either spoken or written or in electronic form or in any other manner whatsoever, shall be void and illegal.
1. Came into force with retrospective effect from 19th September 2018 and published in the Gazette of India, Extra. Part II, Section 1, dated 31st July 2019 by the Ministry of Law and Justice (Legislative Department).

4. Punishment for pronouncing talaq.—Any Muslim husband who pronounces talaq referred to in section 3 upon his wife shall be punished with imprisonment for a term which may extend to three years, and shall also be liable to fine.
CHAPTER III
PROTECTION OF RIGHTS OF MARRIED MUSLIM WOMEN
5. Subsistence allowance.---- Without prejudice to the generality of the provisions contained in any other law for the time being in force, a married Muslim woman upon whom talaq is pronounced shall be entitled to receive from her husband such amount of subsistence allowance, for her and dependent children, as may be determined by the Magistrate.
6. Custody of minor children.—notwithstanding anything contained in any other law for the time being in force, a married Muslim woman shall be entitled to custody of her minor children in the event of pronouncement of talag by her husband, in such manner as may be determined by the Magistrate.
7. Offence to be cognizable, compoundable etc.—notwithstanding anything contained in the Code of Criminal Procedure, 1973 (2 of 1974), -----
(a) an offence punishable under this Act shall be cognizable, if information relating to the commission of the offence is given to an officer in charge of a police station by the married Muslim woman upon whom talaq is pronounced or any person related to her by blood or marriage;
(b) an offence punishable under this Act shall be compoundable, at the instance of the married Muslim woman upon whom talaq is pronounced with the permission of the Magistrate, on such terms and conditions as he may determine;
( c ) no person accused of an offence punishable under this Act shall be released on bail unless the Magistrate, on an application filed by the accused and after hearing the married Muslim woman upon whom talag is pronounced, is satisfied that there are reasonable grounds for granting bail to such person.
8. Repeal and saving.—(1) The Muslim Women (Protection of Rights on Marriage) Second Ordinance, 2019 (Ord. 4 of 2019) is hereby repealed.
(2) Notwithstanding such repeal, anything done or any action taken under the Muslim Women (Protection of Rights on Marriage) Second Ordinance, 2019 (Ord. 4 of 2019), shall be deemed to have been done or taken under the provisions of this Act.

شادی شدہ مسلمان خواتین کے حقوق کا تحفظ ، اور ان کے شوہروں کے ذریعہ انہیں طلاق دیے جانے پر پابندی لگانے،اور اس سے وابستہ امور یا واقعاتی معاملات کی فراہمی کے لئےایک قانون۔
اس پر جمہوریہ ہند کے سترھویں سال میں حسب ذیل پارلیمنٹ کے ذریعہ قانون نافذ کیے جانے کے لیے:-
باب اول
تمہید
1. مختصر عنوان ، حد اور آغاز۔۔ (الف) اس قانون کو مسلم خواتین (شادی سے متعلق حقوق کے تحفظ کا) قانون2019 کہا جاسکتا ہے۔
2. اس قانون کا اطلاق ریاست جموں و کشمیر کے علاوہ پورے ہندوستان پر ہوگا۔
3. یہ سمجھا جائے کہ اس کا نفاذ 19 ستمبر 2018 سے ہوجائے گا۔
2.تعریف:ـ اس قانون میں ، جب تک کہ سیاق و سباق کی ضرورت نہ ہو ، -
(الف) انفارمیشن ٹکنالوجیایکٹ، 2000 (2000 کا 21)کے سیکشن 2 کے ذیلی سیکشن (1) کی شق (ر) میں"الیکٹرانک فارم" کے معنی اسی طرح ہوں گے۔
(ب) "مجسٹریٹ" کا مطلب ہےپہلے درجہ کا قانون نافذ کرنے کا حق، ضابطہ قانون فوجداری 1973 (1974 کا 2) کے تحت ، اس جگہ جہاں شادی شدہ مسلمان عورت رہتی ہے۔اور
(ج) "طلاق" کا مطلب طلاق بدعت ہے یا اس کی کوئی دوسردی مماثل شکل جس کا اثر بذریعہ مسلم شوہر دی گئی طلاق پر فوری اور ناقابل تنسیخ ہو۔
باب دوئم
طلاق کے باطل اور غیر قانونی ہونے کا اعلان۔
3. طلاق باطل اور غیر قانونی ہے۔ مسلم شوہر کااپنی بیوی کو طلاق دینا، الفاظ کے ذریعے ، خواہ بول کر یا تحریری یا الیکٹرانک شکل میں یا کسی دوسرے انداز میں باطل اور غیر قانونی ہو گا۔
1. 19 ستمبر 2018 سے سابقہ اثر کے ساتھ عمل میں آیا اور ہندوستان کے گزٹ میں ایکسٹرا۔ پارٹ II ، سیکشن 1 ، مؤرخہ31 جولائی 2019 کو وزارت قانون و انصاف (قانون سازی کے محکمہ) کے ذریعہ شائع ہوا ،

