Source text - Korean 강남역 화장실 여성살인 사건을 두고 여성혐오 범죄인지 정신질환 범죄인지 또는 ‘묻지마 폭행’인지 논란이 뜨겁다고?
‘논란이 뜨겁다’고 보도하는 것 자체가 여성혐오이다. 여성혐오 범죄임을 부인하는 사람들은 극소수이다. 대부분의 사람들은 이미 그런 논란과 무관하게 첫째, 무고하게 죽은 사람을 애도하고 있고 둘째, 아동학대의 피해자들이 그렇듯이 신체적 약자인 여성은 항상 이유 없는 폭행 대상이 쉽게 될 수 있다는 상황에 통감하고 있다. 또 상당수 사람들은 한국의 성 차별적 상황에서 여성은 카르텔을 유지하려는 남성들의 분노의 대상이 될 수 있음을 우려하고 있다. (참고로 ‘세계여성포럼’이 2015년 발표한 ‘성(性) 격차’ 세계 랭킹에서 한국은 중국이나 캄보디아보다도 낮았다.) 내가 보기에는 이번 사건으로 우리 사회는 여성차별철폐를 위해 더욱 단합하고 있다. 더 큰 문제는 논란이 있는 것처럼 보도하면서 극소수 여성혐오자들에게 목소리를 주는 것이다.
바로 작년 6월에 한 백인청년이 미국 사우스캐롤라이나 찰스턴시의 흑인교회에 들어가서 총기 난사를 했을 때 어느 누구도 그것이 증오범죄임을 의심하지 않았다. 이와 동시에 모두가 미국사회에 인종차별•혐오의 문제가 있고 강박장애를 앓고 있는 ‘미친놈’이었기에 그런 차별적 이념을 실행에 옮길 수 있었음에도 동의했다. 무슬림청년이었다면 ‘테러리즘’으로 규정되어 훨씬 더 많은 수사 자원이 투입되었을 거라는 비판이 있었을 뿐이다.
혐오는 두뇌에서 발생하는 현상이다. 당연히 두뇌에 문제가 생기면 혐오는 더 증폭될 수 있다. 이미 10년 넘게 기능적자기공명영상(fMRI)을 통해 인종차별 및 혐오가 뇌의 특정 부분의 활성화와 관련이 있음이 밝혀진 바 있다. 뇌의 관련 부분에 문제가 생겼는데 차별이나 혐오적 성향에 문제가 없다고 생각하는 것이 더 이상한 일일 것이다. 히틀러의 정신질환 가능성에 대해서 밤을 새우고 토론해도 히틀러가 저지른 범죄가 인종혐오 범죄임에 누구도 토를 달지 않는다.
강남역 사건이 ‘묻지마’ 폭행임을 주장하는 분들이 여성혐오 범죄임을 배제하기 위해 그런 주장을 하고 있다면 이를 옹호할 생각이 전혀 없다. 이번 사건은 여성혐오 범죄임이 분명하다. 하지만 지금까지 밝혀진 사실들만을 보면 여성 중에서 무작위로 상대를 선택한 묻지마 범죄임도 명백하다. 헌법의 평등원칙 내용은 자의적인 차별의 금지이다. 그렇다면 의도적인 혐오•차별과 자의적인 혐오•차별은 서로 반대말인가? 아니다. 우리는 합리적인 이유가 있어서 그 사람을 혐오하는 것을 ‘자의적인 혐오’라고 생각하지 않는다. 하지만 그런 합리적인 이유가 없는데도 어떤 사람을 차별하는 것을 ‘의도적인 차별’이라고 생각하고 금기시해왔다. 이번 사건도 ‘묻지마’이기 때문에, 즉 피해여성을 공격할 이유가 아무것도 없었기 때문에, 더욱 혐오범죄임이 명백한 것이다. 살인의 동기를 파보면 아무런 이유 없는 여성에 대한 혐오만 똘똘 뭉쳐져 있을 것이기 때문이다.
