By signing this Agreement, each Parent and the Senior Agent (for and on behalf of all Senior Lenders) agree that none of the Custodian, the Security Agent or any other Senior Finance Party shall be regarded as an Investor or a Sponsor Affiliate (as such terms are defined in the Senior Facilities Agreement) solely by virtue of the Custodian subscribing for and holding Subordinated Creditor A Shares and Parent A Shares and acting in accordance with this Agreement, the other Holdco Documents and the Custodian Documents
