According to the German that does not spell out allein und ausschließlich, the patentee is the sole - but not necessarily the exclusive - owner. What scenario does that cover? For instance, if he has agreed with the licensee to assign the latter the patent on expiry.

Asker: Thank you, that looks really good. The person in question IS the owner of the patent for something he has invented, and giving a license to use it to someone else but keeping some control. Would that mean that "exclusive" fits here or not? (Sorry if I am slow to understand this.)

  -> Perhaps then you, no doubt carrying professional indemnity insurance, can explain why a US American Attorney-at-Law objected to 'exclusive dealership' for Alleinvertriebsrecht and insisted it was a sole distributorship.
