non-contentious legal proceedings Explanation: The matter before the court is governed by the rules on non-contentious legal proceedings. I personally would not use "alternative dispute resolution" here, as to English ears, this suggests mediation / arbitration or some other form of non-judicial process. As far as I can tell, the Austrian Außerstreitverfahren is a form of judicial proceedings subject, however, to procedural rules which are different to those which apply in general civil law cases. ADR Alternative Dispute Resolution Explanation: ist der zumindest in Österreich bekannte Terminus für Außerstreitverfahren / Außerstreitsache -------------------------------------------------- Note added at 3 Stunden (2011-09-07 07:33:04 GMT) -------------------------------------------------- aber auch in Deutschland ist er bekannt: ADR – Verfahren „Alternative (außergerichtliche) Streitbeilegung“ - „alternative dispute resolution“ Alternative Dispute Resolution (ADR) bezeichnet zum staatlichen Gerichtsverfahren alternative Streitbeilegungsmethoden. Es sind dies strukturierte Streitbeilegungsmethoden, bei denen mit Hilfe eines Dritten, am Konflikt unbeteiligten, ein Ergebnis gefunden wird, welches den wirtschaftlichen und persönlichen Bedürfnissen der Streitparteien möglichst nahe kommt.
