German term or phrase: advokatorische Vorsicht
Ein Schriftsatz in einem Gerichtsverfahren, in dem es (auch) um gewisse Fehler geht, von denen der Beklagte naturgemäß keine Kenntnis haben KANN. Hier der ganze Satz:

Die vom Kläger behaupteten Fehler werden daher vom Beklagten aus *advokatorischer Vorsicht* bis auf weiteres bestritten.

My attempt, so far:
Thus, for reasons of *lawyerly precaution* Defendant contests for the teime being the errors alleged by Plaintiff.

Since *advocatory* means *beteiligend*, I think it is a false friend. On the other hand, an *Advokat* is a *lawyer* and *lawyerly precaution* would be *anwaltliche Vorsicht*, which is what I understand the term in question to mean. But, I might be wrong?
Many thanks in advance for your help!

denied ....in erring on the side of legal professional caution
Explanation:
Methinks this is a practical professional indemnity point, lest a charge of negligence 'in the course of un/skilled advocacy' is brought.

I have hunch that the source text is Austrian (Advokat is an old word for a rechtsanwalt/wältin) so *lawyerly precaution* would certainly fit the bill.

Also note the diffrerence between a general and specific 'traverse' in EN pleadings.

out of an abundance of caution

Explanation:
Nur eine Floskel?

Von der "umseits rubrizierten Rechtssache" über die "fristgerecht erhobene" Berufung bis zum "lediglich aus advokatorischer Vorsicht" erhobenen Einwand. Wir haben uns dann selbst bei genug Füllwörtern in unseren Elaboraten "ertappt".

The phrase, "out of an abundance of caution,” is often used when explaining an action that isn’t necessary, but is going to be done anyway because you want to be extra careful

Example sentence(s):
  • Auch hier seien die einzelnen Straferkenntnisse nicht konkret angesprochen worden, obwohl dies die advokatorische Vorsicht geboten hätte.
  • GENERAL TRAVERSE, pleading. One preceded by a general inducement, and denying, in general terms, all that is last before alleged on the opposite side, instead of pursuing the words of the allegations, which it denies.

lawyerly prudence

Explanation:
Citing lawyerly prudence, the defendant has, at this point, denied the errors alleged by the plaintiff.
