Die Argumente der Arbeitsgruppe zum umfassenden Schutz des Prinzips der uneingeschränkten Verantwortlichkeit der Athleten/innen („Strict liability“), des unverzichtbaren Eckpfeilers des Anti-Doping-Kampfes, sind überzeugend. Die Sanktionierung eines durch positiven Dopingtest überführten Athleten soll weiterhin allein durch die Sportgerichtsbarkeit erfolgen, da nur so eine schnelle, harte und international sofort durchsetzbare Bestrafung möglich ist. Wird der Athlet durch staatliche Maßnahmen der Weitergabe von oder des Handels mit Dopingmitteln überführt, unterliegt er schon jetzt den für alle Bürger geltenden gesetzlichen Bestimmungen des Arzneimittelgesetzes.
