Source text - English 4.2. Use of covert investigator and informant
This SIM – covert investigator and informant - is frequently used and has proved very successful in proving that the defendant committed the crime. Namely, the application of this measure requires specially trained OSL – covert investigators. During the investigation phase, upon prosecutor's request for application of this special investigative measure, the court should issue an order in which the covert investigator is given a code name. In the course of application of the special investigative measure, the covert investigator who acts on basis of the court order, is obliged to write an official note after each applied measure and all contacts or telephone conversations with the suspect, and sign it with his/her code name. After the completion of this special investigative measure, the covert investigator is obliged to draft a report that refers to his overall action and submits it to the court.

Оваа посебна истражна мерка – прикриен инспектор и соработник на правдата - често се користи и се покажа многу успешна во докажување дека обвинетиот го сторил кривичното дело. Имено, примената на оваа мерка бара специјално обучени овластени службени лица – прикриени инспектори. Во текот на фазата на истрагата, по барање на обвинителот за примена на оваа посебна истражна мерка, судот треба да издаде наредба со која на прикриениот инспектор му е дадено шифрирано име. Во текот на примената на посебната истражна мерка, прикриениот инспектор, кој делува по судски налог, по секоја применета мерка и по секој остварен контакт или телефонски разговор со осомничениот, е должен да состави службена забелешка, и да ја потпише со неговото шифрирано име. По завршувањето на оваа посебна истражна мерка, прикриениот инспектор е должен да подготви извештај за целото негово делување и да го достави до судот.

6. The status of international law within a municipal legal system is generally
determined by municipal law. Consequently, different rules apply in different
jurisdictions. Where the monist theory is followed, international law and municipal
law on the same subject operate concurrently and, in the event of a conflict, the
former prevails. Where the dualist theory is favoured, international law and
municipal law are regarded as two separate systems of law, regulating different
subject matter. They are mutually exclusive, and the former has no effect on the
latter unless and until incorporation takes place through domestic legislation. One
reason for this view is because the making of a treaty is an executive act, while the
performance of its obligations, if they entail alteration of the existing domestic law,
requires legislative action. However, in many of those States in which the dualist
theory is preferred, the recognition and observance of fundamental human rights and
freedoms is nevertheless now generally accepted as obligatory, or certainly as
influential in the ascertainment and expression of domestic law.

6. Статусот на меѓународен закон во рамките на општинскиот правен систем вообичаено се утврдува од страна на општинскиот закон. Како резултат на тоа, различни надлежности применуваат различни правила. Таму каде што се следи монистичката теорија, меѓународниот закон и општинскиот закон делуваат на истиот предмет истовремено и, во случај на конфликт, преовладува меѓународниот закон. Таму каде што е фаворизирана дуалистичката теорија, меѓународниот закон и општинскиот закон се сметаат за два посебни системи на правото, регулираат различни предмети. Тие меѓусебно се исклучуваат, и првиот нема ефект врз вториот доколку, и се додека, преку домашното законодавство не се инкорпорираат. Една од причините за ова гледиште е тоа што склучувањето на договор е извршен чин, додека извршувањето на обврските, ако тие повлекуваат промена на постојното домашното право, бара законодавна мерка. Меѓутоа, во многу од оние држави во кои дуалистичката теорија е преферирана, признавањето и почитувањето на основните човекови права и слободи е сепак прифатено како задолжително, или има големо влијание во осмислувањето и изразувањето на домашното право.
