Source text - Arabic يعتبر هذا العقد مفسوخا من تلقاء نفسه دون الحاجه إلي تنبيه او انذار او حكم قضائي ولا تكون الشركة بذلك مسئولة بأي شكل عن أي أضرار أو خسائر تنتج عن ذلك السبب و ان أي تأخري أو انقطاع لتلك الخدمات لأي سبب سواء لسبب خارج عن إرادة الشركة أو لسبب غيرمتوقع أو غير متعمد حدوثه فلايحق للمستثمر المطالبة بأي تعويض أو مبالغ مالية جراء ذلك.
-المقترح: يتم حذف عبارة يعتبر هذا العقد مفسوخا من تلقاء نفسه دون الحاجه الي تنبيه او انذار او حكم قضائيوتستبدل بعبارة ( يحق للطرف الأول خصم مقابل الرسوم والخدمات المستحقة طبقاً لهذا البند من التأمين المدفوع من الطرف الثاني وعلي الأخير استكمال التأمين خلال 30 يوم من تاريخ إخطاره بذلك) .
وفي حالة التأخير عن تلك الفترة يلتزم المستثمر بسداد مبلغ وقدره250 د.ك (مائتان وخمسون دينار كويتي لا غير) عن كل يوم تأخير وفي حالة تجاوز مدة التأخير30 يوم عن المدة الممنوحة يعتبرهذاالعقد مفسوخا من تلقاء نفسه دون الحاجه إل ىتنبيه اوانذاراوحكم قضائي مع عدم الاخلال بأي حقوق أخرى للشركة ناتجه ع نذلك.
Translation - English This contract shall be terminated, sua sponte, without the need of a notice, a warning of a court judgment. Acting this way, the company shall not be liable for any resulting damage or losses. If the said services discontinue for any reason beyond the control of the company or for any unexpected or unintentional cause, the investor may not claim for any compensation or financial amounts.
- Suggestion: This sentence shall be deleted: "this contract shall be terminated, sua sponte, without the need of a notice, a warning of a court judgment." And replaced by the following sentence: (the first party shall have the right to deduct due consideration of fees and services, stipulated in this clause, from the deposit paid by the second party. The latter shall complete the deposit amount within thirty days as of date of the notice to this effect).
The second party shall abide by the specified period. In case of delay, the investor shall pay KWD250 (two hundred fifty Kuwaiti Dinars) for each day of delay. If the period of delay exceeds 30 days after the granted period, this contract shall be terminated, sua sponte, without the need of a notice, a warning of a court judgment, without prejudice to any other rights resulting for the company from this act.
