Source text - English The HITECH Act is designed to promote the widespread adoption and interoperability of health information technology. Subtitle D of title XIII, entitled “Privacy,” supports this goal by adopting amendments designed to strengthen the privacy and security protections for health information established by HIPAA. These provisions include extending the applicability of certain of the Privacy and Security Rules’ requirements to the business associates of covered entities; requiring that Health Information Exchange Organizations and similar organizations, as well as personal health record vendors that provide services to covered entities, shall be treated as business associates; requiring HIPAA covered entities and business associates to provide for notification of breaches of “unsecured protected health information”; establishing new limitations on the use and disclosure of protected health information for marketing and fundraising purposes; prohibiting the sale of protected health information; and expanding individuals’ rights to access their protected health information, and to obtain restrictions on certain disclosures of protected health information to health plans. In addition, subtitle D adopts provisions designed to strengthen and expand HIPAA’s enforcement provisions.

Source text - Swedish Begreppet direktåtkomst används i olika registerförfattningar utan att det finns någon egentlig legaldefinition av begreppets innebörd. Under 2011 tillsatte regeringen en utredning som antagit namnet Informationshanteringsutredningen, Ju 2011:11, med uppdrag att bl.a. analysera om det finns skäl att i registerför- fattningar upprätthålla en skillnad mellan direktåtkomst och andra former av elektroniskt utlämnande. Om utredaren anser att en åtskillnad även i fortsättningen bör upprätthållas, ska utredaren lämna förslag på vilka begrepp som bör användas och hur dessa bör definieras. Utredningen beräknas avsluta sitt arbete senast den 1 december 2014. I avsaknad av legaldefinition har vi anslutit oss till det synsätt som bl.a. kommit till uttryck i patientdatalagen (2008:355). Med direktåtkomst avser vi en särskild form av utlämnande av uppgifter där den som lämnar ut uppgifterna inte har kontroll över vilka uppgifter mottagaren tar del av eller när det sker och där mottag aren inte kan ändra eller påverka innehållet i det informations- system eller register som informationen lämnas ut ifrån. Vidare karaktäriseras direktåtkomsten av att den som lämnar ut uppgifter saknar möjlighet att i samband med utlämnandet, d.v.s. när upp- gifterna görs elektroniskt tillgängliga, göra en särskild sekretess prövning. Bestämmelser om direktåtkomst anses dock inte ha sekretessbrytande effekt i sig utan att de – om andra myndigheter eller enskilda ska kunna medges direktåtkomst till sekretessbelagda uppgifter – måste kombineras med särskilda sekretessbrytande regler.
Translation - English The term ’direct access’ is used in various register acts without any actual legal definition of what it refers to. In 2011, the Swedish Government appointed an investigation, which adopted the name Informationshanteringsutredningen (“Information processing investigation”), Ju 2011:11, with instructions to, among other things, analyze to what extent there are grounds for maintaining a distinction between direct access and other forms of disclosure. If the investigator finds that a distinction should continue to apply, then the investigator is to propose what terms should be used and how they should be defined. The investigation is expected to conclude its work no later than December 1, 2014. Lacking a legal definition, we have adopted the view that is expressed in patientdatalagen (2008:355) (“Patient Data Act”). We use the term ‘direct access’ to refer to a particular means of disclosure whereby the party making the disclosure has no control over what information the recipient will make use of or the timing of such use and where the recipient will not be able to modify or influence the content of the information system or register from which the disclosure is made. A further characteristic of ‘direct access’ is that the party making the disclosure is not in a position to make a separate assessment of confidentiality in connection with the disclosure, i.e. when the information is made available electronically. Provisions regulating direct access are however not considered to override privacy in and of themselves, but must be combined with special rules overriding privacy before information subject to privacy can be made available through direct access to other government agencies or members of the public.
