Yenilik, başvuru yapılmadan önce başkaları tarafından yazılı, sözlü ya da uygulanarak açıklanmamış olmak anlamında mutlak yeniliktir. Tekniğin bilinen durumunun aşılması kriteri ise "konuda uzman bir kişinin kolayca düşünüp uygulamaya koyamayacağı" nitelik anlamındadır.