4.طلاق دینے کی سزا ۔ — کوئی مسلمان شوہر جو اپنی بیوی کو طلاق دے بحوالہ سیکشن 3 ،اسے تین سال تک کی سزائے قید ہوسکتی ہے ، اور جرمانے کا بھی پابند ہو سکتا ہے۔
باب سوم
شادی شدہ مسلمان عورتوں کے حقوق کا تحفظ۔
شادی شدہ مسلم خواتین کے حقوق کا تحفظ۔
5.مالی کفالت-- اس وقت کے نفاذ کے لئے کسی بھی دوسرے قانون میں شامل دفعات کی عمومی حیثیت کے بغیر ، ایک شادی شدہ مسلمان عورت جس کو طلاق دی گئی ہے ، وہ اپنے اوربچے کے لئے اپنے شوہر سے اتنی مقدار میں مالی کفالت وصول کرنے کا حقدار ہوگی جسے مجسٹریٹ طے کریگا۔
6.نابالغ بچوں کی پرورش - باوجود کسی بھی دوسرے قانون میں شامل دفعات کی عمومی حیثیت کے بغیر ، ایک شادی شدہ مسلمان عورت اپنے شوہر کے ذریعہ طلاق دیے جانے کی صورت میں اپنے نابالغ بچوں کی پرورش کی حقدار ہوگی ، اس طرح کی صورت حال میں ، مجسٹریٹ طے کر سکتا ہے۔
7.قابل دست اندازی ، قابل معافی جرم وغیرہ-- ضابطہ فوجداری 1973 (1974 کا 2) کے طریقہ کارکے باوجود ،۔۔۔۔۔
(الف) اس قانون کے تحت قابل سزا جرم قابل دست اندازی ہوگا ، اگر اس جرم کے متعلق کمیشن کو شادی شدہ مسلمان مطلقہ خاتون کے ذریعہ یا کسی ایسے شخص کے ذریعہ جو اس کا خونی یا سسرالی رشتہ دار ہو اطلاع دی جائے۔
) ب) اس ایکٹ کے تحت قابل سزا جرم شادی شدہ مسلمان مطلقہ عورت کی درخواست پر ایسے شرائط و ضوابط پر مجسٹریٹ کی اجازت سےمعاف کیا جا سکتا ہے جس کا تعین وہ کریں گے۔
(ج ) اس قانون کے تحت سزا پانے والے کسی فرد کو ضمانت پر رہا نہیں کیا جاسکتا جب تک کہ مجسٹریٹ ، ملزم کے ذریعہ دائر درخواست پر اور شادی شدہ مسلمان خاتون کی سماعت کے بعد ، جس کو طلاق دی گئی ہے ، مطمئن نہیں ہوتا کہ آیا ایسے شخص کو ضمانت دینے کی مناسب بنیادیں ہیں یا نہیں۔
منسوخ اور برقراری ۔— (1) مسلم خواتین (شادی سے متعلق حقوق کا تحفظ) دوسرا آرڈیننس ، 2019 (2019 کا آرڈر 4) کو منسوخ کیا جاتا ہے۔
(2) اس طرح کی منسوخی کے باوجود ، مسلم خواتین (شادی سے متعلق حقوق کا تحفظ) دوسرا آرڈیننس ، 2019 (2019 کا آرڈر 4) کے تحت نافذ کردہ کوئی عمل یا کوئی کارروائی اس قانون کی روشنی میں نافذ العمل سمجھی جائےگی ۔
