Le modifiche delle convenzioni matrimoniali, anteriori o successive al matrimonio, non hanno
effetto se l'atto pubblico non è stipulato col consenso di tutte le persone che sono state parti nelle
convenzioni medesime, o dei loro eredi. Se uno dei coniugi muore dopo aver consentito con atto pubblico alla modifica delle convenzioni, questa produce i suoi effetti se le altre parti esprimono anche successivamente il loro consenso, salva l'omologazione del giudice. L'omologazione può essere chiesta da tutte le persone che hanno partecipato alla modificazione delle convenzioni o dai loro eredi. Le modifiche convenute e la sentenza di omologazione hanno effetto rispetto ai terzi solo se ne è fatta annotazione in margine all'atto del matrimonio.L'annotazione deve inoltre essere fatta a margine della trascrizione delle convenzioni matrimoniali
ove questa sia richiesta a norma degli artt. 2643 e seguenti.

تعديل الاتفاقات
لا يكون لتعديل الاتفاقيات الزوجية, السابقة او اللاحقة علي الزواج ثمة أثر, ان لم يكن السند العمومي قد انعقد بموافقة كل الاشخاص الذين يعتبرن اطرافا في الاتفاقات الزوجية, او من ورثتهم. وإذا مات احد الزوجين بعد الموافقة في سند عام علي تعديل الاتفاقات, فيرتب هذا آثاره إذا عبرت الاطراف الأخري كذلك لاحقا عن موافقتها, فيما عدا حالة موافقة القاضي, ويجوز طلب الموافقة من قبل كل الاشخاص الذين اشتركوا في تعديل الاتفاقيات او من ورثتهم. ولا يكون للتعديلات المتفق عليها وللموافقة ثمة أثر في مواجهة الغير الا إذا تم التأشير بها علي حاشية سند الزواج. ويتعين علاوة علي ذلك التأشير علي حاشية تسجيل الاتفاقات الزوجية في حالة المطالبة بذلك بموجب ما هو منصوص عليه في المادة 2643 وما يليها.

Source text - Spanish Artículo 21. Autorización de Registro.- Una vez cumplidos los requisitos
establecidos en el artículo anterior, el Consejo Directivo de la CONAMI deberá

pronunciarse sobre dicha solicitud en un plazo no mayor de treinta (30) días
hábiles.
Aprobada la solicitud, el Presidente Ejecutivo procederá a la inscripción de la IFIM
respectiva, en el Libro de Registro que se llevará para tal efecto, y notificará de la
resolución a la institución interesada dentro de los cinco (5) días hábiles
subsiguientes a la fecha de autorización. La autorización de registro deberá
publicarse en "La Gaceta", Diario Oficial, por cuenta de la IFIM autorizada.
En caso que las IFIM no llenen los requisitos, la CONAMI comunicará a los
peticionarios las faltas que notare para que llenen los requisitos omitidos. Una vez
subsanadas las faltas, otorgará la autorización solicitada, dentro de un término de
quince (15) días hábiles contados a partir de la fecha de subsanación.

بمجرد استيفاء المتطلبات المقررة في المادة السابقة, يتعين علي مجلس ادارة اللجنة الوطنية للتمويل متناهي الصغر أن يرد علي الطلب المذكور خلال أجل لا يتجاوز ثلاثين يوم عمل. و بمجرد إجازة الطلب, يقوم الرئيس التنفيذي بإجراء القيد لمؤسسة الوساطة في التمويل متناهي الصغر ذات الصلة, في دفتر السجل الذي ينشأ لهذا الغرض, و يُخْطِر المؤسسة المعنية بالقرار خلال خمسة ايام عمل لاحقة علي تاريخ الترخيص. و يتعين نشر الترخيص بالسجل في " الجريدة " , الجريدة الرسمية, علي حساب مؤسسة الوساطة في التمويل متناهي الصغر التي تم الترخيص لها. و في حالة عدم استيفاء مؤسسة الوساطة في التمويل متناهي الصغر للمتطلبات, تبلغ اللجنة الوطنية للتمويل متناهي الصغر, الطالبين بالأخطاء لاستكمال المتطلبات التي اُغْفِلَت. و بمجرد تصحيح الأخطاء, تمنح الترخيص المطلوب, خلال أجل قدره خمسة عشر يوم عمل يُحتسب اعتبارا من تاريخ التصحيح.

