Excuse my highly unregarded and non-bog standard ignorance, but I've never come across an 'uncertificated' mortgage or land charge in UK conveyancing practice or US practise, but I can distinctly recall having creating an NB registrable, equitable charge by deposit of title deeds only.....

neutral  AllegroTrans: I think it's dangerous to use "equitable" to translate a German, and hence civil law, term, even this is a near equivalent; something "common law-free" is needed imho
