Explanation:
A patent examiner (or, historically, a patent clerk[1]) is an employee, usually a civil servant with a scientific or engineering background, working at a patent office. Major employers of patent examiners are the European Patent Office (EPO), the United States Patent and Trademark Office (USPTO), the Japan Patent Office (JPO), and other patent offices around the world.

Duties[edit]
Patent examiners review patent applications to determine whether the invention(s) claimed in each of them should be granted a patent or whether the application should instead be refused. One of the most important tasks of a patent examiner is to review the disclosure in the application and to compare it to the prior art. This involves reading and understanding a patent application, searching the prior art (including prior patent applications and patents, scientific literature databases, etc.) to determine what contribution the invention makes over the prior art, and issuing office actions to explain to the applicants and their representatives (i.e., patent attorneys or agents) any objections that may exist against the grant of a patent. In other words, an examiner reviews a patent application substantively to determine whether it complies with the legal requirements for granting of a patent.

Podstawowym zadaniem Urzędu Patentowego jest orzekanie w sprawach dotyczących udzielania praw wyłącznych na przedmioty własności przemysłowej (wynalazki, wzory użytkowe, wzory przemysłowe i znaki towarowe). Zadania te realizowane są przez korpus ekspercki, grupę specjalistów wysokiej klasy ze wszystkich dziedzin techniki.

Uzyskanie uprawnień eksperta wymaga posiadania wyższego wykształcenia odpowiadającego zadaniom eksperta, znajomości języków obcych i odbycia aplikacji eksperckiej. Aplikacja trwa 3 lata, z tym, że w uzasadnionych przypadkach na wniosek aplikanta eksperckiego może być skrócona do 1 roku i 6 miesięcy. Stosunek pracy aplikanta eksperckiego nawiązuje Prezes Urzędu Patentowego na podstawie umowy o pracę na czas określony. Aplikacja, w trakcie której aplikant uzyskuje potrzebną wiedzę i umiejętność samodzielnej pracy polega na wykonywaniu przez kandydata na eksperta, czynności pod kierunkiem przydzielonego opiekuna aplikacji. Aplikacja kończy się egzaminem, który przeprowadza komisja egzaminacyjna powołana przez Prezesa Urzędu Patentowego. Po złożeniu egzaminu pracownikowi powierza się wykonywanie zadań w charakterze asesora przez okres nie krótszy niż 2 lata. W przypadku pozytywnej oceny przebiegu asesury, asesor uzyskuje uprawnienia eksperta. Wysokość wynagrodzenia ekspertów, asesorów i aplikantów eksperckich określona jest w drodze rozporządzenia Prezesa Rady Ministrów z dnia 3 listopada 2004 r. (Dz. U. Nr 240, poz. 2411; z 2009 r.
