صادر بتاريخ 16/11/1999 (مدني)
المحكمة،
بعد الاطلاع على الأوراق وتلاوة تقرير التلخيص والمداولة.
حيث إن الطعن استوفى أوضاعه الشكلية.
وحيث إن الوقائع – على ما يبين من الحكم المطعون فيه وسائر الأوراق – تتحصل في أن المطعون ضدها أقامت الدعوى رقم 336/1992 مدني أبو ظبي طالبة الحكم بإلزام الشركة الطاعنة أن تدفع لها مبلغ 222 ألف درهم تعويضا عما لحقها من أضرار نتيجة عدم وفائها بما التزمت به قبلها بموجب عقد مقاولة من الباطن أبرم في 28/4/92 تعهدت فيه بتوريد وتركيب أعمال الألمنيوم في مبنى الكمبيوتر الجديد بدائرة المالية في أبو ظبي. وأقامت الشركة الطاعنة الدعوى رقم 440/1992 أبو ظبي طالبة فيها الحكم بإلزام المطعون ضدها أن تؤدي لها مبلغ 195 ألف درهم تعويضا عما حاق بها من أضرار بسبب إخلال الأخيرة بما التزمت به في عقد المقاولة المشار إليه. وبعد أن ضمت محكمة أول درجة الدعويين حكمت في الأولى بإلزام الطاعنة أن تدفع للمطعون ضدها مبلغ 121 ألف درهم في الثانية برفضها. استأنفت الطاعنة ومحكمة الإستئناف ندبت خبيرا وبعد إيداع التقرير ومناقشة الخصوم له قضت برفض الاستئناف وتأييد الحكم المستأنف. طعنت الطاعنة في هذا الحكم بطريق النقض بالطعن رقم 36/18ق. ع وفي 1/7/1996 نقضت محكمة النقض الحكم جزئيا فيما قضى به بخصوص الضرر المدعى به من المطعون ضدها وتقدير التعويض عنه والإحالة. ندبت محكمة الإحالة خبيرا هندسيا وبعد إيداع تقريره ومناقشة الخصوم له حكمت في 17/11/1997 برفض الاستئناف وتأييد الحكم المستأنف. طعنت الطاعنة في هذا الحكم بطريق النقض بالطعن المطروح.
وحيث إن الطعن أقيم على ثلاثة أسباب تنعى الطاعنة بالسببين الثاني والثالث منها على الحكم المطعون فيه القصور في التسبيب والإخلال بحق الدفاع، وفي بيان ذلك تقول: إن المطعون ضدها لم تقدم للخبير المندوب من قبلها عقد المقاولة من الباطن وأن المستند الذي قدمته عبارة عن عرض أسعار لا يرقى إلى مستوى العقد، وجاءت أسباب الحكم قاصرة بخصوص دفاعها المؤسس على اختلاف المواصفات في طلاء الألمنيوم بأنه باللون العادي وليس باللون المزدوج رغم اختلاف السعر البين بين الطلائين والتفت عن دفاعها إعادة المأمورية إلى خبير آخر ليفصل في هذه المسألة خاصة وأن الخبير ركن في ذلك إلى مجرد عدم اعتراض دائرة الأشغال دون أن يقوم بالمعاينة ثم ترك البت في هذه المسألة للمحكمة. وإذ لم يرد الحكم على دفاعها عما سلف وبخصوص اختلاف الأعمال بين عرض الطاعنة وعرض ورشة ... ولم يطلع على عقد الأخيرة فإنه يكون مستوجب النقض.
وحيث إن هذا النعي في محله، ذلك أنه من المقرر أنه إذا لزم في الدعوى الفصل في مسألة فنية تستوجب الاستعانة بأهل الخبرة كان على محكمة الموضوع الاستعانة بها. أما إذا رأت الفصل فيها دون خبرة فإنها تكون ملزمة ببيان الأسباب التي ارتكزت عليها في حكمها بشكل لا يخالف واقع الأوراق والأصول الفنية والمبادئ القانونية وبما يكفي لحمل قضائه.
