Appeals against first-instance rulings are decided by a competent second-instance court.
The one exception to this is any case handled by the Special Departments for Organized Crime and War Crimes of the Higher Court in Belgrade, which will be in the jurisdiction of the Special Departments for Organized Crime and War Crimes at the Appellate Court in Belgrade.

The second-instant court decides in a panel made up of three judges, where the reporting judge is also the president of the panel.
