RE: DISCIPLINARY HEARING OUTCOME
Dear Ingars,
I am writing to you following the disciplinary appeal hearing that took place on Wednesday 24th June 2015, at Kepak Clonee.
You chose not to be accompanied by an Employee Representative. You confirmed that you did not require translation for you. You further confirmed that you had received all of the information and documentation contained in your disciplinary pack and that all of the documents had been translated for you and you understood the contents.
As you are aware I was required to adjudicate on the following allegations:
1. That on the 18th of May last you did not report your absence to your supervisor/manager, in breach of the Kepak Clonee absence policy.
2. That you already have 13 unauthorised absence days for the period of a year, in breach of the Kepak Clonee absence policy.
During the hearing, Luke Hade read out his statement and you were afforded the opportunity to question their statements and evidence.
During the hearings, you confirmed that you had not informed your supervisor about your absence and you were not intent to do that. Most of your absences weren’t for the medical causes, but for family or personal concerns. I asked you did you intend to continue, not to inform your supervisor when you do not attend work; you told me you would call. You also mentioned you would give your supervisor notice for days off, and that you have already notified him of your desire to have a day off next week.
Luke Hade stated that it was not the first instance that you did not inform him about your absence from work. Also, he stated that you had bad attendance and also you are frequently late to work. However, he mentioned that you have improved your communication to him, and also have been more punctual lately.
You did not call any witness at the appeal hearing despite the offer to do so.
In light of the serious nature of the allegations upheld against you, I informed you that I would take time to consider the appropriate disciplinary sanction and that we would meet you on same day to inform you of my decision. In coming to my decision on the disciplinary sanction, I had carefully considered all the evidence and information before me at the hearing and the serious nature of the allegations that I upheld. Should you continue to absent yourself from work on a regular basis, you may face further disciplinary actions, up to and including dismissal.
As you are previously on a final written warning stage, I advised you that the next stage in the disciplinary process was suspension without pay, and as such, you will be suspended without pay for two days from 25th of June 2015 till 26th of June 2015. You should report for work as normal on Monday 29th of June 2015. Also, you are being issued with a further final written warning to remain on your file for 24 months. Any further breaches of Company Rules may result in dismissal from your employment.
Should you wish to appeal this decision, please do so in writing to the Human Resources Department within five working days.

Rakstu Jums saistībā ar disciplinārlietas spriedumu, kas tika pasludināts trešdien, 2015. gada 24. jūnijā SIA "Kepak Clonee".
Jūs izvēlējāties neizmantot darbinieka pārstāvību. Jūs apstiprinājāt, ka jums nav nepieciešamības pēc tulkojuma nodrošināšanas. Pēcāk jūs arī apstiprinājāt, ka esat saņēmis visu informāciju un dokumentāciju, kas iekļauta jūsu disciplinārlietas materiālos, un ka visi dokumenti jums ir iztulkoti un jūs izprotat to saturu.
Kā jums ir zināms, man bija jālemj par šādām apsūdzībām:
1. Šī gada 18. maijā jūs neziņojāt par savu prombūtni savam priekšniekam/ vadītājam, pārkāpjot SIA "Kepak Clonee" prombūtnes noteikumus.
2. Jums jau ir 13 neattaisnoti kavētas dienas šajā gadā, tādējādi pārkāpjot SIA "Kepak Clonee" prombūtnes noteikumus.
Tiesas sēdes laikā, Lūks Haidess (Luke Hade) nolasīja savu paziņojumu, un jums tika dota iespēja iztaujāt viņu apgalvojumus un pierādījumus.
Tiesas sēdes laikā jūs apstiprinājāt, ka jūs neinformējāt savu priekšnieku par savu prombūtni, un jums nebija nodomu to darīt. Lielākā daļa no jūsu prombūtnes iemesliem nebija medicīniska cēloņa, bet ģimenes vai personīgo interešu. Es jautāju jums vai jūs plānojat turpināt neinformēt savu priekšnieku, kad jūs neieradīsieties darbā, jūs man atbildējāt, ka jūs zvanīsiet. Jūs arī pieminējāt, ka jūs ziņosiet savam priekšniekam par dienām, kad neieradīsieties darbā, un ka jūs jau esiet paziņojis viņam par vēlmi paņemt brīvu dienu nākamajā nedēļā.
Lūks Haidess (Luke Hade) norādīja, ka tas nebija pirmais gadījums, kad jūs neinformējāt viņu par savu neierašanos darbā. Tāpat viņš norādīja, ka jums bija slikta apmeklētība, kā arī jūs bieži sākat darbu novēloti. Tomēr viņš minēja, ka jums ir uzlabojusies komunikācija ar viņu, kā arī pēdējā laikā jūs esat bijis punktuālāks.
Jūs neuzaicinājāt nevienu liecinieku apelācijas tiesas laikā, neskatoties uz piedāvājumu to darīt.
Ņemot vērā pret jums vērsto apsūdzību nopietno raksturu, es informēju Jūs, ka man būs vajadzīgs laiks, lai apsvērtu atbilstošu disciplinārsodu, un ka mēs ar jums tiksimies tajā pašā dienā, kad tas būs pieņemts, lai informētu jūs par manu lēmumu. Lai pieņemtu savu lēmumu par disciplinārsodu, man bija rūpīgi jāapsver visi pierādījumi un informācija, kas tika sniegta tiesas sēdē un nopietnā rakstura apgalvojumiem, kuriem man ir jāpiekrīt. Ja jūs turpināsiet regulāri neierasties darbā, jums var rasties turpmāka disciplināratbildība, līdz ar to un ieskaitot atlaišanu no darba.
Tā kā jums jau ir izteikts pēdējais rakstiskais brīdinājums, es informēju, ka nākamais solis disciplinārajā procesā ir atstādināšana no darba bez samaksas, un ar tādu jūs tiksiet atstādināts no samaksas par divu dienu darbu no 2015. gada 25. jūnija līdz 2015. gada 26. jūnijam. 2015. gada 29. jūnijā jums jāziņo par darbu kā ierasts. Tāpat, jums tiek izsniegts tālākais pēdējais rakstiskais brīdinājums, kas ir spēkā uz 24 mēnešiem. Jebkādi turpmāki uzņēmuma noteikumu pārkāpumi var novest pie atlaišanas no sava darba.
