Die KESt-Freistellung gem. § 94 Z 5 EStG 1988 für Kapitalerträge die zu den Betriebseinnahmen natürlicher Personen (Einzelunternehmen, ARGE's (GesBR), Personenhandelsgesellschaften (insbesonders OHG, KG, GesmbH & Co. KG), eingetragene Erwerbsgesellschaften (insbesondere OEG, KEG, GesmbH & Co. KEG) gehören, ist nicht zulässig, es besteht KESt-Pflicht und **Steuerabgeltung**.

I got now hold of a dictionary: instead of payment, settlement is better (and then you don\'t necessary need deduction or withholding).