PRINCIPLES OF PARTS II AND III
1. The court and any person, in exercising functions under or in
consequence of Parts II and III, shall have regard to the following general
principles—
(a)

that the institution of marriage is to be supported;
that the parties to a marriage which may have broken down are
to be encouraged to take all practicable steps, whether by
marriage counselling or otherwise, to save the marriage;
(c) that a marriage which has irretrievably broken down and is being
brought to an end should be brought to an end—
(i) with minimum distress to the parties and to the children
affected;
(ii) with questions dealt with in a manner designed to
promote as good a continuing relationship between the
parties and any children affected as is possible in the
circumstances; and

1- تراعي المحكمة أو أي شخص, اثناء مزاولتها لمهامها المنصوص عليها في القسمين الثاني والثالث أو بموجبهما, المباديء العامّة التالية :
أ- أن يكون ابرام الزواج ثابتاً ;
ب- أن يكون قد تم تشجيع طرفي الزواج الذي قد يكون انحل على اتخاذ كل الخطوات العملية, سواء عن طريق استشارات الزواج أو غير ذلك, لانقاذ الزواج ;
ت- أن يكون الزواج الذي انحل بشكل غير قابل للرجوع فيه وجاري انهاؤه قد تم انهاؤه فعلياً ;
1. بأقل مشقة للطرفين والأطفال المعنيين ;
2. بتناول المسائل بطريقة تقود لاستمرار العلاقة بين الطرفين والاطفال المعنيين بصورة حسنة بقدر ما تسمح الظروف ; و
3. دون تكبد تكلفة بصورة غير منصفة فيما يتصل بالاجراءات الواجب اتباعها لانهاء الزواج ; و
ث- أن تتم إزالة أو إنقاص أي مخاطر عنف من احد الطرفين على أحد طرفي الزواج, و أي من الأطفال, بقدر ما يكون ذلك معقولاً.

louisianais, ainsi que l'a très fortement montré M. le Conseiller Barham. Le juge français typique accomplit dans la magistrature l'ensemble de sa vie professionnelle. Très jeune encore, au sortir de la Faculté, il se présente au concours de l'Ecole nationale de la magistrature. S'il réussit à ce concours, il accomplit, à l'Ecole ou sous la direction de celle-ci, deux années d'études théoriques et pratiques et de stages. Il peut alors devenir juge à un tribunal de première instance — il n'a peut-être que vingt-cinq ans. Il espère accéder par la suite à une cour d'appel (il y en a trente et une), puis à la Cour de cassation. Celle-ci, après diverses réformes, est actuellement composée de six chambres : trois chambres civiles, une chambre commerciale, une chambre sociale, une chambre pénale. Elle réunit plus de cent magistrats, au sommet de leur carrière. On notera à côté d'eux la présence de vingt conseillers référendaires. Ce sont des magistrats plus jeunes que les autres, mais qui se sont déjà distingués par leur valeur ; ils sont nommés pour préparer les affaires qui leur sont
confiées et siéger avec voix consultative dans la chambre à laquelle ils sont affectés.
Translation - Arabic ويختلف القاضي الفرنسي النموذجي عن القاضي الأمريكي, ولو كان من لويزيانا, كما اظهر هذا بوضوح, السيد المستشار بارهام. فالقاضي الفرنسي النموذجي يكمل في القضاء مجموع حياته العملية. فهو عند تخرجه في سن صغيرة جدا من الكلية, يتقدم لمسابقة المدرسة الوطنية للقضاء , وإذا نجح في هذه المسابقة, فإنه يكمل سنتين من الدراسة النظرية والعملية والتحضيرية في المدرسة أو تحت إشرافها. وبوسعه حينئذ أن يصبح قاضياً في محكمة الدرجة الأولى – وهو في عمر ربما لا يزيد عن 25 سنة. ثم يأمل في أعقاب ذلك أن يلتحق بمحكمة استئناف ( هناك 31 محكمة استئناف في فرنسا ), ثم بمحكمة النقض. وهذه الأخيرة بعد اصلاحات مختلفة, تتكون فعلياً من ست دوائر : ثلاث دوائر مدنية, ودائرة تجارية, ودائرة اجتماعية ودائرة جنائية. وهي تضم أكثر من مائة قاض, في ذروة مسيرتهم المهنية. وسيلاحظ المرء بجانبهم, وجود عشرين مستشارً وهؤلاء قضاة أكثر شباباً من الآخرين ولكنهم يتميزون بقيمتهم ; فيُرشحون لاعداد القضايا التي يُعهد بها إليهم ويكون لهم رأي استشاري في الدائرة التي يكونون اعضاء بها.
