Bei Pfändung oder sonstigen Eingriffen Dritter ist X unverzüglich schriftlich zu benachrichtigen.
X hat das Recht aber nicht die Pflicht, Klage gem. § 771 ZPO zu erheben. Die Pflicht entsteht nur, wenn der Käufer die Klage bei eigenem Prozesskostenrisiko des Käufers vorfinanziert.

Der letzte Satz scheint mir etwas kompliziert. Es steht 2-Mal Käufer geschrieben, vielleicht ist eins davon falsch und müsste der Dienstleister heissen. Oder was soll dieser Satz genau bedeuten? Hat jemand eine Idee? Danke im Voraus

Obwohl es 2-Mal Käufer geschrieben wird, ist eins davon nicht falsch.

What they want to say is - "X is under obligation to file a lawsuit only if the buyer has already financed it in his litigation costs."
