Distinzioni tra servitù

La prima distinzione fondamentale tra le servitù è quella tra servitù volontarie e servitù coattive: il criterio della distinzione è evidentemente quello della loro fonte, ovverosia del modo in cui possono nascere e anche vivere.
Le servitù volontarie sono quelle che nascono in virtù di un atto dell’uomo, e quindi per volontà dei proprietari del fondo dominante e del fondo servente (mediante contratto) o per usucapione.
Le servitù coattive invece nascono perché è la legge stessa a prevedere e imporre la loro costituzione: si vedranno meglio nel prosieguo le particolarità di questa categoria di servitù, ma preme sin da ora sottolineare che non è direttamente la legge a dire che tra quei due determinati fondi vi deve essere una servitù, ma essa stabilisce unicamente i presupposti per i quali è necessario costituire la servitù, e sarà poi onere delle parti, e in particolare del proprietario del fondo potenzialmente dominante, di agire in giudizio per chiedere al giudice di costituire mediante sentenza una servitù.
