12. The Deputy Registrar then proceeded to state his opinion regarding the application of surplus income in the jurisdiction in which he presides. He noted that bankrupts should (1) default in payment of their surplus income obligation, (2) ‘forget’ about mandatory mediation, and (3) force the matter on to court, where he claimed that he would ignore the law and likely waive any surplus income obligations.
