The whole phrase is 同条約二五条に上り有限責任に関する規定の適用が排除される結果 but I'm having trouble understanding the phrase above に上る。I'm guessing that its like による but am not 100% sure. Thank you in advance.

I read 上り as より because of the position it occupies, and didn't even realise it was unusual until I read the detail of your question. I wouldn't be bothered with the strange usage of the kanji.

I think it's just a typo. The original document must have been created decades ago, when someone made a handwritten draft and his/her secretary mistakenly read よas 上 when typing it. Since then, nobody seems to have noticed the error.

Asker: Thank you! I know 「よる」has many different Kanji combinations but wasn't aware 上る.