Translation - English Objection for Cassation No. 7 of 20th JY

The Court,
Pursuant to the perusal of documents, reading of the summary report, and after deliberation.
Whereas the Objection for Cassation has fulfilled all its formal conditions.
Whereas, in the facts - as apparent in the contested judgment and the documents - the respondent filed the action No. 336/1992 civil, Abu Dhabi, requesting to impose upon the appellant company the payment of AED 222,000 as indemnification for appellant's default on the obligations set forth under the construction sub-contract concluded on 28/4/1992, whereby it undertook to supply and install the aluminium works in the new computer building in the Department of Finance, Abu Dhabi. The appellant company filed the action No. 440/1992 Abu Dhabi, requesting to impose upon the respondent the payment of AED 195.000 in compensation for the damage it incurred due to the respondent's breach of obligations under the said contract. After the court of first instance enjoindered the two actions, it ruled on the first action to impose upon the appellant the payment of AED 121.000 and, on the second action, to dismiss it. The appellant appealed against the judgment and the court of appeal delegated an expert. After the expert's report was presented and discussed by the litigants, the court of appeal dismissed the appeal and corroborated the appellate judgment. The appellant filed the appeal in cassation No. 18/36 JY. On 1/7/1996, the court of cassation reversed the judgment as to the part related to damage claimed by the respondent and estimation of the remedy, and referred the action. The referral court delegated an engineering expert. After the expert's report was presented discussed by the opponents, the court ruled on 17/11/1997 ruled to dismiss the appeal and corroborate the appellate judgment. The appellant appealed in cassation against this judgment.
Whereas the cassation is based on three grounds whereby the appellant claims, in the second and third grounds, the contested judgment lacked substantiation and breached the right of defence. Since the respondent did not provide the engineering expert with the construction sub-contract and the document provided was just a quotation. The grounds of judgment were insufficient in respect to its defence based on the difference of specifications in painting the aluminium which are in the normal not double colour in spite of the clear difference of prices between the two paints.The judgment pushed aside the appellant's request to delegate an expert to decide on the matter, especially that the expert relied to the objection of the department of works without carrying out the inspection and left the matter to the court. Whereas the judgment did not reply to the appellant regarding the above-mentioned and in relation to the difference of works between the quotation of appellant and that of ...... workshop and did not review the latter's contract. The contested judgment therefore necessitates its cassation.
Whereas this cassation is valid, since it is stipulated that if there is a technical matter in action that requires experts, the trial court shall ask their assistance. If the court finds it appropriate to decide on the same without experts, it shall make clear the grounds to which it relied to the extent not violating the fact on the documents, technical principles and legal norms in a sufficient manner..

Translation - English The Second Party represents and warrants that all claims contained in the letters served upon the First Party in relation to the claim, subject matter of the Settlement, are confined to the amount mentioned in Clause II hereinabove, which was paid by the First Party under cheque No. ........................... with the amount of AED 5,200,000 payable on ..................., and dawn upon ................. Bank. The Second Party acknowledges that this Agreement is a comprehensive and final Settlement for all its rights and whereby the Second Party waives all claims mentioned in the letters served upon the First Party. The Second Party undertakes that it will never proceed any legal action against the First Party; and the Second Party may not sue or claim the First Party or Dubai Land company, as the Master Developer of the Project where the financed real estate units are located, for any rights of any kind or value arising out of the claim subject matter of the Settlement or any other agreements or documents issued in this regard with the mutual agreement of both parties. The Current State of Learning
The benefits of education — to national development, individual prosperity, health and social stability — are well known, but these benefits are significantly greater when the children who go to school are actually learning. Despite commitments and progress in improving access to education at the global level (i.e., Education For All [EFA] Goals and Millennium Development Goal [MDG] 2), learning levels are still low. According to the 2012 EFA Global Monitoring Report, at least 250 million primary-school-age children around the world are not able to read, write or count well, even for those who have spent at least four years in school.
