agree  Laura Friend: I can't be sure of it, either -- Translator174 makes a good point -- but it seems to me the bank would verify the actual existence of the property once, and later, periodically, check on its condition.

  -> Thanks! Maybe I’m just being cynical, but I can see why a creditor (especially if it is a bank which holds thousands of properties as security) or even their advisors (auditors etc.) may want to confirm a property's existence more than once!

по-моему переводить дословно "фактическое наличие" не стоит, уж больно это странно звучит: "поеду, посмотрю, стоит ли мой дом на месте!" Если квартира не сгорела, то она там и находится.
Во всяком случае ни в одном контракте я такого не встречала. но опять же - имхо.
