प्रस्तावना :-
महाराष्ट्र जमीन महसूल संदहता, 1966 आदर् महाराष्ट्र जमीन महसूल (सरकारी जदमनीची
दवल्हेवाट करर्े) दनयम, 1971 मधील तरतूिीनुसार शासदकय जदमनीचा आगाऊ ताबा दिल्यानंतर, अशा
जदमनींच्या कब्जेहक्काच्या रक्कमेवर त्या जदमनीचा आगाऊ ताबा दिल्यापासून ते अंदतम कब्जेहक्काची
ककमत दनदित करुन दतचा भरर्ा करण्याच्या दिनांकापयंत 15 % िराने व्याज आकारावे. तसेच,
शासदकय जदमनीच्या भूईभाड्याचा िर संपूर्ग बाजारमुल्याच्या 15 % आकारण्याचा दनर्गय संिभीय शासन
दनर्गय दि. 30.6.1992 अन्वये घेण्यात आलेला होता. याबाबत शासनाकडून पुनर्षवचार करुन उक्त
व्याजाच्या व भूईभाड्याच्या िरामध्ये सुधारर्ा करण्याबाबत संिभीय शासन दनर्गय दि. 8.07.1999 अन्वये
पुढीलप्रमार्े सुधादरत आिेश िेण्यात आलेले आहेत.
“आगाऊ ताबा दिलेल्या शासदकय जदमनीच्या अंदतम ककमतीवर तथा तात्पुरती ककमत व अंदतम
ककमत यातील थकीत रकमेवर आकारावयाच्या व्याजाचा िर आदर् भूईभाड्याने दिलेल्या शासकीय
जदमनीच्या वार्षिक भूईभाड्याचा िर भारतीय स्टेट बॅंकेच्या “प्राईम लेंडींग रेट” इतका असावा. हा िर
िरविी दि. 01 जानेवारीच्या भारतीय स्टेट बॅंकेच्या “प्राईम लेंडींग रेट” च्या िराइतका असावा आदर् तो
त्या संपूर्ग विाकदरता कायम असावा. भारतीय स्टेट बॅंकेचा “प्राईम लेंडींग रेट” मध्येच बिलला, तरी
पूवीचाच िर त्या संपूर्ग विाकदरता कायम असेल व विग संपल्यानंतर आवश्यक असल्यास पुन्हा
सुधारण्यात यावा.”

त्यानुिंगाने, सन 2016 या संपुर्ग विासाठी आकारावयाच्या उक्त नमूि व्याजाचा िर आदर्
भूईभाड्याचा िर दनदित करण्यासाठी भारतीय स्टेट बॅंकेकडून दि. 01 जानेवारी 2016 चा “प्राईम लेंडींग
रेट” प्राप्त करुन तो क्षेत्रीय यंत्रर्ांना कळदवण्याची बाब शासनाच्या दवचाराधीन होती.
शासन पदरपत्रक:-
शासकीय जदमनीचा आगाऊ ताबा दिल्यानंतर कब्जेहक्काच्या रकमेवर आकारावयाच्या व्याजाचा
िर तथा भाडेपट्ट्याने द्यावयाच्या जदमनीकरीता आकारावयाच्या वार्षिक भुईभाड्याचा िर हा प्रत्येक
विाच्या 1 जानेवारी रोजी असलेल्या भारतीय स्टेट बॅंकेच्या “प्राईम लेंडींग रेट” इतका असावा आदर् तो
त्या संपूर्ग विाकदरता कायम ठेवावा असे संिभादधन शासन दनर्गयान्वये आिेदशत करण्यात आलेले आहे.
त्या अनुिंगाने भारतीय स्टेट बॅंकेकडून दि. 01 जानेवारी 2016 रोजीचा “प्राईम लेंडींग रेट” संिभग क्र.3
येथील पत्रान्वये प्राप्त करुन घेण्यात आला असुन, त्यांनी सिर रोजीचा “ प्राईम लेंडींग रेट 9.30% ”
असल्याचे कळदवले आहे.
सबब, सन 2016 या संपुर्ग विासाठी, शासदकय जमीन कब्जेहक्काच्या रक्कमेवर आकारावयाच्या
व्याजाचा िर तथा भुईभाड्याचा िर भारतीय स्टेट बॅंकेच्या उक्त “प्राईम लेंडींग रेट” च्या िरानुसार
आकारण्यात यावा.

Preface :-
As per the provisions of the Maharashtra Land Revenue Code, 1966 and Maharashtra Land Revenue (Disposal of Government Land) Rules, 1971, after advance possession of Government land has been given, interest shall be charged on the Occupancy price of such land for the period from the date on which the advance possession of that land has been given up to the date on which the final Occupancy price has been fixed and paid, at the rate of 15%. Also, the decision to charge the ground rent of Government land at the rate of 15% of the entire market value was taken, vide Government Resolution dt. 30.6.1992, given under Reference. The Government has reconsidered this and the following amended Orders regarding amending the above-mentioned rates of interest and ground rent are being given, vide Government Resolution dt. 8.07.1999 given under Reference, as follows.
“The rate of interest to be charged on the final price or the outstanding amount between the tentative price and final price of the Government land, the advance possession of which has been given, and the annual rate of ground rent of the Government land given on lease shall be equal to the “Prime Lending Rate” of the State Bank of India. This rate shall be equal to the “Prime Lending Rate” of the State Bank of India of dt. 01 January every year and it shall remain applicable to that entire year. If the “Prime Lending Rate” of the State Bank of India changes in between, even then the previous rate only shall be applicable for that entire year and it shall be again amended after the year ends, if needed.”
Incidentally, the matter of obtaining the “Prime Lending Rate” of dt. 01 January 2016 from State Bank of India for the purpose of fixing the above-mentioned rate of interest and the rate of ground rent to be charged for the entire year 2016 and intimating the same to the regional machinery was under the consideration of the Government.
Government Circular:-
The Government has, vide Government Resolution referred to above, instructed that the rate of interest to be charged on the Occupancy Price of the Government land after it's advance possession has been given, and the annual rate of ground rent to be charged for the land to be given on lease shall be equal to the “Prime Lending Rate” of the State Bank of India of 1st January of every year and that shall remain applicable for that entire year. Accordingly, the “Prime Lending Rate” of dt. 01 January 2016 has been obtained from the State Bank of India vide letter mentioned at Reference No. 3 and they have intimated the “Prime Lending Rate to be at 9.30%” for this date.
Therefore, the interest rate to be charged on the Occupancy Price of Government land and the rate of ground rent for the entire year of 2016 shall be charged as per the rate of the “Prime Lending Rate” of the State Bank of India mentioned above.
02. This Government Resolution has been made available on the website of the Government of Maharashtra www.maharashtra.gov.in and its code number is 201605061554310019. This Order has been attested with digital signature and issued.
