Tratto da un affidavit:

Mr XXX takes issue at paragraph 6 with the statement in Ms YYY’s First Affidavit that there was never any suggestion in the EW Proceedings of *common design* being heard together with patent issues.

For clarification, I say that how the *common design issues* came to be stayed in the EW Proceedings was that the Judge indicated at the outset of the directions hearing that he was minded to stay the *common design*/joint tortfeasance issue in accordance with the UK Defendants’ proposal made before the hearing.