경찰이 이 사건을 정신질환 범죄로 구분하면서 구태여 여성혐오 범죄가 아님을 강조하며 ‘논란’을 자초했다. 하지만 면식이 없는 사람들에 대한 강간 또는 아동학대는 틀림없이 신체적 약자를 향한 혐오범죄이고 이 사건도 마찬가지이고 경찰로부터 더 인정받을 것도 없다. 2012년 10월 여성 12명을 연거푸 성폭행해 무기징역을 선고받은 ‘성남 발바리 사건’의 범인 B씨(47)도 2005년 특수강간 혐의로 구속된 적이 있었으나, 당시 정신병(심신미약)을 인정받아 가벼운 처벌만 받고 풀려났었다. 경찰 발표 때문에 싸우지 말고 그냥 대범하게 해석해주자. 강남역 사건에서도 ‘정신질환이니 무죄’라는 항변이 나올 수 있으니 수사를 제대로 해야 한다는 취지라고.
Translation - English When a woman was stabbed to death in a public bathroom near Gangnam Station in Seoul, South Korea, the local media reported “controversy” on the characteristic of the crime – whether the cause was misogyny or mental illness, and whether the crime can be labeled as a “random attack”. Are they serious?
Try to remember that detecting “controversy” from the public response starts from belittling of women’s rights, which is a core part of misogyny. After all, not many people are even denying the misogynistic characteristic of the case from the first place. Moreover, regardless of how they would define the motivation of the crime, people are genuinely mourning the victim, and empathizing with the mourners because this tragedy reminds them of women’s vulnerability to violence without cause, just like they are alerted by child abuse cases and mourn the most defenseless victims. People are also expressing concern over Korea’s prevalent gender inequality, which we would not even have to prove by referring to the Global Gender Gap Index published by World Women Economic Forum, which ranked South Korea lower than China and Cambodia, because this case has showed us that men who would never let traditional male privilege go can express their anger towards women in such an extremely violent way. Such response to the case can be defined as solidarity, rather than “controversy”, with the people’s commitment to end gender inequality. What is indeed problematic is the media reaction, which has only made a few misogynistic rants heard and taken seriously.
Nobody was reluctant to call Charleston shooting a hate crime in the United States, even though the white man who murdered 9 people in the African-American church was “a crazy guy”. The consensus was that discrimination and hatred towards African-American people are well and alive enough to make the mentally ill man realize the violent idea into the action. The only “controversy” regarding such a conclusion was that more resources would have been put to shed light on the case if he had been a Muslim and the shooting was conveniently considered as a terrorist attack.
Because hatred is a psychological reaction from the brain, problems in the brain like mental illness can accelerate the already existing hatred. More than ten years ago, experiments involving fMRI(functional magnetic resonance imaging) procedure proved that activation in certain parts of the brain is related to discriminatory feelings and hatred such as racism. If someone has a problem in such related parts in the brain, it is hardly possible to assume that his/her feelings are perfectly normal. However, just because the criminal is mentally ill does not mean hatred is completely irrelevant from the motivation. There might be tons of evidence that Adolf Hitler was mentally ill that psychologists are willing to discuss all night, but none of them would deny that the Holocaust was a racist crime.
The misogyny deniers who insist that the crime only be called “a random attack” deserve none of my defense. Of course, it was also a “random attack”, given that the criminal picked a random victim among all the women passing the street of Gangnam that he had not known before. However, does that fact ever dilute the fact that he hated women?
The constitution recognizes right to equality and non-discrimination, which means that any “arbitrary” discrimination on the basis of any personal characteristic is prohibited. However, that word “arbitrary” does not have a binary antonym “intentional” when it comes to hatred and discrimination. While “arbitrary” discrimination only means discrimination without an understandable reason, insisting on “arbitrary” discrimination knowing that there is no such a reason is also called an “intentional” discrimination, and, therefore, is not accepted. The Gangnam murder was a hate crime as well as a random attack, because there was no reason for the predator to specifically hate the victim, but he insisted on hating her and committing the crime. No matter how we try hard to find another core motivation, we will only face much denser hatred against women with no discoverable reason.
