Registration ( of the marriage line) is equal to (its) documentation/document Explanation: در ذهن کاملاً قابل تفکیک است سه مفهوم «عقد»«سند»و«ثبت»یعنی ممکن است عقد بیع بصورت شفاهی محقق شود بدون سند و دلیل کتبی برای اثبات آن و نیز ممکن است عقد بیع همراه با تنظیم سند عادی واقع گردد،در این صورت با وجود آنکه طرفین قانوناً،طبق ماده۴۶ قانون ثبت باید سند عادی مزبور را اجباراً ثبت ناید،ولی از انجام این الزام قانونی ناشی از قرارداد امتناع نمایند،لذا عقد غیر از سند و ثبت غیر از عقد و سند می باشد. |
