Dette quérable
A teneur de l'art. 271 al. 1 aCO, à la fin du bail, le preneur restitue la chose louée dans l'état où il l'a reçue et conformément à l'usage local. Il s'agit d'une dette quérable, ce qui signifie que, sauf convention spéciale, la chose doit être restituée au lieu où elle se trouvait lors de la conclusion du contrat (art. 74 al. 2 ch. 2 CO; ATF 48 II 390). S'agissant d'une dette quérable, l'offre purement verbale de restituer suffit à entraîner la demeure du créancier (WEBER, n. 126 ad art. 91 CO; cf. ENGEL, Traité des obligations en droit suisse, p. 446, let. B in fine, qui est d'avis que le créancier est en demeure, même en l'absence d'une offre, si la dette est quérable, à l'expiration du contrat).

Le débiteur doit offrir d'accomplir sa prestation. En principe, son offre doit être réelle. Il en va ainsi pour une dette portable: le débiteur doit avoir amené la chose au lieu de l'exécution.