What the media called the “controversy” started when the Police announced that the case is identified as a crime committed by a mentally ill person. Such an announcement that sounded like they deny any misogynistic characteristic of the crime was completely unnecessary, since any form of violence, rape, or abuse targeting a stranger from a vulnerable demographic group is a hate crime, and any more approval from police of this definition would be irrelevant.
Now we are reminded of a 47-year-old serial rapist who was found guilty of abusing 12 women the city in October 2012 and was sentenced to life in prison. He had been charged for aggravated rape back in 2005, being given a significantly reduced sentence owing to mental impairment. I do not want any more argument on this, but probably the only acceptable excuse for the police might be that they are committed to keep him behind bars, and never to let him go on the grounds for mental disabilities.

Source text - English So this is James Risen. You may know him as the Pulitzer Prize-winning reporter for The New York Times.
Long before anybody knew Edward Snowden's name, Risen wrote a book in which he famously exposed that the NSA was illegally wiretapping the phone calls of Americans. But it's another chapter in that book that may have an even more lasting impact. In it, he describes a catastrophic US intelligence operation in which the CIA quite literally handed over blueprints of a nuclear bomb to Iran. If that sounds crazy, go read it. It's an incredible story.
But you know who didn't like that chapter? The US government. For nearly a decade afterwards, Risen was the subject of a US government investigation in which prosecutors demanded that he testify against one of his alleged sources. And along the way, he became the face for the US government's recent pattern of prosecuting whistleblowers and spying on journalists.
You see, under the First Amendment, the press has the right to publish secret information in the public interest. But it's impossible to exercise that right if the media can't also gather that news and protect the identities of the brave men and women who get it to them. So when the government came knocking, Risen did what many brave reporters have done before him: he refused and said he'd rather go to jail. So from 2007 to 2015, Risen lived under the specter of going to federal prison.
That is, until just days before the trial, when a curious thing happened. Suddenly, after years of claiming it was vital to their case, the government dropped their demands to Risen altogether. It turns out, in the age of electronic surveillance, there are very few places reporters and sources can hide. And instead of trying and failing to have Risen testify, they could have his digital trail testify against him instead. So completely in secret and without his consent, prosecutors got Risen's phone records. They got his email records, his financial and banking information, his credit reports, even travel records with a list of flights he had taken. And it was among this information that they used to convict Jeffrey Sterling, Risen's alleged source and CIA whistleblower.
Sadly, this is only one case of many. President Obama ran on a promise to protect whistleblowers, and instead, his Justice Department has prosecuted more than all other administrations combined. Now, you can see how this could be a problem, especially because the government considers so much of what it does secret. Since 9/11, virtually every important story about national security has been the result of a whistleblower coming to a journalist. So we risk seeing the press unable to do their job that the First Amendment is supposed to protect because of the government's expanded ability to spy on everyone.
But just as technology has allowed the government to circumvent reporters' rights, the press can also use technology to protect their sources even better than before. And they can start from the moment they begin speaking with them, rather than on the witness stand after the fact. Communications software now exists that wasn't available when Risen was writing his book, and is much more surveillance-resistant than regular emails or phone calls.
For example, one such tool is SecureDrop, an open-source whistleblower submission system that was originally created by the late Internet luminary Aaron Swartz, and is now developed at the non-profit where I work, Freedom of the Press Foundation. Instead of sending an email, you go to a news organization's website, like this one here on The Washington Post. From there, you can upload a document or send information much like you would on any other contact form. It'll then be encrypted and stored on a server that only the news organization has access to. So the government can no longer secretly demand the information, and much of the information they would demand wouldn't be available in the first place.
SecureDrop, though, is really only a small part of the puzzle for protecting press freedom in the 21st century. Unfortunately, governments all over the world are constantly developing new spying techniques that put us all at risk. And it's up to us going forward to make sure that it's not just the tech-savvy whistleblowers, like Edward Snowden, who have an avenue for exposing wrongdoing. It's just as vital that we protect the next veteran's health care whistleblower alerting us to overcrowded hospitals, or the next environmental worker sounding the alarm about Flint's dirty water, or a Wall Street insider warning us of the next financial crisis. After all, these tools weren't just built to help the brave men and women who expose crimes, but are meant to protect all of our rights under the Constitution.
