agree  AllegroTrans: not sure about your wording but it does sound like some form of caveat// OK but let's not worry too much about E&W (or even Essex) procedure - the crux is to arrive at a descriptive and intelligible term

  -> Thx. Problem is, as mentioned, a caveat is entered at the Probate Registry vs. a caution entered at the Land Reg.. This is def. the latter//'Notice of a strict settlement (trust)' roughly fits the Anglocentric bill.

Das ZGB zwingt die Gesamtheit der Erben indirekt, dennoch ihren gemeinschaftlichen Rechtserwerb ins Grundbuch einzutragen, dann nämlich, wenn diese die Liegenschaft an einen konkreten Erben kraft Erbteilung, an den Vermächtnisnehmer aufgrund eines Legates oder an einen Dritten durch anderweitiges Rechtsgeschäft (z.B. Verkauf, Schenkung) übertragen möchten. Dieser sog. Erbfolgevormerk, also die grundbuchliche Eintragung, wonach die Liegenschaft allen Erben zu Gesamteigentum zusteht, wird erreicht, indem man von der zuständigen Behörde (Kanton Zürich: Einzelrichter in Erbschaftssachen) die Ausstellung einer Erbbescheinigung verlangt und diese dem Grundbuchamt einreicht.
