Affirmation document for that the bidder is not prohibited from bidding in tenders Explanation: I don't know if it can be worded any shorter, but this is what it means Reference: http://www.tasinirmal.net/soru-cevap/60-ihale-surecinde-yasa... https://ekap.kik.gov.tr/EKAP/Yasaklilik/YasakliSorgu.aspx |

Certificate of non-disqualification Explanation: On the face of it, this is an odd term because it sounds as though the bidder has to provide certification showing that they are barred from bidding, which would be an odd thing to do, because they might as well not bid at all if this is the case. However, from the following explanations: "18) İhale üzerinde kalan isteklinin ve varsa ekonomik açıdan en avantajlı ikinci teklifsahibinin, 4734 sayılı Kanun’un 58’inci maddesine göre yasaklı olup olmadığına dair Kamu İhale Kurumundan alınan teyit belgeleri." https://kms.kaysis.gov.tr/Home/Goster/60455?AspxAutoDetectCo... "6. İmzalanmış olan sözleşme ve sözleşme imzalandığı tarihte yasaklı olmadığına ilişkin yasaklı teyit belgesi," http://bekad.org/imgs/files/Güncel Mali Sorunlar -2.pdf page 67 this is actually a document showing whether or not the bidder is barred, and presumably if it showed the former, the bidder would not bother bidding! 'Certificate of non-disqualification' is really my own invented term, although you can find it used on page 00300-10 here: http://www.st-charles.il.us/sites/default/files/bids-proposa... -------------------------------------------------- Note added at 54 mins (2017-03-02 06:55:42 GMT) -------------------------------------------------- You will find 'certificate of qualification' used in the following tender rules: http://www.melsenpower.com/index.php?case=archive&act=show&a... |

Anti-corruption commitment / Compliance commitment Explanation: I work for a Contracting energy company. I will not disclose its name) In our company we have requested from our Subcontractors exactly the same compliance document requiring refraining from any illegal actions and undertakings, including corruption. -------------------------------------------------- Note added at 2 hrs (2017-03-02 08:50:44 GMT) -------------------------------------------------- Yes, dear Harold. I agree with your comment. Legal Compliance Commitment (adding Document or without it, does not matter much) will suit perfectly. |
