4. Considerando que essa cláusula de fornecimento de peças é de conhecimento da YYY, essa empresa não deveria ter descontinuado totalmente a produção das peças do XXX. A L3Harris deveria manter uma produção, ainda que mínima, das peças para possibilitar a aquisição destas pelo Exército Brasileiro durante o período de 10 anos após a última aquisição, conforme previsto em contrato.
5. Diante da insistência da empresa YYY em não cumprir a cláusula contratual com a informação de que foi descontinuada a produção das peças do XXX, este CCOMGEX tem a obrigação de acionar a empresa para que apresentem uma solução alternativa para este caso.
6. Ressalto que este Comando entende que esse tipo de problema não deve se repetir. Portanto, recomenda-se que a YYY cumpra esta cláusula de fornecimento para todos os contratos de equipamentos que essa empresa tenha com o Exército Brasileiro.
