disagree  Eliza Hall: Why are you talking about what the court does? The "recourant" is the applicant/petitioner/etc. Also, see reference re what a "question juridique de principe" is.

  -> Different terminology would be used if it were the court as the subject and for the asker's - not your - guidance. Also I had been translating Encyclopedia of Int'l Law articles about Bulgarian law in the early 1970s, so have an idea of a possible mix-up.

neutral  Eliza Hall: Once we grapple w/ "question juridique de principe" (see reference), your title will need tweaking. The full sentence you give is not correct ("as a matter of principle" is wrong, and "en vertu" probably means "under"/"in accordance with."
