Bei der vom Gericht angeordneten Geschäftsaufsicht geht die wesentliche Aufsichtskompetenz auf die (gerichtlich bestellte) Aufsichtsperson über bzw. können bestimmte Aufsichtsinstrumentarien nicht mehr eingesetzt werden. Die Geschäftsaufsicht stellt das Kreditinstitut in den "Schutz" vor den Gläubigern, insoweit sind alle Gläubigerforderungen gestundet und es liegt ein Fall des Tätigwerdens der Einlagensicherung vor. Ziel ist es, der Bank Zeit für eine Reorganisation und Sanierung zu geben und die Überschuldung oder Illiquidität zu beheben. 2. .
