特に institution って何でしょう？　まさか刑務所のような場所を意味しているのでしょうか？

例えば、逮捕された後、拘置所に半年入っていた時に２年の実刑判決が出たとすると、その半年を差し引いて残りの1年半だけ刑務所に入れば良い場合もありますが、上の場合は、拘置所に入れられていた期間は刑務所で服役する期間に算入されないと言っていると思います。（なお、あまり一般的な言葉ではありませんが、拘置所は刑務所と同様、「刑事施設」のひとつです。）
