Otra **servidumbre de uso y disfrute** de una franja de la zona ajardinada en desnivel de la finca de la Sra. XY, delimitada de la forma siguiente: Norte, en línea de 2,30 metros, con la parcela número 57; Este, en línea recta de aproximadamente 20 metros, con la finca del -Sr. X; Sur, en línea oblicua de unos 3,13 metros, con la parcela 59, y Oeste, en línea quebrada de tres tramos, el primero de uso 11 metros, el segunde de 85 centímetros, y el tercero de 9 metros, con las dos servidumbres anteriormente establecidas y con la finca de la Sra. XY. Esta servidumbre se establece para el **uso y disfrute**, como zona ajardinada, del propietario del predio dominante, hoy del Sr. X, quien se obliga a no realizar en ella ningún tipo de construcción, plantaciones o reformas sin el expreso consentimiento del propietario del predio sirviente, sien además de cuenta de aquél todos los gastos de conservación y limpieza quepor el **uso y disfrute de la servidumbre** se pudieran ocasionar.
